Are there puppy lemon laws in your state? Buster came with kennel cough which verged on Pneumonia and they had to pay his medical bills for the treatment of kennel cough. They did not pay for his Giardia or Coccidia issues.

Exactly where is the trashing of the OP? I didn't even disagree with the OP...reread.

I have seen many of the same people here say the opposite...return the pup etc....merely an observation on my part.

I've only the word of the OP regarding a seemingly Reputable breeder. I've seen nothing other than her word, though I didn't say it was untrue so not sure what your alluding to?

The only facts that I can ascertain are that the OP met the breeder, chose a seemingly healthy pup, at some point the pup became ill, the OP decided to keep the pup and a breakdown in communication ensued between the parties. The contract was specific as to what was to be done, it wasn't done in this situation, OP admits this here and thus far there is no resolve.

My opinion, (set aside my own sincere sympathy for OP, OP's husband and this poor sick pup), is that this was a very sad and unfortunate occurrence that regardless of what the parties agree or disagree on there is still a sick pup. I don't believe that OP would have chosen a sick pup had the pup presented ill upon the selection? Nor do I believe that this "reputable" breeder would have sold the OP a sick pup, intentionally.

I do think that at this point the breeder needs to live up to her part in the contract. Obviously the pup is in good hands and the OP is taking good care of the pup that she has chosen to keep just as I did with Mini.

In the end all that matters is this pup gets well. I wish OP(s) the best and I sincerely hope this pup gets well soon.

Trashing? not at all, just my opinions.

OP please keep us posted on the outcome involving the breeder, I am anxious to see what she eventually decides to do. I also hope that you get well soon.

This "disposable world" we live in can be so depressing!! I get sick of hearing about life being measured in dollar bills...it's not just dogs or animals in general either. It includes humans and ALL life really....
I promise you, I will take care of Maxwell.

He's not disposable to us. But it hasn't helped to buy a sick puppy.

You are asking for an absolute resolution on your terms without providing any proof to the breeder. Mrs. Marksbury has agreed to honor her contract.

I believe that the owner should be getting that paperwork out shortly. It is reasonable for a breeder to request the results of tests that have shown a problem or problem(s) going on.

A second opinion for sure can be sought at the breeders expense, she can pick a board certified opthamologist within a reasonable travel distance to the purchaser. Should the purchasers vet health records and the current opthamologists consult report not be enough to satisfy the breeder.

As a breeder who would never knowingly breed a dog with a genetic condition I would gladly pay for that consult, especially seeing as I have done no CERF's according to the CERF registry on either one of the breeding pair. If this dry eye is autosomal recessive that means both these dogs carry the gene! And that by God I would want to know for sure that this puppy has this condition. If it is autosomal dominant, and some diseases can be, without full penetration throughout the litter, then at least one of the littermates from either sire or dam would have expressed this condition.

This is a life long condition, and maybe surgery (which will be expensive) just might correct it, but if not you are talking about drops for the lifetime of the dog.

All medical records will go out this week. Breeder hasn't asked for them, but I am sending them.

Maxwell's left eye improved a little bit, but it is now in his right eye.

The Vet explained to Sheila, that the reason she knew to do the Schirmer tear test, was because Max's left eye was so dry.

Rich and Sheila and Max. It seems to me that the best thing right now for all, is to heal up; to focus on just doing those things that nuture and support you all.

You three will get through this, with all the love that you have for one another.

BTW...I think the breeder did offer her a pup from a different litter on here. She may have not did it in her email, but I am fairly certain she said it on here....but she did not offer to refund her money.

EDIT TO ADD: Looking back...yes she did say a pup from any litter and she offered to have it vet checked and certified.
The breeder has only offered us a littermate.

We hesitated to take a littermate, due to the fact that there may well be other congenital issues in that litter.

Thank you for your prayers. We really appreciate prayers. I don't know if I deserve such a medal, but Sheila makes it easy to be a good husband.

No puppy lemon laws in Indiana.

Never expected to need a law.
