| ![]() I was going by the information I saw on several on the recipes. All of the ones I looked at had the following statement somewhere on them: "This recipe is copyright protected and may not be reproduced without ____'s (Food Network, Emeril, Southern Living, etc.) consent." I will back out of the argument now with one last statement, "If I made up the recipe OR had won prizes for the recipe OR had it published in a national cookbook OR had my own TV show where I demonstrated it on national TV, I don't think I would want someone else claiming it as their own." Once again, sorry and thanks for setting me straight!

| ![]() Where did it specify that the recipes were to be our own original recipes? I thought it was supposed to be our favorite recipes. And as the poster previously stated, all recipes come from SOMEWHERE...there's nothing truly original out there. All you have to do is change ONE ingredient to make it "original" anyway. The rule is, that a collection of recipes can be copyrighted; an individual recipe cannot. I have recipes that have come from everywhere, and a lot that I got from other people; whether they are their own "original" recipes or not, I have no idea. Some of the recipes I submitted are my mom's or my "original" recipe and I don't give a hoot whether someone takes them and puts them in any cookbook or website and makes money off them. More power to them. And, to set the record straight, I was never claiming that all the recipes I submitted as MINE, nor did I suppose the all the other recipes submitted are "original" recipes.

| ![]() I think we owe Vallery a debt of gratitude! She has volunteered to do editing on the cookbook and to promote it tirelessly. I want to clarify here that I was trying to support her and not attack her in any way. The issue of copyright law is VERY important and serious. I agree with her on that. I just think the issue needs to be researched a little more before recipes are removed. I am very proud of everyone's participation in the cookbook! Ya'll (as we say in Texas. ![]() Thank you to YouGetTheSmiles, Vallery and all of the other editors for this wonderful project. ![]()

You make a good point, I don't think we can just ignore those recipes. That statement will have to be removed and the issue dealt with on those recipes. I don't see how they can be copyrighted unless they include extensive instructions on how to prepare the dish, but never the less, I think we should look into those. I'm not sure if we can just cite the source or if we need to rewrite the instructions. Could you PM the name of one of those and I'll look into it further. That's a Great Catch! Unfortunately, I have entered recipe contests and I have had to sign a piece of paper acknowledging that while the recipe was my own unique creation, it would be made available for public use. It just goes with the territory of creating your own recipe and entering it into a contest. You would hope that anyone using it would give you credit but they don't have to. Hopefully, no matter where the recipe came from, it is a tried and true recipe that someone has tried and loves.

| ![]() The hospital guild has these cook-books every year and they are so nice and I appreciate all the work you are putting into this one. Do you think saying "Mary Jones is including a recipe she loves" or has used often or makes for her family. Rather than: Mary Jones recipe ???? might be better.

| ![]() The ingredient list is never a problem, since it cannot be copyrighted. The instructions can only be copyrighted if they are extensive. For example, if the directions for a recipe say to mix this and this and then combine with that and then bake in oven, they cannot legally be copyrighted. If the directions for a recipe are copyrighted, then just citing them without permission of the author is still a violation. I recommend that we just ask that whoever submitted a recipe that is in question, rewrite the instructions using their own words. Whether or not the instructions to a recipe are copyrightable, it would still be nice to mention where you originally got the recipe.
