I didn't mean to rile you. I don't blame your for changing your mind. I'm just saying by accepting the check, you formed a contract, agreeing to hold this puppy for them and not to sell it to anyone else. So if they wanted to be nasty about it they would have a pretty strong case.

I agree with you, I wouldn't want to sell it to them either. But courts tend not to see things as black and white. There is a lot of grey inbetween.

If I gave a deposit to someone for a puppy, and I have, i would be extremely upset if they turned around and said they changed their mind. What else is the deposit for if not to make the contract binding.

I am glad you decided to keep your pup and wait for a suitable home. From what I read it doesn't sound like they are financially able/committed to care for a Yorkie. I believe you acted in the best interest of the pup!! Congratulations and now you can sleep peacefully!!!

return their deposit and tell them you don't have time for someone who doesn't have time for a puppy. the poor dog would surely suffer if they can't even take time to get supplies and get her i think your feelings are right...or you could just tell them you decided to keep her for yourself.

I might sound riled but Im just feeling strongly about the situation. I dont look forward to being the big ol meanie by any means!!
ANd I appreciate the view, it makes me think. Ive never did this before. I dont make a habit of disappointing people. THey might be afraid to ask for the deposit, or even releived in the long run, even though they said dont sell the puppy.
I dont have a formal contract but an angel must have been sitting on my shoulder because I looked thru my emails and I stated the deposit term in writing which I stated I could return the deposit for any reason to them, which I rarely do, usually I just say it verbal. So maybe that would be good enough because they agreed to those terms when they replied with "we are sending a deposit. "
I think they might be mad at me, but I dont think they will try to sue me. I think they might just move on to buy from someone else. But who knows!

To be honest, I believe they would have a case if they refused to accept the returned deposit and insisted on the puppy. So you will be lucky if they take back the deposit and walk away happy.

They might be realizing that this was not a good idea but are afraid to tell you they changed their minds for fear you will keep the deposit.
i don't think they would have a case even with a check because it should have been picked up at a reasonable length of time and she has made every effort to give it to them.

OMG, Bobbi is so cute! I'm the same way with my dogs. I treat them like they were my kids. When my sons were born a long time ago, didn't have money for extras for them until they were a little older. I missed buying that frilly stuff when they were born. They still claim I wanted to dress them like girls. I spoil my dogs like you do.

DH and I have no skin children yet............so imagine how spoiled they are

I grew up in foster care.........

Maybe sometimes I am over-protective.........but it makes me happy to be able to give them all my love. I am a true believer that God put them here to humble us humans and to me, they are nothing but Lord's special gift

Yes, Bobbi is from Kelly Anderson's breeding. I have nothing but marvelous things to say about her. Bobbi is super healthy, well-socialized, and just perfect

I agree with Peters .... you want your pup to be in the best home possible ....

Send the letter and CHECK... RRR and signed ... you will also have the deposited check as proof of acceptance ...

NO Havent called yet Havent got up the nerve yet but I will. Ill let ya know if I get a good cussing.

Been taking pictures of lil girl to show. THought Id share. SHes very sweet, weighs 2 lbs 12 ozs at 13 weeks. SHe isnt AKC registered, this litter was CKC (continental kennel club) Dad is AKC but mom isnt.
THought Id let you see the heart stealer. Theres lots of pictures.

That is unfortunate, but I agree with your decision to return the deposit and be done with it. For the future, I think it should have been a 'red flag' to you when YOU made the phone calls to stay in touch with them. That should never be necessary for any breeder to have to 'go to' the customer. If they don't call or e-mail you regularly, then assume that they are not really that interested and go elsewhere immediately!
