![]() Interesting thread all together- honestly if I lost my dog to my fault, someone else's fault, or a combination of both- I would not be thinking about getting money to pay for the next one so soon.

				   | Indeed. Anybody CAN sue, but that doesn't mean that they should sue or even that they have a case. We are only getting the story from one side, but even based on the OP's version, her dog (tragically) wasn't completely under her control even though it was on a leash. There is plenty of blame to go around for all involved. I'm not even sure about the other person being responsible for half of the vet bills. According to the OP, "He died as soon as I touched him to try to soothe him." If he was already dead, I don't see the point in bringing him to a vet and incurring a vet bill, that doesn't make any sense to me. She didn't pay anything for the dog, so there are no monetary damages that can be documented in a court of law. And they will require original documentation on what was actually paid by the claimant .... if none exists, they will ignore that part of the claim. Now the tragedy of losing a pet to a freak accident, I am truly sorry about that. So heartbreaking.

				   | I remember the original posts when Max has what looked to be a ruptured anal gland and claimed there were no open vets in the Chicago area on a Sunday. I was the open that offered a list of ER vets and even sent a PM to her offer further advice. Here is her post from 3/3/11 where she is asking about a midwest breeder. Hmmm~with all of the backdoor puppy sales that go on via PMs she probably got what she was looking for and left. ![]() http://www.yorkietalk.com/forums/bre...t-breeder.html

				   | That's sad that the pain and suffering isn't considered in such a situation but considering dogs are "property" under the law though...that makes total sense. Preceding is not to the ppl I quoted below just the previously mentioned above. I see the OP has a history on here for some questionable content post was that what sparked the reactions of some people to this thread because... wow, some people are really getting rude about this whole situation in their comments to the OP and their whole thing about the dog not being under control... 1.did the OP say how long the leash was? 2.Was the dog straying? To a point of beyond control? 3.How far was the OP from the elevator door? 4. Have any of you turned your back for a moment-were you not in control...did you expect a dog and then a person to accidentally just fall on your dog and kill them? I get it the person accidentally killed their dog but we are as responsible for our accidents as our intentions... Elvis was almost stepped on by a lady as we walked down the isle in the pet boutique once...good thing I'm fast...seriously who walks down an isle in a pet store looking straight ahead and doesn't at least see a leash in my hand? Let alone expect a dog to be on an isle in the pet store...? She was all shocked acting when i yelled and grabbed him up...I was so mad...yeah okay it was an accident..I'd have more than held her responsible if she had stepped on my Elvie...was I not in control looking at dog sweaters with Elvis leashed within three feet from me...would that have been my fault...should he have been directly exactly next to me...in my arms...I should have been vigilantly looking around for someone walking by not looking down? | Oh my, I am so sorry that happened. That had to be so heartbreaking. I will keep you in my prayers, that was awsome to help in the short time for you to make such a positive change. How sad for the first 2 years, how can anyone do that to any animal. Again, I am so sorry for your sadness. |
