Im gonna be sued... Im sooo stressed out! I live in California and I think I got scammed by a lady. We bought a male puppy a couple months ago and our yorkie was so nasty to him and wouldn't even come out of our bedroom when he was in the house. So to make her happy, we found a new home for him. Here's the story: He is ACA registered, 8 months old and blue/gold. We sold him to her for $600 (very cheap). He was about 6-7 lbs. She came to see him and she liked how he was calm and friendly. She said that she wanted a yorkie that was calm because the yorkie that she used to have was a barker. She had us give her a copy of his papers so that she could look into his pedigree or whatever. Then she added that she had been sued before and just wanted to be careful. So she left and came back the next day w/ cash. She was also asking me & my fiance what we did for a living (which I thought was sorta rude). She wanted a receipt, and she didn't like how I put "As Is" , "no refunds". I had a bad feeling about her. She wanted something written on there that she could bring him back if the vet said that there was a problem. She EMAILS me that evening to say that I took advantage of her and that I wanted too much for the dog. She goes on saying that the dog had psychological issues and that she wanted her money back. I wrote her back right away. I was nice about it and said that I just wanted a letter from her vet stating his diagnosis and that I would want a second opinion from my vet (she could be present, I would've cared). She didn't respond for TWO days! She calls and says that if I don't return the dog she will take me to small claims court. I don't think I was asking for much here, just a letter from her vet. I have a feeling that she sues a lot of people and that she is just trying to scam us. So my boyfriend noticed that the first email that she sent the day she bought him wanting to return him, was cc'd to an attorney. So I talked to my Mom who is a paralegal and had her talk to her attorney about all of this. She told me that this will probably be thrown out of court, but I am worried about myself and for the dog. I hope she isn't being mean to him or anything. I don't know what to do about all of this. I don't want to have to refund the money to her because Sassy is back to herself and soo happy that he's gone. But then I don't want the male dog in a bad situation either (which he was when I first got him). Ooooh and it gets better...she's now saying that the yorkie is a silky and that silkys only sell for $50. What? The yorkie had papers! What is she talking about? Im worried, I don't wanna be sued, nor do I wanna go through all of this hassle. Im sooo confused. Any Advice would be so greatful. Thanks! |

I would definetly give her the money back and get that poor puppy from her also!! She is certainly sue happy and I would also be worried about how she is caring for the puppy..probably not very well!! Dawn |
You have been given great advice. Give her the money back, and get the dog back from her SOON!! There are lots of people here on YT that would love him, and give him a wonderful home. Good luck! |
Please give the money back and get the puppy back. Then, to keep Sassy happy, you can find another great home for this puppy. I hate to think of it being mistreated by this woman. There was a scam on here last year about the same thing. |
Well, as a lot of people know, papers don't mean a hill of beans..there are a lot of breeders that tell you you're buying a yorkie, when it is actually a silky(this happened to my sister), anyway, I'm sure it is a real yorkie..but, I would give her her money back and take the puppy back..first of all, whenever you have one dog and bring another one in, there is going to be jealousy..that's natural. I have 3 inside, and am getting another yorkie this coming week, it usually takes 2-3 weeks, and then they become the best of friends..it takes time and patience..get the puppy back, and give your other one time to get accustomed to having the new one around..always give the first one her treats first, and let her show him that she was there first..in time she will love having someone to play with...and like someone else said, she could be being mean to the puppy and if that were me, it would break my heart.. |
When she asked you what you did for a living, she was gauging if she could get money out of you when she sues you. If someone tells you the first day you meet them that in the past they were sued, its a red flag to not have any dealings with them. Usually when people are sued or any other legal issue, they keep it to themselves. She is a moron to think that a any dog would be sold for $50, silkys are just as desirable as any other dog. This lady is a whack job, the case probably won't even make it to court. As others have said get the puppy back first then give her a refund, but give the refund as a certified check(not personal, she may somehow end up draining your account) so its trackable and she can't say she was never refunded. |
It's not worth the hassle. Refund her money and get the dog back. You can always rehome later. Good luck! |
What I would do... I would give her the money back minus processing fee's of $100.00. You sold the dog as is. Processing fees? Any documents you printed up for her, for her vet to look over. Since you sold it as is, she really has no case but if I were you I would rather get the dog back if she is this unhappy, god knows what she would do to the dog. At this point in the tranaction the most she can get back is the original sale price. If she goes to the Vet, has the dog altered, shots ect you could end up paying for things you can't prove were done unless you can get the Vet records. Then you have to be careful to make sure your Dog is the Dog that was "Actually seen" There are to many variables that she can "Make up" if you don't get the dog back and return her cash immediately. Again I would try with holding a processing fee of $100.00 unless you just want to wash your hands of this. |

Sounds like a professional scammer to me. Give her the money back, but get the dog back first. There are lots of people out there who would love to have a little Yorkie for only $600, and won't give you grief in the process. |
Ditto 100%!!! If you didn't have a good feeling about her, I would definately give her the money and get the pup back. And as the above poster said, do NOT send your money first.. You'll probably never see the dog again. You can find him the best home. Don't sell him to someone you don't like. Find him the best fit. Sorry, not to preach. :p lol |
