| I got an email from the breeder and this is what she stated. Didn't even open the photo, because you are right we accidentally gave you Mandy and the lady who was supposed to get Mandy and picked puppy up yesterday before I read your email, just phoned me telling me she has a boy and of course, she paid for a girl $700 and she wants a girl. I know you are attached to the puppy, but you paid for a boy $500, if you wish to keep the girl puppy I will have to have you send me the additional $200, or you may choose to bring your puppy back and get the boy. I am sorry for all of this confusion. Let me know your decision. SO I RESPONDED WITH THIS. This is not at all possible because we have spent a week with the pup to try to addapt to her needs, and we feel as if it is not at all our fault because we did not realize he was a she untill a week later. If we had found out about this a day or 2 after before getting attached then it would not be a problem of returning her but there is no way we can return her now. I feel the 200 should be ignored because it is entirely not our fault. we have grown attached to the puppy and treat her like our own child we could only afford 500 or else we would have paid 700 for a girl at the time. We were just as shocked when we found out our toby was a girl, but there is not much we can do now except hope that you will understand that the situation is entirely out of our control. we cannot pay you the extra 200 and you can refuse to send us the akc papers if you wish, but we wish you find it in your hearts to do so because it was entirely not our fault and the matter is out of our hands. What do you guys think here on yorkie talk, am I right or am I wrong? I feel that what I'm doing is right and the mistake was on the breeders side and not mine. |

| As for the correct AKC papers, is there a way to contact the AKC and get my pup the akc papers? I have the litter number the akc assigned to my pup and im sure the breeder will refuse to send me the correct papers, does anyone have an idea on how I could persue such. |

| In my opinion, that breeder is Ridiculous. How does she expect someone who has Already fallen in love with a puppy return the puppy or send her more money. That is entirely her fault. It's not like you did it on purpose or anything. I think you did the right thing. I would tell her to keep the papers if she wanted to be cold hearted and all then that is on her consience. Once again not your mistake. She should have to deal with the problem of what to do with the people that accidentally got the boy. I feel you are doing the right thing. After all its papers vs. Miss Toby.lol I honestly do not know how I could return a puppy reguardless of gender after I had fallen in love with him/her. Good Luck. Keep us posted |

| Is there a way to contact the AKC and get the papers myself for my pup? I do have the copy of the AKC Online Litter Application, it states the breed and litter number along with the date of birth and all the necessary info. Is that enough to prove that the pup belongs to me? Would the AKC send me the correct papers for my pup? |

| Papers As for the papers I am not really for sure what to do. Visit AKC's Website www.akc.org and also here is what I copied off AKC's website for you. I called them to ask them some questions and they were VERY helpful, they can also give you advise. Customer Service phone: (919) 233-9767 This office is responsible for handling all calls involving any type of registration question or problem. When you want any AKC registration forms or answers to registration questions, this is the office to call. If you are calling about a registration application, keep in mind that the normal processing time is approximately two to three weeks. Hope this helps. |

| Well, wow! This is just plain and simply NOT your fault. What happens to the other people simply isn't your problem (I know that sounds cold, but come ON!) The breeder should have made sure this didn't happen. I really don't think the burden should be on YOU for her mistake. Hopefully she'll have learned her lesson and will keep something identifying on the puppies from now on. I'd be interested to see how the other breeders here on Yorkie Talk would handle this situation. Take care and PLEASE keep us posted on how this is turning out.

| A later post http://yorkietalk.com/forums/showthread.php?t=1969 seems to indicate that they found out over the weekend that Toby was indeed a girl and that the breeder made a mistake.

| If you don't plan to breed her than the paper are not important. Both of mine have papers but I didn't even register them, the are both fixed. did you sign a contract with her saying you were to get a male dog? You took her to the vet, how much did it cost? That is money you have put into Miss Toby. If you could come up with a $100 dollars and split the extra cost of Toby being a female, maybe the breeder would drop it, I would hate to think she could get the puppy back after you have come to love her so much. Let the breeder know you have put money into Toby, taking to vet, supplies, ect. If she knew you had already but $200 in to her and you would want that money back. Just some suggestions. I hope you get to keep Miss Toby................Cindy |
