She came to see him and she liked how he was calm and friendly. She said that she wanted a yorkie that was calm because the yorkie that she used to have was a barker. She had us give her a copy of his papers so that she could look into his pedigree or whatever. Then she added that she had been sued before and just wanted to be careful.

So she left and came back the next day w/ cash. She was also asking me & my fiance what we did for a living (which I thought was sorta rude). She wanted a receipt, and she didn't like how I put "As Is" , "no refunds". I had a bad feeling about her. She wanted something written on there that she could bring him back if the vet said that there was a problem. She EMAILS me that evening to say that I took advantage of her and that I wanted too much for the dog. She goes on saying that the dog had psychological issues and that she wanted her money back. I wrote her back right away. I was nice about it and said that I just wanted a letter from her vet stating his diagnosis and that I would want a second opinion from my vet (she could be present, I would've cared). She didn't respond for TWO days! ["]She calls and says that if I don't return the dog she will take me to small claims court. I don't think I was asking for much here, just a letter from her vet. I have a feeling that she sues a lot of people and that she is just trying to scam us.

So my boyfriend noticed that the first email that she sent the day she bought him wanting to return him, was cc'd to an attorney. So I talked to my Mom who is a paralegal and had her talk to her attorney about all of this. She told me that this will probably be thrown out of court, but I am worried about myself and for the dog. I hope she isn't being mean to him or anything. I don't know what to do about all of this. I don't want to have to refund the money to her because Sassy is back to herself and soo happy that he's gone. But then I don't want the male dog in a bad situation either (which he was when I first got him).

Ooooh and it gets better...she's now saying that the yorkie is a silky and that silkys only sell for $50. What? The yorkie had papers! What is she talking about? Im worried, I don't wanna be sued, nor do I wanna go through all of this hassle. Im sooo confused. Any Advice would be so greatful. Thanks!

I'm confussed who has the dog? you said you sold the dog to this woman, and then two days later she calls and says that if You don't return the dog that she is going to take you to small claims court??? am i reading this wrong... Where is the dog?

its so sad that there are scammers out there or people that just cant be nice and work with others to do whats best for the dog

I think she meant take the dog back....accept return of the dog, in exchange for a refund.

I agree, I would want the dog BACK and find a better home for that pup.

I would definitely let her return the puppy for a full refund. It's not even worth the time and money it'll take to deal with someone like that. Plus, who knows how she's treating the poor puppy. I'm sure you won't have a problem finding a new home for the puppy, just go with your instincts this time. It's really sad that there are so many people out there like that.

She's a scam artist @ work! I can't wait until this whole thing is over. AND to boot, she is threatening to have him DNA tested to see if he's a real yorkie. Don't the owners of his parents have to be willing to do that? I doubt that she will go that far. She's a real piece of work!

She is lying, she is trying you for a fool STOP all contact and call a lawyer. Call that lawyer ASAP. Also do not pay this woman anything past the money for the dog. I bet anythign she already sold him and will say he died, that is her next stunt

Please just get your puppy back. After that, put a restraining order on her if she keeps harrassing you. Best of luck!!!

I can feel for you...same thing happened to me ONCE AND ONLY ONCE!! let me tell you there are people that are just out to cause trouble and this client was just that TROUBLE....all over a $500 puppy deposit, I was first threated by her attorney friend...!!

Client sued for $5000; in mediation she was asked why $5000 her answer was "she should buy me my next dog"...she played the poor defenseless puppy buyer, the judge awarded her the $500 period....poor and defenseless is not what this woman is yet she played her role brilliant in court.

She called the county animal control, which they too enjoyed playing with the kids and found her claim to be false and spiteful...she then filed a BBB report filed with nothing but lies "which I was able to get removed, they too saw through her."

The best, is the attorney that advised her...then sued me and 26 other forum members for $2 million yep you read it right 2 MILLION!!!!!

My attorneys (I hired TWO of the largest law firms in San Diego) advised her to sign a dismissal with prejudice, it was either sign and dismiss or we were filing for court sanctions for attorney misconduct, filing a frivilous law suit, attorney fees and court cost!!

DISMISSAL WITH PREJUDICE - When a case is dismissed for good reason and the plaintiff is barred from bringing an action on the same claim.

NOW the kicker....the ink wasnt even dry on the signed dismissal papers, she threatens two forum members with a lawsuit!!

Harrassment comes in many forms and this was harrassment at its best....remeber stand up for what you believe in, you will prevail in the end!!!

I believe you forgot the part about being on Judge Judy though....lol. Sometime I believe my life (and yours apparently) would make a nice MTV reality show.

Lets just say the attorney had and has too much time on her hands and if someone says something she doesnt like on a forum she threatens a lawsuit to get her way or force you into her way of thinking...

Mardelin, this was not a public issue it was private, the client attempted to make it public, I was called by several daytime shows, which of course I refused....the client wanted the DRAMA, I chose not to particpate in their childish games nor give them their 15 minutes of fame.
