If she can sue you, then definitely do not give her a spayed/neutered pup lolol I'd pay her the $1,200 and be done with it.

| I am a bit confused here...if your contract reads stud fee of $450.00 or a puppy back and you didnt pay the stud fee upon service, then you had to have verbally agreed to a puppy back. She can play the devil by not allowing you to register the litter if you do not fulfill your end of the contract. While I understand your quandry not placing the pup in a loving home, I agree with most everyone, place the pup in a proper pet home and give her the $1200.00 Hard lesson learned but make sure you have everything spelled out on paper by the stud owner... this is a portion of mine where the bitch owner has to inital 1. The fee for the stud service is payable at the time of service, or terms as follows: The owner of the dam identified above agrees on this date: / / (initialed: ) that the stud fee must be paid to the stud dog owner upon first day of service or “pick of litter” before the stud dog owner will sign the AKC litter registration application, which ever is agreeable to both parties.

| You need to pay her the 1,200. You cannot legally spay/neuter her puppy. That's right. It is already HER puppy unless you pay the 1,200. |

I normally do not post on here, just read.. But I am from Indiana and your story sounds to familar! My very first litter I used another breeder's stud.. She would not take the stud fee up front and said we would wait until we knew for sure she took.. So stupid me did what she told me to do.. When my female whelped there were three males in the litter.. When I contacted her about the whelping and there were three boys, she stated she would take pick of litter! I about died! We took the puppies to visit her when they were 12 weeks old, she stated I could give her pick of the litter or buy my own puppy back for $1400.00.. My husband made me turn over the puppy papers to her and the puppy she liked.. She did say she would going to place the puppy into a pet home and it would go on limited registration.. I made her sign a statement which said the puppy would be placed as a "PET ONLY" on limited registration.. Needless to say I cried all the way home! About 1 year later I received a call from a man in Michigan who had bought this boy from the stud owner and he told me the stud owner told him he could use him for breeding! But the papers were marked limited and he wanted to write a letter to AKC stating I would give him full rights on the boy.. I told him there was NO way in H*ll I would do that, but I offered to purchase him back.. He said no I will just keep him for a pet, because I love him so much! Well a couple months later I checked with AKC and he had been given full registration on this boy and had already registered litters under him! He had whited out the limited box, drew it back in, and obtained full rights on the boy.. It took me almost 1 year and writing many many letters to AKC and I was finally able to pull full registration on the boy and the papers on his puppies as well! A few months after that happened I received a letter from the owner and he stated he was going to have to sell him and ask me if I wanted to purchase him back.. The next day my husband and I was one our way to Michigan and brought the boy back home with us.... He is now in a loving forever pet home! So please pay her the $1200.00 and be done with her... That way you do not have to go through what I had to... Sounds like stud owner you used......

| I was hoping someone had some great words of wisdom that I wanted to hear. I will most likely have to give her a puppy and I can only hope and pray that she will do what she says she will do. I do not have 1200. until I sell a puppy. I want to thank everyone for answering me and all of your help we will see what happens from here. Hopefully if anyone out there reads this that will learn from my mistake and not sign anything that gives someone the right to one of their puppies unless they are sure that is what they want to do. Again thank you all so much for your advice in this matter. |

| Most breeders want the pup at 8 to 12 weeks...how could she stall until spaying time? This breeder sounds like one who would threaten a small claims suit..nowhere in the contract does it say the pup would be spayed, right? I think she will hodl her to the contract.. Few breeders want a spayed pup back... |

| Shyorkies...we all have learned some hard lesson I am afraid. I almost did the same thing..a friend told me to pay the stud fee because the breeder would want the best pup..she had first hand experince with him. I thought he was being so nice telling me not worry about the fee..wait and see what I got..I got a female he tried to buy for months, so I would have lost her if I had not paid. I used to sent AKC a list of all full regs and limited regs I placed. I did have two white out limited and they pulled the papers before breeding. Yoursotino..you have helped by posting this thread... Last edited by YorkieRose; 09-18-2007 at 03:57 PM. |

So important ..when dealing with stud services. One must be sure, it will be the type of terms they are willing to live with. You may try and ask her if it's OK if you can place the pup and give her the money from the sale. I ran across a similar situation when I was looking for a stud service. The terms were she wanted a female as pick of the litter or If no female was born she wanted the full price of a pup. I asked her what her flat stud fee was and she said it the same as the price of a pup... I said Thank You ...but No Thank You. I think paying a reasonable flat stud fee up front is always the best way to go. Good luck to you I hope everything works out.

| I wanted to let you know that I feel that this has all been worked out this person is being most gracious. She is accepting a much lesser amount or a puppy. I still have reservation about turning over a puppy. Can anyone tell me what is the right price to price puppies. I have mine listed at1200 and lowered it because everyone screams at the price. excuse sp. I dont have my glasses on and I am trying to do this blind |

you price them what you think they are worth no matter how much people scream. You base it on size, bloodline and etc .But, basically, it all comes down to what you want for them. Glad you guys are working things out.
