| What Should We Do? On Sat my bf went to one of those drive thru car washes. Well, when he got to the dryer part, there must've of been a rock or something in the dryer and when it hit his car, the whole back windshield SHATTERED!!!!! So he told the employee there what had happened and he said he would have to speak to the manager. So he waited and waited and the manager never showed up...... so then he got their phone # and took pictures of the car and left. Since then we have finally got in touch with the manager and he said he wanted to go thru their insurance and we said ok. Since then we have tried to contact them again and it seems they are trying to avoid us by not returning our calls. We plan to go there tomorrow. I mean they SAID they would fix it but they are not doing anything about it like calling their insurance company to file a claim etc... my bf does not want to call his ins co cuz he feels that the car washes ins should take care of the damages. Needless to say this has caused a HUGE inconvenience to us as we have two very different schedules and only one car (my car). He cannot drive his car with the back window shattered cuz it is illegal and will get a ticket. And we cant park it anywhere either. The timing couldnt have been worse cuz i was scheduled to drop off my car at the body shop this week and now i cant cuz of this..... ughhhh!!!!! We need a rental car asap but do we wanna make sure the car wash will pay for it first. On the other hand, I am soooo glad there was no one in the back seat at the time..... or one of the dogs... Anyways, im wondering if theres anything more we can do or say to them that will make them resolve this asap!. Should we threaten legal action? Any suggestions would help. Sorry this is so long......... Thanks in advance! |

| I would get ahold of my insurance and get it fixed ASAP. They can then try to get the money from the carwash. That is what your insurance CO is for. The other option is pay out of pocket and then take them to small claims court. Good luck!

| Personally, I would do everything I could with the car wash people before ever contacting your own insurance. My husband is an auto adjustor for a large insurance company and the things I have learned over the years have surprised me. Most insurance companies have the "3 strikes and you're out" policy. If you call the insurance claims people and tell them about the accident (your fault or not), you have a mark on your policy. Even if you don't use them to pay for the damage, you still have filed a claim and it will count against you. Not fair, I know but that's how most of them work. My husband had the hard task of telling an elderly man that he was being denied coverage and being dropped because he had filed 3 claims and was wanting to file a 4th. Even though the guy didn't even follow through (and have the company pay) on two of those claims, they were still marked against him. I say hound and hound the car wash until you get results. Only go to your insurance company as a last resort. Just my opinion, of course! Good luck!

| Also, you may be out of luck. Most car washes state that you enter at your own risk and they are not responsible for any damage that is caused to your car. I hope you are able to settle this! Michele :-) |

| We had damage to our vehicle from a car wash as well. It was actually a scrape down the side of my husbands truck. It was not on the truck when he got in and he only went to the car wash and then straight to work - when he got out of the car at work - there was a big scratch. The car wash said there was no way it could be them and we couldn't really prove anything.... it sounds like you are in a better spot though as it shattered immediately and everyone saw it. Good luck.... |
