When I was reading what you posted that she wrote it as she had 3 weeks to decide plus three weeks to give back the money. How far does she live from you. did she say she was coming to get her back? I dont think the court would go by her email but by the contract. But yes do keep all copies of what she says to you by email. If her contract states a 3 week dead line. She can always come up with the money by three weeks and take the girl back. she could always say that that email was letting you know what she was planning on doing , so that you would know ahead of time. with in three weeks if you dont see your money back then she has broke the contract and theres nothing she can do to get her back. You will then have to pay her the remaining amount. I hope that she changes her mind and lets you keep her. She didnt want her in the first place or she wouldnt of let her go. my fingers are crossed for you.

Well it seems she was using me as a bank to help pay her bills since she wasout of work & had no intentions of letting me keep her, she will be back forsale to the highest bidder soon

| I just wanted to say I think Lola is gorgeous and don't blame you for wanting her. I have four and my boys adore me, but my girls love their daddy. I do all the grooming, bathing, etc. In my opinion, you should sell the boy because he will feel left out. You have loved this little girl for so long and someone will give your little boy a loving home. Not saying you don't love him, but since you haven't bonded with him, please do him a favor. There is someone out there just dying to have a little male to love. I have a very hard time with my girls not wanting me and I am with them all day. The minute my husband comes in, the girls go nutz for him. I am not being ugly, just honest and I truly hope everything works out the way you want. I have a friend that prefers males only because she says they love her. God bless and good luck. Jan |

| You have two choices, fight or give in. I would e-mail her back with the part about payment due upon termanation "if maria wants to terminate this contract she will pay rachel her full deposit at time of termination" and state that these are the terms of the contract, if she wants to terminate the contract the depost needs to be refunded within 24 hours and Lola immediately picked up(DO NOT TAKE HER TO HER, make her drive to YOU).Wait 24 hours then send the remaining amount(money order or cert. check) via certified signed mail and mark the payment "final amount due". If the lady doesn't have money she won't take you to court or bother to pay a lawyer. Even filing in small claims costs money. You are not Check-n-Go, you did not give her permission to "borrow" your money, if she can't immediately pay you back she has voided her contract with you and Lola is yours. You've already incurred vet bills and honestly, I'd get her fixed if you can afford it. That might make Lola less "valuable" to her.

| The other option is give in: it's more painful but it's over quicker. You give her back to the conniving b*tch and move on. I'd personally go with option one posted above-FIGHT for her. But the heart sometimes hurts too much to fight. She'd have such an awesome life with you but people like Maria are too materialistic, she probably misses the attention Lola got her. It's something to own that she knows someone else wants and that is what makes her happy

| Does this woman know where you live?? Just be careful that she doesn't come over and try to force you to give her Lola back. It's better if she doesn't know where you live. It sounds like she didn't follow her contract. I would talk to a lawyer. Just make a simple phone call, explain the situation and ask if you have a legal leg to stand on. If you do, then I would NOT return her.

Also, I am glad you might be able to do something with her e-mail that might work in your favor as she did not state an intention to pay you right away as it said in her contract. You might want to e-mail her and say that you understand her intention is to get the dog back but the other half of your agreement was for her to refund your deposit right away and she is unable to do that so you would be unable to give her her dog back unless you got her money back right away, as it is stated in your contract of she decides to cancel. Otherwise, I would tell her to stop playing games with you. So she just expects you to keep her until "she gets her finances togeher" and further bond with her and then just give her back. I'm sorry, I would tell her you are not a boarding home, not a doggy daycare and you can not keep caring for this Yorkie, whom you have fallen in love with and bonded with if she has already decided she wants her back, she needs to get the money to you within 24 hours or she is violating the terms of her contract! Tell her you have seeken legal council. Get a letter from a lawyer and overnight it to her saying these things...On a phone conversation, tell the lady you got her fixed or something... Ok..I'm gonna stop rambling...I hope I said something helpful in this post...
