| Were the photos your talking about your own personal photos of your own dogs or ones given to you by someone else, say possibly recounting a history of a breed? Do you think it could be possible, if they were given to you by another party, that someone could have also sent the same photos to this party? I'm not sure I would immediately always think that someone is out to get you or steal from you without looking at all the other possiblities too. -Diana |

| It was brought to my attention that some of my pictures from my personal website are in several different places too. I never was asked for permission for my photos to be used. I am the author and owner of all of this work! I guess since I have a copywrite on my website it hasn't stop people to think it is okay to just grab and run off with them.....

| happened to me, too. Mine showed up on puppyfind and the only place I had ever posted them was here. It was only two puppy pictures which I had already sold so i didn't say anything about it but I will raise a huge stink if it ever happens again. |

| The Czech guy has used a lot of our pictures but he didn't say: "I found these and would like to share" "I just love gathering the history of the Biewer". When asked if they could be used she says "Oh, yes, of course. I found the two images, cleaned them up and pasted them together to make a nice presentation. I think it would be wonderful to put on the website. Also anyone who wants it on their own web site. These are historical photos, and no one has a copyright filed on them. Even though I edited the old images, I don't intend to claim a copyright on this image, artistic license in reverse". LOL Well, it is not Laugh Out Loud funny! Everyone knows she took them off of the IBC web site where it is boldly stated that they are not to be copied. Big give away is the fact that the gold buttons in the gold braiding where Dagmar put her stamp is gone. |

| I think everyone is missing the point...it is not who is the owner of the subject but rather the owner of the PICTURE. Everyone needs to read the copyright laws. If you take pictures of someone else's dog in a public place then you own the right to the picture not the person that owns the dog. That is how the paparazzi can take pictures of celebrities in public and be able to publish the pictures because they own the pictures. Thus Dagmar owns the pictures and has the copyright to them. She can then give permission to publish to anyone she wishes to or for that token not give permission either. It is very simple. If she requests or has someone request on her behalf to have the pictures removed from an unauthorized site then that request should be honored otherwise it is subject to litigation. The same goes for the Czech site. He has absolutely no right to publish anyone else's pictures and should be shut down. |

| A copyright is secured automatically when a work is created. This concept is frequently misunderstood. Some people still believe that there are formalities required in order to create a copyright. This is not true. Under the latest version of the Copyright Act, neither publication nor registration with the Copyright Office of the Library of Congress is required in order to secure full copyright protection. When a work is created, it is automatically copyrighted. In the case of photographs, it is sometimes difficult to determine who owns the copyright and there may be little or no information about the owner on individual copies. Ownership of a “copy” of a photograph – the tangible embodiment of the “work” – is distinct from the “work” itself – the intangible intellectual property. The owner of the “work” is generally the photographer or, in certain situations, the employer of the photographer. Even if a person hires a photographer to take pictures of a wedding, for example, the photographer will own the copyright in the photographs unless the copyright in the photographs is transferred, in writing and signed by the copyright owner, to another person. The subject of the photograph generally has nothing to do with the ownership of the copyright in the photograph. If the photographer is no longer living, the rights in the photograph are determined by the photographer’s will or passed as personal property by the applicable laws of interstate succession. After you have located graphics that you would like to use in your web site, study the web sites containing the graphics to see if the sites give limitations on the use of information in the sites. These limitations might be (a) copyright notices for the sites, and (b) specific comments about use of the information. Keep in mind that pictures may be copyrighted even though no copyright notice is publicly displayed. |
