I have not spoken to the animal control officer. They are under no obligation to call about this unless they actually find Zeke. They may arrive and find no person home and they wouldn't be able to do much other than mail a citation for having too many animals.

I have some belief that the person dealing with this until Monday may not be as sympathetic to the cause as the female animal control officer who returns on Monday. Because of that, I'd like to lay low from calling them until she is back.

My plan is to see the house myself on Friday with Maureen and take some pictures of the animals. If Zeke can be ID'd, then I'd call 911 and when the police arrive, they can do something with a positive ID right then.

If we can't ID Zeke or see the dogs clearly, then I will deal with the female officer on Monday.

Hopefully something will get accomplished today with the less friendly officer. He happens to be the female officer's supervisor, so I don't want to get him upset and have her be told she can't help us with this.

Small claims is a civil matter, not a criminal one. Search warrants are issued in criminal casess. Law enforcement is the only one who can request them.

Also, in CA the only thing a small court judge can order is money damages. So . . . she could sue the people and all she could hope to get if she won was an order for the value of Zeke - not Zeke.

Just got off the phone with Maureen, I have not read all the posts here yet...but she wants everyone to know...her computer is down again. She is waiting for her dad to come home from work and check it out. Galatea, she did say she was going to try to call you after 6:00...just to keep in touch. She has not heard anything back from the animal control people yet...still anxiously waiting for them to contact her. Keeping my fingers crossed...praying so hard it hurts and wishing for a miracle to occur...please remember to light candles for Zeke. Going back to read what I've missed today while at work. Because if she can't ID the dog, or they have the dog hidden where she can't him, they can get rid of the dog and she will not see Zeke again.

She can't just barge into the house, if Zeke isn't there it is considered a felony.

Even if Zeke is there, if she break and enters or pushes the woman to get in, it is a criminal act.

I'm pretty sure it has to be handled in a legal way and also not tip them off to what we are trying to do or we risk losing contact. If they get any idea of what we are trying to do they could move him forever.

I have offered to help since I'm not too far away, but will do so only with Galeta's or Maureen's say so. I wouldnt want to get in the way and make things worse.

Just curious but were there windows in the garage? Just asking because my parent's house has two windows in the garage. It sure would be hard not to break a window to get into the house if I thought Lacy was in there - illegal or not. I would be going CRAZY if I was Maureen and couldn't get anyone to help me

I know this has not been easy for either one of you, and I am sorry for whoever PM'ed you to harass you, you both know that what you are doing is right, and the procedures you are following are buy the book, I hope you got some pm's also thanking you for all you do, and for the support you have given us, and of course your staying power even when things were turning ugly, for both of you. Please know that I can not appreciate you more for staying when everything was in turmoil! I think it is so great that you and Maureen are working on a one on one, that is how it should have been from the beginning. But in the beginning till you were on board, which was just about two weeks ago, we were 100% on our own, doing the best we could not to lose the faith, and continuing the search on our own from near and far for ZEKE and I feel every one did the very best they could and also deserve a hand up!.

I have nothing but admiration for you and the help you are giving Maureen, as far as Officer Nickerson, I can not tell you how glad I am he is off the case, to my knowledge he was never on the case!!!!!! He has never wanted to help in any way since day one, he has lied to us, and not offered a drop of help. I can not tell you how glad I am that the case has been turned over to someone else who will take us seriously, and is not easily deterred. Believe me he knew he was in the wrong and that is the only reason he took himself off the case. Hopefully with your help, the MPD can get back on track, and be of some service to this case.

We are all here to offer nothing but support, help, prayers and anything else you or Maureen can think of for us to do. The case is back on track, and to stay that way, I feel it is best for all of us to appreciate you and Maureen working on a one on one. And giving us the information you wish to share with us without jeopordizing the case. Please know you have all our support and well wishes!!!!!!! Someone posted that there was yorkies in the yard? The Grandmother has other yorkies? Also they are kept in a garage is their air condtioning in there?

Maureen told me that the garage was very dark and that all of the adult dogs were very dirty and matted. There were 3 puppies and maybe 8-9 dogs total. She said there was excrement everywhere. There were also 3 puppies. She said that she saw one dog that appeared to have Zekes coloring, but it was dark and the dog was matted. She could not tell the gender of the dog. She said there was one window and this is what she looked through.

She said that is when they called the police who brought out animal control.

She was told that unless she could make a 100% positive ID they could not get a warrant and enter the house.

She said in all good conscience she could not make the ID and be sure.

She said all of the dogs appeared neglected and all jumbled together.

She hopes that if Zeke can't be found there, that maybe on eof the others has a chip that corresponds with one of the other two missing yorkies who were chipped. She was contacting their owners to alert them to this location as well. I hope she was able to do that, because if ANYONE can make a positive ID that there dog is there, a search warrant can be obtained and then ALL the dogs can be scanned.

I will be praying for Zeke's safe return.......

We all have the desire to drive over there and break down the door and just grab Zeke, but I think it's best if we just keep in mind that Galatea knows what she is doing and she and Maureen are doing this their way.

It might be more positive if we put that energy into wishing them well, lighting candles and praying, not that everyone's ideas aren't appreciated. They certainly are, as is your support.

Well even if Zeke isn't there maybe something can be done to help these dogs at that house. Poor things.

For the record, because I am an attorney, I am officially considered an officer of the court. In that capacity, I can not advise or recommend that anyone commit an act that I know to be a crime. If I did, I could lose my license.

Wow! We really have to take this seriously and not post any more ideas that are not legal, even if we're not sure. We can pm each other, but let's promise each other to keep them off this thread. Of course, we don't mean them seriously, but we can't even vent on here in that way.

There is not a new regular MPD officer on this case, and there likely won't be. Animal Control is a division of the MPD, so it has now been passed on to them.

Maureen called me this morning in tears and said the animal control officer called her and said they would be doing nothing about this case because there was no case according to Nickerson.

Nickerson called me about the same time and told me that Animal Control went to the house around noon and he did not know the results and gave me the name of the new animal control officer. He told me that he has always returned Maureen's calls, but usually gets a voice mail and it has been telephone tag. He is on 4 days, then off 4 days.

Because I have conflicting information and Maureen thought the female Animal Control officer who returns on Monday was sympathetic to her, I have decided to wait to call on this UNTIL she returns.

I think on the most part we have always considered abiding by the law from day one. Everyonce in a while someone will lose it and threaten to jump a fence or break a window, but to my knowledge it was just letting off steam. We have always known we can not break the law.

I must say, with Galatea on board, we have the guidance and the guidelines we need to respect, and ahere to the law, anyone that does anything different makes it harder to get ZEKE.

I hope we are all on the same page, will listen to Galatea, and respect her wishes, she is our last chance to bring Zeke home, without her help I'm afraid we would not even be able to get close to getting ZEKE back, if he is at the Grandmothers home, she will find a way to get him for us. I support her 100% and remain grateful that she is on board.
