Omg Has anybody been through this?

My dad recently bought a new car from a small dealership and now he's finding out that the guy who owned the dealership committed a bunch of fraud and has declared bankruptcy. The car that my dad bought has a lein on it (money still owing on the car) and the dealership's credit company wants to repossess the car It's completely unfair, as my dad paid for this car and now it must be taken away for no fault of my dad's. I was just wondering if anybody here has been through a problem like this and has any advice or thoughts? Anything would be helpful, thanks in advance!

CholeandJ just had a thread about this recently. Unfortunately it doesn't look too promising on getting any money back.

The point we are at right now, is all dealers must have a bond protecting customers. We have sent in a claim but have no idea if we will see any money. Be sure to report it to the DMV and they can also tell you how to the the information on the dealer's bond.

Oh my goodness, I had no idea this happened to you, too! I'm going to go read your thread. There is a compensation fund that we can file for, but the maximum payout is only $15000 and my dad paid almost twice that for the car. Another problem is, he paid most of it by certified check but paid the rest in cash, so there's no paper trail for the cash, and so he can't prove the actual price that he paid for it Can I PM you to talk more about this?

He surely received a printout from the company with the price he paid for the truck? They usually print out a long yellow piece of paper with everything on it.

Well, on the sale agreement/bill of sale, the guy only put down the amount that my dad paid by certified check...he didn't include the amount that was paid in cash. When I went with my dad to pick up the car, I kind of had a bad feeling about the place. I told my dad that I had a shady vibe about the place, but he had aready put a few thousand dollars deposit on it and just figured it was ok, since it was a legit dealership and not a curbsider or anything like that. I should've gone with my gut feeling and convince my dad to not get the car

Of course it's water under the bridge now, but THAT was a red flag.

I don't think there is anything he can do about that. I'm sorry

Of course it was a red flag but at the time you don't think someone is trying to scam you. It's a very unfortunate lesson my hubby and i learned and i'm sorry your father has to go through this as well.

Does your father know what the amount of the lien is?

My dad has done dealings like that before and has never gotten screwed over by it. We just didn't think that a legit dealership was capable of a scam like this. Hindsight, there were many red flags and we are now aware of that. No need to point it out and make me feel worse about it.

I'm sorry you and your husband had to go through this as well. We can both understand how much it sucks I read that they took the car from you already. Are you taking any other steps to try and get your money back?

We don't know what else there is. We just can't afford an attorney at this point. We're staying hopeful with the dealer bond. If that doesn't go through, i don't know if my hubby has the energy to fight more for it.

Your dad can file reports with the police and better business bureau. There may be others that were ripped off as well. I googled a bunch of stuff and did find other people that were ripped off by our dealer however i was not able to contact them unfortunately.

My dad doesn't want to shell out money for an attorney either, especially since it's not a very hopeful case. We went to file a police report, but the Constable said it wasn't neccessary, because a bunch of other people had aready filed police reports on the guy. Apparently this jerk ripped off atleast 12 other people He's currently on house arrest until his trial, but that doesn't help us keep the car or get our money back

Oh, I forgot to tell you that the lien on the car is around $22000...and we are NOT paying that much to keep it.
