| I really think you have a alot here to help you get your dog back in this apartment. If you have neighbors that have seen your yorkie often and can write letters and a police report stating on one red mark that didn't seem to be a dog bite, you have a good chance. If you think in your heart it could have been a dog bite and not worth the hassle and you would rather move then that is one thing but I would fight it. I owned my condo (now I am in an apt.) for 22 yrs. and the association had monthly meeting and it was rare that more than 5 or 6 people showed up even when they were thinking of raising the maintanence fees. One day we got a letter that we would not be able to get another dog if ours died and there would be a meeting on such and such a date. You NEVER saw such a turn out in your entire life. Yes, we had strength in numbers but they did change the law there as they wanted but grand-fathered us in so those that ones purchased when when it said we were able to have sm. dogs could still get another. I know you feel alone in all this and I hope the advise you get will help you. All you have to do is run up against one person that doesn't like dogs and they can make your life hell on earth so maybe the move is best for you. Hugs, Joan

| Unfortunately, landlords do have the last word when it comes to permitting pets on their premises as they are legally responsible if someone gets bitten or injured on their property. They also can evict pretty easily if a dog is just a nuisance, i.e. excessive barking. Since Riley now has a bite on his record, right or wrong, I think it will be difficult to challenge your landlord's decision. I hope you are able to find a new place that will welcome Riley. I think I would try to get a doctor's note stating the reasons why you need Riley with you before you look for another place. I would also be really careful next time to not allow Riley to jump on or bother anyone in anyway so you don't have to go through this again. Pets are always conditional in leases and subject to removal at the landlord's discretion. |

| YT 1000 Club Member | Don't they have to give x number of days for eviction? In which case she should be able to keep her dog untill she moves out. This red mark on the woman's leg sounds disputable. If he's anything like Roxie he likes to jump up to people to say hello. I'm sure that's all he was doing. I know when I have shorts on even when her nails are clipped they can scratch a bit. He didn't know the woman was a biatch because he's never encountered anyone else that doesn't like him. You probably will be better off in a place where hopefully there aren't more of her around. Dog haters are miserable people.

| I am so sorry you have to go through this. I don't know what I would do without my babies. Sometimes I can't sleep at night if they aren't all in bed with me. I hope you find a place that allows your Riley.

| Definitely follow up with all of your options through ADA. Also, if you get enough people where you live upset about what the landlord did to Riley, there's power in numbers. Don't get discouraged. Riley's getting an adventure vacation for now with your son, and she'll be back in your arms soon, you just have to jump through some hoops first. |

| I did overlook what happened > the bite accusation. The lanlord could have given you a 3days notice by law. Either get rid of Riely or evict. So 5 days was nice IMO. I've recieved 3 days before because of a cat. The landlord let it slide, however then anther tenant got one too and pointed out I had one, so I got busted . I was so upset . This was long before I was approved for a service dog. Having a dog who supposedly "bit" a person is good cause for not allowing the animal back on the premisis. Best thing to do IMO, it to look for anther low income/subsidized housing and move. Then start over , request a service dog through your medical DR's and go from there. I am very sorry .
