| advice needed i took in a retired breeder yorkie back in august ihave place several dogs for this breeder in the past 4 years she had me rehome 3 other dogs when i picked up this one well now i get a letter that i am to appear in small claims court april 5 i have never had o pay her for a dog she wanted me to rehome an now she is wanting 500.00 for this 1 yorkie she said we had a verbal agreement for me to pay her which i did not this dog is 7 years old an i recieved no papers for any of the dogs including her thedeal with this yorkie has been when she decided to stop breeding her she would give her to me when i recieved her i picked the dogs up at no exspense to her an i kept them an did there medical care until they where placed in adoptive homes this dog had a skin infection an flea allergys plus was loaded with tape worms what should i do do i need to counter sue or what? i am in total shock |

| Ok first off a judge is prob not going to make you pay b/c there is no way to prove there really was or wasn't a verbal agreement! And if you have paid for all those things to be fixed then bring the papers and receits and all the info from the vet and let the judge know these things and see them and you will more then likely walk out of there without paying a dime!

You have placed others for her at no charge, so if she thinks she's going to get away with saying there was a verbal agreement, it's not going to work. As long as you are sure you had no agreement, I wouldn't worry. I'm sure the Judge didn't go to school just to eat his/her lunch. Good Luck to you!!!

| I would simply tell the judge what you have stated on here and by all means take any records with you from you vet where you have paid for anything concerning this matter. Good luck hey by the way did you get the dress I sent you for Willow? If not maybe Monday. And how is Willow doing? |

| advice i got the dress today i am gonna have to send someone a picture by snail mail to post as i dont own a digital camera due to every extra cent i have goes to help the rescues i place i have been doing this for 6 years an she is the first person i have had this happen with she is totally out of her mind |

| I'm sorry that this is happening to you. I agree with the other responses. Just bring all of your info to court and show the judge. What a wonderful person you are for helping place these wonderful babies. Good Luck.

| Maybe you could take the person who has the dod now as a witness of sorts to maybe testify that the dog was in bad shape?? Just don't get yourself sick with worry. Things tend to always work out, especially when you know you did the right thing, and it sounds like you are doing MORE then the right thing with all the rescues you do, I commend you. Good luck in court, and if it were me, I would counter sue for the vet bills. |

| advice i think im gonna counter sue vet bills traveling exspenses an boarding food the works plus i think i am goona have her investigated to see if she is running her kennel properly |

| OH My.......... I am sorry for hearing about what you are going through. This is why people can't do favors for anyone in this world because of stuff like that. She knew she never had anything with you as far as a contract. Now she's asking out of spite. Since you never had papers for none of them and you did all their medical care take those documents with you and any other proof you have and show the judge that. Im not sure of how the legal part goes but if you can you should counter sue because thats just not right for her all of a sudden to be demanding money from you when you were them one taking and caring for all the dogs she needed homes for. | why is she still breeding? the dogs seem to be in bad shape when you get them from her, she can't be a very good breeder if she's letting her breeding stock's health go down like that. she should not be breeding at all if her dogs have worms, fleas, ticks, etc. these are very easy to take care of, but she isn't even doing the bare mininum. I hope the judge shuts her down. good luck in court. |

| I agree with everything said above. Make sure you have documentation and I don't see a verbal agreement standing up in court.
