I don't know. I guess it's possible. I'm a VERY reasonable person. I'm willing to work out a reasonable time line to expect a refund and I'm even willing to take the losses on the vet bills I've incurred and the return shipping for Emma, but I still want my initial purchase price back so I can purchase the RIGHT dog for me when one comes along. She's attacked my integrity that's really upsetting for me. I spent 5 years active in westie rescue took a few years of a break and now I'm the rescue director for Wasatch Avian Education Society. My WHOLE life has been dedicated to helping animals in need but I'm just not set up to deal with the problems Emma is presenting in my home. If I didn't have small children and a tiny Yorkie, things might be different and I'd take her on. But I can't place any more at risk. If Emma were MY responsibility, I never would have placed her in my home to begin with. As rescue director, I pride myself on placing the right parrot in the right home based on environment, situation, experience and the needs of the bird. As a breeder, I expect the same thing. After all, I don't get monetary compensation for what I do. She does. Therefore, she should take a little more interest in what she does. I feel the seller knew it wasn't a good fit and that's the reason she got combative when I initially contacted her and then again, here on the forum. I'm at a loss. I don't know what to do here. But I do know that if I have to file charges for fraud, I'll be asking for way more than my initial purchase price. I want to thank everyone for the support and the links for Florida fraud. That's very helpful information and very kind of you. |
Wow, I just read through most of this thread and I'm really sorry to hear that things are not working out with Emma. I hope the seller responds to you soon and that Emma will be able to find her forever home. |
I was looking at those pics back and forth and back and forth comparing. There is no way that is the same dog and not sure what some see that makes it the same. If you look closely below it's chest, in one you can see black hair on the lower part of the chest. In the first one it's golden all the way down to it's belly. I don't know about anyone elses yorkies but Roxie didn't darken as she got older, she lightened. Plus the nose has a bunch more black on the bridge and just looks a little longer in the snout. |
I've just come across this thread and it poses several interesting issues. First, I am no expert except to the extent that I spend the greater part of my life lately staring at Yorkie pictures on here and, to me, that doesn't even come close to looking like the same dog. But whether it is or isn't, I just want the OP to know that bringing a lawsuit for fraud may feel morally right to you, but it will be a huge headache trying to bring someone from across the country into small claims court. I feel for you so much. Purchasing a pup on the internet is risky, but sometimes we don't have a lot of options. If you live near me, I have not found one Yorkie breeder anywhere near me. Pet stores are not an option. Even if you do get to meet the pup before you purchase, there is still so much risk involved. My breeder boasts on her website that she promises you will get a healthy, well socialized puppy. I spent almost $1,200 to get a pup with a liver shunt who, since being diagnosed last month, has already cost me between $4,000 and $5,0000 dollars in medical expenses and that's just the beginning. My breeder didn't give me a dime or an ounce of emotional support. Can I sue her for fraud? I doubt it. I don't want to hijack this very upsetting thread. Just want to tell you that I feel for you and understand how you feel betrayed by someone in this community. The upside to my situation is that I do have a wonderful dog that I love dearly and who fits in with my family. I just hope you don't get into a protracted legal mess that will cost a lot more than Emma. If the breeder ignores you and there is no hope for training, then maybe you should concentrate on finding her the best possible home. You will be out the money, but you will have the satisfaction of knowing you did the best thing for Emma and probably got her out of a situation where she wasn't wanted anyway. A breeder who cares about her Yorkie would never respond like this. |

I know your situation is very real to you and I don't want to minimize it at all. I will say though - this situation hurts every REPUTABLE BREEDER. Yes, it does. People will remember if they are looking at a new breeder. *walking away shaking head* Best of luck in both of you to get this worked out in a fair manner to both. Please hug that little girl for me! |

I really hope they're not just immature, irresponsible kids bickering at each other at this point otherwise, I'd say they all deserve each other except that I feel real sorry for the dog now. I really hope I'm wrong and the links are wrong and the ads are wrong and the Chelsy's yorkie website advertising the dog is wrong as well. Crazy! Talk about soaps. I really hate them myself. :mad: |
