| ![]() okay does the seller have to give the purchaser a choice of the 3? or can the seller give the purchaser a choice? because the store owner did give me the option of getting a refund or getting a new puppy from his store... but i never heard the choice #3.... although i did finally get $488 from him to pay for her emergency visit... the warranty entitled him to pay for an emergency visit if it was for hereditary/congenital reasons and within 1 year of purchase. but $488 is not near the $1200 i payed for her. hmmmm... am i liable to more? the whole $1200?

| ![]() I'm so sorry you're in this situation, I lost a 6 month old puppy to LS. I had to put over $3000.00 on my credit card to pay for her surgery's, but in the end she didn't make it. I'd of paid anything to keep her with us. If only I'd done more research on Breeders, I wouldn't have this hole in my heart. And I commend you for not turning her back over to the pet store. They pretty much count on the fact that you won't and they don't really care what health issues these puppies have. ![]()

| ![]() I am not from Calif. but from what I can tell the choice is yours whether or not to keep the ill pup. You would still be due up to 150% of the purchase price if vet bills are that high. I think I would do this first thing tomorrow. You only have 5 days to notify them of the diagnosis though, I think. I would copy all your bills along with the surgery estimate. I would put in writing what you expect...150% - the 488 they gave you already. Let them know you are serious and read the law. I wish you luck and hope your baby gets treatment and well soon. | ![]() if you end up having to deal with the vet clinic about payment, talk with the vet himself - hopefully he can intervene with any of office people & you don't have to. Praying you find an answer for Bell very quickly.

| ![]() I know there might be no chance of this but could you personally talk with the pet store manager/owner? Show them the vet results of her tests. If she gets return there is a 99.9% that no one will get her surgery and she might die. You bought what you thought was a healthy pet. Your pet is now sick,they might be able to give you some money back. It doesn't hurt to go in person and show up with all your vet tests. It's the same as having a child. No one expects to give birth to a sick child but it happens sometimes and most people can't afford treatment if they get diagnosed with something like this. I totally understand how you don't have the heart to return her like you would a damaged radio etc.. That's exactly what petshops expect. Has your vet started her on a low protein diet and Marin or Denosyl? Both those meds help the liver work to flush out the toxins. Having a yorkie with L/S is very stressful. My yorkie has the liver shunt that can be controlled with diet . He turns 4 yrs old in March and doing well on the diet ( Hill's Science diet L/D can food) I was going to suggest the Care Credit card but I just read that it was denied ![]() I wish I could help. The last option ,it's better than giving her back to the store. Would be to give her up to a Yorkie Rescue that will raise the money to get her surgery.At least she will get her surgery that she needs. | ![]() okay so i have some news.... yesterday i made a visit to my vet and asked for a written statement, i pick it up today. also, i showed him the ca law, (puppy lemon law), and explained how i was entitled to 150% of bells cost for her vet bills... he agreed with me. he advised me to go to the pet store and explain to him what the law says. so, i left the vet and headed for the store. the owner is always there, and mind you he knows me, like i said he already gave me 488$. anyways, he gave me 1 min of explaining to him about the law and said. "i'm done talking to you, if you want anything take it to small claims." and that was it, he wanted NO further dicussion. but today, after i pick up the vet statement, im going over there one more time, because it's the law that i show him the vet statement, and im bringing a witness.... also, it is within 5 days, i just got the confirmed diagnosis 2 days ago. thank you so much to CC's without you i would not of known anything about this law. luckily i learned in the appropriate time! but unfortunately it looks as if we'll be going to court, but i WILL take it there, that guy deserves it... and i did print the entire code section on this matter, and have thoroughly read it several times... and guys i have to say it looks like this guy is going down!... oh, but just in case, by boyfriend id calling attorneys today to seek some advice... geez sorry it's so long!----oh, yeah and bell is on all the right meds and L/D, she has been for about 5 months. she is actually symptom free as of now, and would like to keep it that way! again, thanks everyone.

He sounds like a real jerk in not wanting to even talk to you about it oh well guess you can always take him to court and burn his butt i bet then he will would have wished he would have talkexd to you about it hehe. Taking a witness is great but if it were me, to really have paper proof you informed him of the law within the alloted time I would send an overnight Fedex letter, with the documents, requiring his signature. Also, if he has a fax machine, you can also send it to him by facsimile so you have the fax receipt. Best of luck to you!

I had a Golden that had to have two surgeries on his intestines.. (they were dying) my Vet ( not the clinic) Said that she would do the Surgery again free of charge if it would make him better for good. But we all know that he didn't have enough intestine left to do surgery on... There are a lot of Compassionate vets out there. I hope and pray you can find the help you need. | |
