| I too agree that you should hold your ground and re-emphasize to her that the deal was you were to get the female pup and you will not settle for anything less. Best of luck to you.

Under contract law, there is no contract if there is no consideration. and FYI, The consideration must be reciprocal, each party offering consideration. You offered your male as a stud in return for possession of the female offspring (their 'consideration' ).. you met the terms of the 'contract' aka "agreement". Were there any stipulations that she could alter the agreement at her discretion? You would have had to be aware of this prior to the "deal" ... I am certain you can give the baby girl the proper attention .... so that does not nullify the contract. (And that was not mentioned or stipulated at the time of the agreement). In law we learned that a contract is any agreement where there is: a) a mutual exchange of promises ; b) with reasonable, understandable terms and conditions c) that binds the parties to performance of the responsibilities described. I do not see a violation of that definition. So speak up! and good luck!

| When i hear things like this i wonder how some people sleep at night. Why are there so many dishonest people around?? I hope you get your little girl as i'd hate to think of her growing up with this type of person for an owner.

| Hello, Maybe she is hesitating because there are only two pups in the litter. Now this is only a suggestion, but perhaps you could say something like 'since there are so few puppies you'd be willing to stud out your baby to her again for free, or with a reduced stud price.' That way you get your baby girl, and it gives this lady other options to consider. I know vet fees can get way up there on a pregnancy and pups, so maybe she's wanting to have a chance to break even on that, and it can be hard with only one male puppy. Again, just a suggestion, and I'm thinking of what I would do to get the female pup that wouldn't cause more money or even sour a relationship with someone whom you consider a friend. Also, from the way she keeps mentioning her husband; it's possible that he's pressuring her. It's always hard to please everyone, and spouses insist on priority (no matter if the issue is right or wrong). Good Luck!!!!

| The circumstances she is under shouldn't matter. She must have known what she was getting into when she approached about breeding the dogs initially. It is common sense that there are costs involved in a pregnancy. There are other ways to raise money to "break even". An honest person would honor her agreement first (give her the baby girl) and then seek other ways to replenish whatever money she spent. Besides, if she's trying to make up some of the costs, why is she offering 700.00 for the stud fee. That's just ridiculous. There is no room for compassion for this lady even if her husband is pressuring her. There is no way my husband would ever let me be or appear to be a dishonest woman. If anything, he would do what he could to preserve my integrity especially because I use "his" last name. Lillyrican, you have options. Don't be bashful about claiming what is rightfully yours. These people are just seeing dollar signs or they probably promised a family member a female and she anticipated there being more puppies. She is just prioritizing. Maybe she rather preserve their friendship before yours. And while I am a firm believer that Blood is Thicker than water, I don't think there is anything that would make me go back on my word. Fight girl, fight for what is yours.

| I agree you had a verbal agreement, She should of thought about all the 'if's" before she made the deal with you because in all reality if this is her 1st litter she could of very easily had just 1 pup weather it female or male.. and if it had been just a male you would of been on the other side of the deal "OUT". But luckily it fell out and she had a female so you get the girl.... and luckily she had 2 so she has profited. She got the bonus weather it female or male. REGARDLESS..... You should get the female. I think you learned a valuable lesson get it in WRITING and have a stud fee in case there is only 1 pup or not the pup of your choice. Good luck and let us know what's going on. I can't wait to see pictures of the little girl. |

I would NOT back down. To others who don't have pets, her excuses may seem valid. But to we Yorkie lovers, we can see right through her deception. PS. And what Yorkie isn't a finiky eater?
