I cannot imagine that a person could get off that way. If that were the case, every defense attorney out there with a tough case could play games and look for a mistrial to get their client off.

I'm no expert either but from my Law and Order (lol) watching...I think clients do get off due to prosecutorial misconduct...however I don't think attorneys would do this often because wouldn't that ruin his/her reputation?
