Has anybody been through this? My dad recently bought a new car from a small dealership and now he's finding out that the guy who owned the dealership committed a bunch of fraud and has declared bankruptcy. The car that my dad bought has a lein on it (money still owing on the car) and the dealership's credit company wants to repossess the car :( It's completely unfair, as my dad paid for this car and now it must be taken away for no fault of my dad's. I was just wondering if anybody here has been through a problem like this and has any advice or thoughts? Anything would be helpful, thanks in advance! |

We have sent in a claim but have no idea if we will see any money. Be sure to report it to the DMV and they can also tell you how to the the information on the dealer's bond. |
Oh my goodness, I had no idea this happened to you, too! I'm going to go read your thread. There is a compensation fund that we can file for, but the maximum payout is only $15000 and my dad paid almost twice that for the car. Another problem is, he paid most of it by certified check but paid the rest in cash, so there's no paper trail for the cash, and so he can't prove the actual price that he paid for it :( Can I PM you to talk more about this? Well, on the sale agreement/bill of sale, the guy only put down the amount that my dad paid by certified check...he didn't include the amount that was paid in cash. When I went with my dad to pick up the car, I kind of had a bad feeling about the place. I told my dad that I had a shady vibe about the place, but he had aready put a few thousand dollars deposit on it and just figured it was ok, since it was a legit dealership and not a curbsider or anything like that. I should've gone with my gut feeling and convince my dad to not get the car :( Quote:

My dad has done dealings like that before and has never gotten screwed over by it. We just didn't think that a legit dealership was capable of a scam like this. Hindsight, there were many red flags and we are now aware of that. No need to point it out and make me feel worse about it. Quote:

My dad doesn't want to shell out money for an attorney either, especially since it's not a very hopeful case. We went to file a police report, but the Constable said it wasn't neccessary, because a bunch of other people had aready filed police reports on the guy. Apparently this jerk ripped off atleast 12 other people :eek: He's currently on house arrest until his trial, but that doesn't help us keep the car or get our money back :( Quote:
