it doesn't look like the same dog to me. There is not dark marking on his nose in the first picture but the other two the dog has black markings on his nose. I can't believe someone would do this..

Even if the Op sells Emma she is not going to get what she paid for her and the breeder should give her the difference. Just because the Op sells her doesnt mean the breeder should get off scotch free

People on yt seem to be very concerned for all yorkies and tend to jump on the bandwagon to defend them. That is a great thing, but can also set people up for these types of situations.
Let's take a moment to truly look at this thread in a broken down form
1) OP questions whether the two dogs look the same
2) OP states that she feels she was duped and seller is not taking responsibility
3)Seller comes on to slam OP for supposedly not taking care of the pup and threatening legal recourse for slander.
4)OP comes on to say that is all lies
5) OP husband comes on to say he will sue if seller does not take responsibility
6) outsider comes on to say pup is posted in ads on other sites under same information original seller used to sell this dog
7) Seller IMMEDIATELY comes on to slam op again (therefore she must be watching very closely even though she states she is moving on)
8) OP comes back on to say that those ads were all an accident and she wants what is best for the dog.
9) YT members start to offer money for the well being of said pup
10) OP starts to actively plan a resolution to the outcome of pup.

Several things of note here,

1) OP was offered at least a partial refund in writing.
2) OP is responsible for due diligence in any purchase, therefore she is responsible for the pup once it comes into her home.
3) Seller NEVER at any point showed concern for the well being of pup
4)OP has not explained why her "friend" says she does not know her or why the other ad was posted.
5) Seller is no longer posting on this thread

Now I am not stating anything by pointing out these facts. Just wanting to rationally break it down so emotions are not all that is playing into others reactions.

Who knows, I am known for killing threads, maybe the norm will happen.

This is truelly killing me.I want this baby girl to have a forever home.I just want what is best for her.If the owner of her now tries to sell her she truelly won't get what she paid for her,lets face it she is 1 yr. old and will hopefully be fixed before being sold.You would be lucky to get a few hundred for her.

If I have to place Emma, I'll place her on a spay contract but we all know that it's not enforceable. I'll do my best to ensure she gets placed in the right environment. However, try to understand my side here that I'm taking a HUGE monetary loss. Even intact, her value is at best $400. I just simply cannot put any more money into a dog that I'm not keeping. I feel for Emma too but I'm stuck in a pretty horrible situation and I honestly can't endure any more losses.

If that makes me a bad person, I'm sorry. But I don't know many people that would happily toss away the same amount of money. Please don't say you would because you're not in my situation.

Poor Emma-I am pretty sure she is catching the raw end of all of this. And it's all about money. How sad!!!

I am sure a rescue could rehab her and find her a wonderful home. People that want her and love her. Alot more than can be said for what is going on here. And it would mean someone would be out money. Which at this point-if you want her out of your house so bad-is quite irrelevent.

Out of curiosity I looked at a couple of Yorkies for adoption. A 4 yr old spayed breeder release was up for adoption for $400 in MN. A 5 to 6 month old spayed breeder release was up for adoption for $400 in OH just last week. I don't know how they determine they price.

Every now and then I log on and I cannot believe this situation is still not resolved. ......I realize no one wants to take a financial hit, but this is ridiculous ...I only think about poor Emma , what darn shame for her to be caught up in this......

If you'd have been HONEST with me, I never would have bought her and YOU KNEW THAT.

I've spent my entire week talking with people regarding this dog (mostly yesterday and today). Yes, I was going to place her under the same conditions that YOU placed her with me under... in tact and breedable. But she's not a good specimen to breed and I know that now (I don't breed dogs btw so I'd have no friggin clue what's a good breeder and what isn't). But several of my close friends, one being a breeder of beagles saw Emma within the past 2 days and told me flat out she's not what you presented.

Yep, I was going to spay her if she worked out in my home. I told you that. But she's not working out. Something else you knew before you sent her here.

So if you're so damn concerned, WHY DON"T YOU TAKE HER BACK ????
