| You know EXACTLY what she is pulling, don't you. Now correct it. It appears she wanted a free credit extension from you. Now that it's time to pay up she has forgotten your name. The little girl is probably just tinier, which of course makes her cuter when they are that young. She either wants to keep the girl for herself or realizes that she can sell the girl for more money. Heck, she probably already has someone lined up to buy the girl. You either get the girl or you will see her in small claims court.

| [QUOTE=lillyrican;1034349] She then tells me that she would have to speak to her husband. I was like okay. That was her way of getting out the coversation. I gave her three days, she didn't call. So I decided to call her Wednesday. She then mentions that she and her husband would be willing to give me 700.00 as a stud fee. You know if there was a BIG RED FLAG ICON I would post about 1,000 of those right here. LOL. She is a con artist in the making. Of course they would give you $700 stud fee. They want the puppy. She wants to pretend that both of those pups are hers now and that you simply donated your male. Yeah right..... Small claims only cost $40 to file. If she doesn't hand over the female then I would tell her that she will be served papers and sued for the price of a top Yorkie female. Do you have any paperwork or is this all going to be heresay?

| i agree that is wrong of her if that is what is promised that is what you should get. and if shes a coworker doesnt she work just as much as you she cant expect you to take care of the dog any less then she. poor little girl all she needs is someone to take care of her no matter her size and its not fair to you to not get the right to give that to her when it was promised to you? I understand that 8 weeks is to young to take the puppy and you should wait. my anna was a small girl and i didnt get her till she was almost 15 weeks cuz of her size. how small is this girl? if she is that sickly maybe she does just have otehr problems. |

| I would tell her you insist to go with her to the vet and find out exactly what is wrong with YOUR little girl. It does definately sound like she is trying to pursuade you out of the girl. If she keeps her, she can breed her too... or is the girl really that small?

| She took her to the vet and the vet said there is nothing physically wrong with the puppy. She is just small, and a finiky eater. I believe she weighs about a pound. I think she is just coming up with every excuse in the book not to give me the puppy. |

This is good advice. I'd make it clear that you are very serious about the health and well being of both puppies, however there is a verbal and/or written contract stating that the female was to go to you in leiu of stud fees. Request the vets name/number and make it clear to her that you intend to see this agreement fulfilled. Remind her that since she cannot register until you sign off on the papers if she continues to pursue this avenue she will have an unregistered female that won't be worth as much as she thinks. Start getting all this down in writing too - original conversations w/dates and all current conversations. Good luck! Last edited by simplyyorkies; 03-30-2007 at 08:10 AM. Reason: misspelled word | |

| You know, even if you don't have any agreement in writing, you had a verbal agreement. What will help you in your defense that this was a business dealing is the fact that you and this co-worker are NOT life long friends. You knew each other through your job. No big weekend cookouts, raising your children together, etc. You will be able to show that she is just that, a coworker. Believe me this will help tremendously as it will show that this was more of a business dealing/verbal agreement.

| Thanks for all the great advice, but unfortunately I didn't get our agreement in writing, it was a verbal agreement. Even though it was a verbal agreement, she told everyone in the office about our arrangement. She even asked me in front of all of her co-workers what I wanted to name the puppy. She's been sending me pics of the puppies development. When I went to visit the puppies at 6wks, she was like, well two more weeks and they will be ready to go home. |

I would be asking any of those coworkers if they would be a witness during your small claims case. I still think you have a VERY STRONG CASE. This coworker will be forced to come up with a good story on why you would let your high priced male Yorkie be studded out with nothing in return. The fact that she has sent you photos and updates is only more proof. The Judge will be able to see right through this one. I still say "go for it". She is trying to scam you and thinking that there is nothing you will be able to do. The fact that she offered $700 now for stud fees - have her put that in writing. That she now wants to back out of the female pup deal and instead offer a $700 stud fee. That should hang her right there. Of course don't sign it. Once you have it in your hands tell her that your friend's husband is a lawyer and you are going to ask him about it.
