Im sorry this happened at your community, Im thinking its only a matter of time that it will happen at mine as well. Every month there is a newsletter with a paragraph to people who do not pick up their dog waste! They say in our bi-laws that if you are asked to remove your pet from the premises, you have 3 days to do it. Imagine that? You cannot even get enough time to sell, pack and move!!! Crazy!
Same here! I believe it was three, it was only a couple of days. They don't even give you time to find a home for your dog, or for yourself (that would be my situation). And what are they going to do if you don't? If the confiscate your dog, it's going to end up in a shelter or PTS I'm assuming. Aren't there enough dogs in shelters and being PTS because of owners that NEGLECT them? Walking your dog is a part of taking care of your dog, and your dog gets taken away from you for doing so!

I'm off work on tues. night, so I get to go to the discussion about this. I can't wait. I have to remember to take pictures of all the crappy landscaping that is done, not from the dogs!

I try not to let my babies on other's lawns out of respect for them, but sometimes they will hop up to pee on their yard right next to the curb which technically I believe is public property (near the electrical poles). I try very hard to not let them past that point though just to avoid issues.
If they go into the grass, I make them go on the little strip of grass between the sidewalk and the street, not on the side with houses. I don't like to let them all up in other yards, but I have seen people do that with extended leashes, once I saw a dog more than half way up my yard! My yard isn't big, but still! I watched out the window, that owner is lucky the dog didn't poop! I wouldn't went out, picked up the poop, followed them, then smeared it on their porch.

Funny you say Nazi Germany, there is a guy across the street from me who I refer to as an assocation nazi, especially when it comes to dogs!

But I would guess that if your community has passed the law, it is legal.

While I've never paid much attention to it, I can see how non dog owners would get upset. Pee kills grass. You might as well just do your best to keep your pup off their lawns.

Good luck.

I don't necessarily think it is though...for one I think it's too absurd, and they did something else that isn't necessarily legal recently. When you first pull into my neighborhood there is a streetlight, they posted a piece of paper on this pole, yes a piece of paper, not even a street sign, and it's printed out from someones home computer. It says you must obey the 20mph speed limit through out the neighborhood, and there are now cameras so if you go over 20 mph you will be caught and fined/ticketed. I'm not complaining about driving slow through out the neighborhood because I do anyways since theres too many people out, but if you drive through my neighborhood there is not ONE speed limit sign! And this sign is printed so small you can't even read it. Not only that, I have yet to see a camera! I mean for spending OVER $150/MO. on association, you think they could atleast have a readable sign!

I understand what your saying, but in the meantime we are paying for landscaping and snow plowing and other services to be done here that are making the landscaping look far worse then a little dead spot of grass here and there. Plus, it's not technically "my" lawn, it's all townhomes so no one owns the lawn around their house, it's the association. When they use my money to spend on a service for the land that doesn't do the land any good, then tell me my dog can't even pee because THATS what is making it look bad, that's why I have a problem.

Plus, were already paying them each month, and I'm sure from what they get and spend, they are making a HUGE profit, especially comparing other neighborhoods and what they pay. They can tap into their profit and pay to fix it up.

I think you have answered your own question, it's their land, you pay for the upkeep, and it's their responsiblity to keep it looking good. I doubt if they are making the profit, you think, and many people think they yellow areas are a huge eye sore and should be repaired, this isn't cheap. Besides, this won't cost you a cent, if your dog isn't the one making the mess.

I'm sorry this is SO frustrating.
I went through a similar situation in my townhouse when I got Cooper. My neighbors didn't like me (I was 18 & they were 65) but I was always respectful and quiet! They tried to CHANGE the HOA to ban dogs, my dad was quite mad and had his lawyers contact them. My dad purchased the house with the understanding that dogs were allowed. You cannot change the rules after someone buys the house!

From what I understand; They cannot retroactively change the rules about dogs. Your dogs would have to be "grandfathered in", and the new rule about banning a particular dog after multiple offenses could only (legally) be applied to NEW purchasers. This is only my opinion, and understanding from my experience.

GOOD LUCK

I doubt if they could remove the animal for that reason, unless it's in the bylaws, but they could legally fine the dog, or the owner, I should say.

Thanks for sharing! I'm definitly going to look into that and see if that applies here, I hope it does!

What ended up happening in the long run? Did your neighbors finally learn to accept the fact that you going to live there and have a dog, or were they still trying to cause trouble?
