I just heard this; Baez graduated from law school in 1997 but was denied admittance by the Florida bar until 2005 (8 yrs) due to failure to pay child support to his teenage child and other financial "mishaps".

From an article I found about Geraldo Rivera interviewing Baez:

Baez also felt frustrated about trying to question an emotional Lee Anthony, Casey’s brother, in court yesterday, Rivera said.

“He [Baez] wanted that jury to know that those parents feared Lee Anthony was the father of that child,” Rivera said on “The O’Reilly Factor.” “That’s why they didn’t want him involved in the baby’s birth. That’s where he was going. The judge stopped it.”


His theories (or Casey's stories) are so ridiculous! I think maybe the judge should have allowed it so they can see how the defense is grasping at straws. They would then have to prove that the family feared Lee was Caylee's father...which would be impossible unless Casey took the stand and who is going to believe her?

How interesting, I believe this, the crying was so strange, it made me wonder if that's what they were trying to do. I think they think this is the only way to save Casey, and are getting bad legal advice. Instead of making us have compassion, I think it just makes us care less about the whole family, and I really do have so much compassion for the family. Baez brought incest up in his opening arguments, is this how he’s going to approach it, just hint around about it?

I'm really surprised Baez is talking to the media, oh I take that back, no I'm not, did he mention any plans for a book?

Wow - court back in.
Recess Saturday was because Defense said that Casey Anthony was incompetent to continue. So over the weekend they had her examined by physchologists (or may have been psychiatrists?).
They found her competent to continue. So the trial goes on.

Guess was a last ditch effort by the defense to try and save her.

Can't believe they threw this "hail Mary"!! NOW they question her mental state! This trial is such a circus - no fault to Judge Perry, but boy Baez is trying his best to make a side show out of his courtroom.

I also cannot believe they did not question Lee about the reported sexual abuse - just inuendo (sp)!

They filed a motion for a new trial with a new jury! From the article in that link:

" Monday morning, Anthony's defense filed a motion requesting a new trial and a new jury in her murder trial.

Death penalty expert attorney Ann Finnell filed a motion Monday morning calling for a new trial and a new jury. The current jury is "death penalty qualified," meaning they said during jury selection they could impose the death penalty if Anthony is convicted of first-degree murder.

Finnell's motion requests a new trial with a jury who has not been asked about their ability to impose the death penalty."

Oh great, it says, "The motion is based in part on a ruling last week by a federal judge in Miami. The judge ruled that juries should determining the aggravating factors in sentencing criminals to die, not judges and that the Florida death penalty is unconstitutional.The ruling is expected to be argued in appellate courts for several years and although it does not strike down the death penalty, it could give death row members another opportunity to appeal."

I hope they don't even go for the death penalty, she'll be given special privileges, and lots of chance to appeal at the tax payers’ expense.

Yes, a District judge in Miami has ordered a new sentencing hearing on a case because in Florida the decision by the jurors to ask for the death penalty is by the majority of the jurors. But in 2002 the US Supreme Court had ruled that the defendants are entitled to have juries decide on whether aggravating factors lead to the death penalty.
I think it would only lead to a new sentencing hearing not a new trial. Convictions will be upheld, they would only need to have a new sentencing hearing.

I'd rather see her get life in prison without possibility of parole - and let's face it if she got the death penalty it would be years before it would be carried out, as you say there would be all the appeals etc.

So who decides that this is a death penalty case? Why couldn't they just make it life in prison without opportunity for parole.

Apparently, according to the article Beamers mom just linked, in Florida, the judge decides instead of the jury, and this is what may be unconstitutional. The prosecution, of course, would have to prove premeditated murder, and I don’t think so far they have done that. I was wondering so much about what happened on Saturday - the theories were off the charts on CNN HLN.

Well of course she is incompetent,or she would not be in court for murdering her child. It took a psychologist to figure that out? I can not keep up with any of this. Just listening to Nancy Grace on Good Morning America confuses me.

So did the child drown or did it suffocate? Or something else? What did the autopsy show?

I am not able to watch any of the trial so I read everything in this thread. :thumbup:
