| Is she going to give you a partial refund? did you pay for the puppy in full? If so, and she refuses to give you a puppy now, or your refund, then to me, it is robbery. You need to file a police report. Especially if this was a high amount of cash. Do not let her get away with it! She is a criminal.

| The puppy you agreed to purchase and paid for either totally or in part died. She is obligated to refund that money to you. If she doesn't give it to you in full you can take her to court and she knows it. Stick to your guns. Ask a lawyer to write her a letter detailing the legalities and she will cave. It won't cost that much. |

| I"m in the middle of this very same thing. Check with your local courthouse on how to file a civil small claims suit. Normally, the filing fees aren't that much. File a police report too. That holds credibility. Print your emails from her and from here on out, document the date and times you talk to her, what the conversation entailed and how long you spoke on the phone. When you walk into court with documentation (even your own notes) it holds a lot more credibility than someone who has nothing. DO NOT back down! Fight for what you paid for and don't give up. Vent here if you need to. My PM box is always open. God knows I know what you're going through. Good luck! PS: the dog isn't a yorkie... AT ALL. It doesn't even pretend to be a yorkie

| Cute puppy, but not a yorkie, maybe partial mix, but not much. I definitely would be requesting a complete refund or a new puppy that is full yorkie, although it would be hard to trust that she would do that now. I would check into the law as others have suggested to recoup my payment/deposit. I am sorry you have to go through this, what a shame. ![]() ![]() . | As long as you stick with the facts, no one can get you for slander/libel. It has to be an untrue statement to fall under slander (spoken) or libel (written) laws. I agree with those who said go to the police. It is a criminal matter. Is she local to you or in a different state? That can make it more difficult but not impossible. You do not have to have a lawyer to go to small claims court. But if you do get a lawyer and win as you should with the facts you presented, then you can be awarded legal fees in addition to recouping your money. Don't let someone get away with this or she will just turn around and do it to another. I am almost wondering if it is possible that she sent you the wrong picture. Did you discuss with her that the dog does not look like a Yorkie? Long shot I know but this is starting to get me down that so many breeders are being dishonest. I would rather think maybe she made a mistake. Does she have a website? Can you list it here?

| Could you ask her if you could wait until the next yorkie litter is due, so you could get pick of that litter? If not, tell her you don't want to loose your money, and that the pup in the photo doesn't have the look you were looking for but you wanted to get more information about the puppy she says you have to take. Verify that those were the right photos (maybe she sent you the wrong photos), ask to see photos of mom and dad and some better close up pics of the pup as well as a photo of the entire litter (including the red pups). Ask for parents full registered names and copy of pedigrees. Ask if she's applied for the pups AKC papers yet and get the pups litter registration number. Ask how many litters dad has sired (if he's sired more than 3 litters in one year or more than a total of 7 litters, he should have DNA on file already - it's required). Hopefully he does have DNA on file already and if so, get a copy of his DNA papers. If you are still not happy with the pup after getting all this information (get all the info first, reg numbers, photos, dna papers), and she still insists that you have to take this pup or no pup at all, tell her that you hope she doesn't mind if you contact AKC just to verify that the information she's given you is correct (and be sure she's in good standing with AKC). If dad does have DNA on file, tell her that if you do take the pup, you intend on DNA'ing the pup to verify parentage because the pup doesn't look like a show quality yorkie; it looks like a mix of something. Hopefully that will change her mind and she'll give you your money back just to get rid of you ;-) I'm sure she doesn't want AKC to see any red flags or question her reputation. Otherwise, small claims court would be an option, if you have all the facts in writing via e-mails to back you up. You could also complain to the Better Business Bureau. Good luck ... sorry this happend to you.

| hi, she also raises LOTS AND LOTS of many horses (like hundreds on a little bit of land). i heard that she pretty much got kicked out of th city because of the care her animals were receiving...which was pretty much none. anyways this is her webiste LIL BIT OF HEAVEN she doesn't usually post many pics of her dogs and considers them "family members'' of course. i know she has several other breeds and that her pups are sick and dying as well as her horses. i hope she doesn't use anyone else. i will be contacting akc. |
