From an article I found about Geraldo Rivera interviewing Baez: Baez also felt frustrated about trying to question an emotional Lee Anthony, Casey’s brother, in court yesterday, Rivera said. “He [Baez] wanted that jury to know that those parents feared Lee Anthony was the father of that child,” Rivera said on “The O’Reilly Factor.” “That’s why they didn’t want him involved in the baby’s birth. That’s where he was going. The judge stopped it.” His theories (or Casey's stories) are so ridiculous! I think maybe the judge should have allowed it so they can see how the defense is grasping at straws. They would then have to prove that the family feared Lee was Caylee's father...which would be impossible unless Casey took the stand and who is going to believe her? |

Wow - court back in. Recess Saturday was because Defense said that Casey Anthony was incompetent to continue. So over the weekend they had her examined by physchologists (or may have been psychiatrists?). They found her competent to continue. So the trial goes on. Guess was a last ditch effort by the defense to try and save her. |

From the article in that link: " Monday morning, Anthony's defense filed a motion requesting a new trial and a new jury in her murder trial. Death penalty expert attorney Ann Finnell filed a motion Monday morning calling for a new trial and a new jury. The current jury is "death penalty qualified," meaning they said during jury selection they could impose the death penalty if Anthony is convicted of first-degree murder. Finnell's motion requests a new trial with a jury who has not been asked about their ability to impose the death penalty." |

Yes, a District judge in Miami has ordered a new sentencing hearing on a case because in Florida the decision by the jurors to ask for the death penalty is by the majority of the jurors. But in 2002 the US Supreme Court had ruled that the defendants are entitled to have juries decide on whether aggravating factors lead to the death penalty. I think it would only lead to a new sentencing hearing not a new trial. Convictions will be upheld, they would only need to have a new sentencing hearing. I'd rather see her get life in prison without possibility of parole - and let's face it if she got the death penalty it would be years before it would be carried out, as you say there would be all the appeals etc. |
My eye is twitching. So who decides that this is a death penalty case? Why couldn't they just make it life in prison without opportunity for parole. <-Ignorant of the law |

So did the child drown or did it suffocate? Or something else? What did the autopsy show? I am not able to watch any of the trial so I read everything in this thread. :thumbup: |
