| Should I be upset about this?? Hey guys I was doing some thinking today about my pups...I bought them from a breeder and paid quite the pretty penny ($2400 for Lexi, $2200 for Oliver) for them. Of course I don't regret it in the least, but in light of the recent health issues I've had with both of them, should I be upset with the breeder? Oliver was just diagnosed with macrovascular dysplasia, a hereditary disease. Lexi has a grade 3 luxating patella, which the breeder said may have been her fault when she helped the mommy dog deliver Lexi. She said Lexi was so tiny at birth that she could have been injured during delivery. What do you guys think? Should I call her and talk to her about it? What really can be done at this point though? These pups are my babies and I wouldn't trade them for anything, but I guess I'm just looking for some perspective. |

Donating YT 14K Club Member | What kind of contract did you two sign? Was there a 1 year health guarantee? With those kinds of defects...hereditary, the breeder is liable for any and all vet trips and treatments.

| We the undersigned, acknowledge and agree to the following terms and conditions in purchasing a Yorkshire Terrier from (Breeder Name). To the best of my knowledge and belief, this puppy (dog) is in good sound health, free from symptoms of contagious and infectious diseases at the time of sale. (Breeder Name) guarantees the health of the animal at the time of purchase, accepting no responsibility for illness or death brought on by improper care, handling, or accidents once the animal leaves these premises. The animal has had all necessary vaccinations and wormings, with the exception of rabies. A required visit to a veterinarian should be made within a 48 hour period after purchase to insure the health and soundness of the animal. If the animal is not in good health, due to disease only, all money will be refunded in full or a replacement puppy given (the buyers choice) providing a vet's certificate is provided to the seller. This guarantee does not include patella luxation, occurring sporadically among toy breeds and sometimes caused by trauma (note: patella problems have not been detected in (Breeder Name) yorkies nor the presence of worms which may be found in any healthy puppy. No treatment is authorized. This guarantee is made for the protection of both the buyer and the seller. (Breeder Name) agrees to be available for advice in both the health and training of your new Yorkshire Terrier and reserves the right to have first choice of obtaining the dog should the owner agree to give the animal up, under certain circumstances. It is further understood and agreed that no warranty or representation has been made with respect to the purchased animal, except as set forth in writing in this agreement. All parties will acknowledge they have read and fully understand the terms and conditions of this sale by signing below. Pardon any typos people, that was a lot to type! Whew! |

| It sounds to me as if you may have no recourse with Lexi's illness but you may have with Oliver's illness. It wouldnt hurt to call the breeder and tell her what is going on and see if she makes you any kind of offer to help with expenses or anything!

| Agreed.. the first condition is genetic, and she should be willing to do something about it. If she is an AKC recognized breeder, you would think she would not want her " name in lights" as having sold puppies with these kinds of conditions. And the second issue with grade three patellas would be hard to miss I would think.

| She's an AKC recognized breeder - would this be something I could take up with the AKC if she isn't receptive? ==================================== sorry but the AKC doesn't get involved in these kinds of disputes; the contract was for 48 hours only with no hereditary disease coverage; I doubt the breeder will help at all; I'm just a small,breeder but even I give a one year guarantee. | I read the same thing Jerry did. I don't think you have any recourse on either issue at this point. And honestly I have 2 contracts that cover genetic diseases but neither cover LP. You have the third dog I have read about with microvascular dysplasia lately.Or chance of.I have never heard of it til now... |

Donating Member | That's so sad for you - even if you can't get help from your breeder - you really need to make her aware of what she's doing.... though she may already know it and not care. I t really sounds as though she's breeding genetic faults and selling the puppies regardless....What a shame you are having these problems - - I'm no expert but I have a feeling LP is not caused by delivering a puppy - Grade 3 is pretty serious if you have a young puppy - LP is treatable but I don't know much about the MD....and I agree with Diva Pup - there are quite a few posts lately about macrovascular dysplasia...it would seem some breeders are being very careless in their breeding practices... I would be just sick with worry ...good luck with your babies and I hope they can live a happy healthy life but if I were you I would for sure call the breeder and complain - that's alot to pay for a yorkie who has some pretty serious problems ...I'd be pretty upset if I were you. BEST of luck with your babies .... |

She cannot challenge you with slander if what you tell is "just the truth" Think of it as preventing more of the same worry and heartache you are now enduring, We all wish the best for your babies but she needs to be stopped from putting out puppies with this kind of contract. I too guarantee against these ailments for one year.

| We will keep Lexi & Oliver in out Thoughts & Prayers, I'm really not sure about your contract. I think you might have had a breeder and not a Breeder. I have a lot of respect for the good Breeders out there.
