A mistrial in a criminal prosecution may prevent retrial under the Double Jeopardy provision of the Fifth Amendment, which prohibits an individual from being tried twice for the same offense, unless required by the interests of justice and depending on which party moved for the mistrial. A retrial may be barred if the court grants a mistrial without the defendant's consent, or over his objection. If the mistrial results from judicial or prosecutorial misconduct, a retrial will be barred. In United States v. Jorn, 400 U.S. 470, 91 S. Ct. 547, 27 L. Ed. 2d 543 (1971), the Supreme Court held that reprosecuting the defendant would constitute double jeopardy because the judge had abused his discretion in declaring a mistrial. On his own motion, the judge had declared a mistrial to enable government witnesses to consult with their own attorneys.

I cannot imagine that a person could get off that way. If that were the case, every defense attorney out there with a tough case could play games and look for a mistrial to get their client off. But...what do I know?

If you listen to the mother's three 911 calls, you can tell Casey finally tells her Caylee has been missing for a month, and her emotions are very real and raw. I think the grandparents just couldn't bear to think this about their daughter, it's too horrendous.

Sounds to me like those people have probably enabled that spoiled brat all of her life and accepted her lies. They seriously need to seek help themselves after this is over if they have not already. I cannot imagine the toll this has taken.

One thing I learned in this trial is that the mother convinced Casey to keep the child, Casey wanted to give it away. Before I read about this, I thought that would be a good thing, but now I wonder? If a girl wants to give her child away, maybe that's what should happen, or adopt the baby yourself. She didn't want to be a mother, and no child should have a mother who doesn't want to be a mother.

That poor darling baby girl is the one who really suffered. To think she left earth in such a horrific way...someone snuffing her life out...whether accidental or intentional. I do believe Casey killed (whether accidental or intentional) her so she could play. Tragic

| I totally agree. They have enabled and made excuses for her for a long time. It just seems like this family is really dysfunctional!
