Trying to find a buyer when you told us you will not refund the money until you have a buyer (but to bring back the puppy back for nothing) is *not* illegal, no matter what you may believe. And, there is no fraud here either. You only offered to refund the money now, originally you wanted the puppy without refunding the money until you sold it. How do we know we will get our money back then? Besides, we were trying to find a home for her and then we were going to contact you so that you can arrange the actual transaction with the papers, etc. Just like you were trying to find her a home, so were we to try to help find one quicker. But again just to be clear, your yorkie breeder laws are NOT the laws of the country we reside in. Keep that in mind before you accuse people of committing illegal acts or fraud, when that is simply not the case. There is nothing illegal about trying to find a dog a new home and *again* you did not offer to refund the money initially (actually you did and then you said you wont until you find a buyer, not very nice...). She is living in better conditions then she did at your house, so as far as her safety goes I think she is perfectly safe and happy. And she is separated from my German Shepherd so there is no issue there. I've already written to you about the problem, do you want me to repeat everything here? The one thing that actually *is* illegal is you posting my full name on a public forum without my permission. I expect you to remove that immediately. I already contacted you yesterday telling you that I will try to make things work and let you know. If you rather I explained everything here just le me know, but we were trying to protect you. Anyway, obviously you are misunderstanding the whole situation and over reacting. Perhaps in the future you should be more educated about the situation before you judge people and make accusations. To the other posters here, sorry if this is causing commotion. I intended no harm and we were honestly trying to find her a good home here as we knew there are many people here who love the breed. We made it clear who was the breeder etc and I think anyone knows its easy to give Betty a call to get any other information. |
PS. I've already tried to remove the post offering the puppy via the moderator yesterday when you said you would refund the money, but looks like it hasn't been deleted yet. |

I sure wondered why Tuntun was offering this pup for sale like that. i knew something was wrong. And people wonder why we are so careful when selling a puppy? I know what Betty Anne and VickiLynne have gone through over this. and yes, breeders please get that $5000 at minimum clause for any breach of contract, I sure have it mine. |
In fact we are not in violation of the contract. And we already offered to return her many times, but initially Vicky did not want to refund the money until they sold the puppy. They have now agreed to do it when we bring the puppy back which is fine. The real reason we are returning the puppy is not because of the german shepherd, they are not even in contact ever. They are kept separately because we know the dog may be too big to play with Roxy. That being said, our german shepherd is very sweet and gentle. I didn't post the real reason only because I didn't want to embarrass the breeders. They know the real reason and can post it here if they want to. Attacking us for doing nothing wrong is not fair at all. We were just trying to find her a good home here and put the new potential owner in contact with Vicky and Betty Anne. There is no ill intent here and accusations are flying all over. Very unfair and immature of the breeder and everyone jumping on their side to support is just being blindly led without knowing the details. Roxy is completely safe and happy... I decided to try to make things work, I wrote this to the breeder last night so I don't understand why she is starting all this. Anyway, she can pick her up if she is so inclined to take her away. No big loss here. Again, I ask that you remove my full name from the post as you have no permission to post it in a public forum! |

This is just horrible. I saw that post yesterday and I thought what the heck is wrong with this person. I had also noticed when it was first posted, she had a pictute of the Yorkie in the Avatar and then it was changed to somthing else. I do so hope they able to get this puppy from this horrible person. |

And yes it does stand up in court a contract is very legal in Canada, don't know what planet you are living on, this is not Europe where contracts are not legal. Most breeders have that stipulation, money is refunded to the first purchaser is returned in a reasonable amount of time, when the pup is sold to a new owner. You must realize that after being out of my hands for a period of time I do not turn around and immediately resell.I have to be sure that pup is ok first. Ana if you want a dog with no strings attached, don't even think of approaching a reputable breeder, try the dog sellers who don't care there are way way more of those than ones that do. Why would it be illegal to post your full name? Not too proud of being called on what you were up to huh? |
Well, yes, the real reason is better explained by the breeder who we wanted to talk to any potential buyer anyway as they were the ones finding her a home. We were just trying to help find one sooner. PS. To anyone that thinks this is a breach of contract -- its not, first we haven't even sold her. Second, there is no clause for resale and third, if we did find a buyer it would happen only through Vicky/Betty Anne anyway. We are returning her to Vicki. Take it easy everyone... try to read between the lines sometimes. And the reason I said its "no big loss here" is a hint at the behavioural issue the dog has. I think I'll stick to German Shepherds. |

Lorraine, again there is NO breach of contract here. Also we've been in contact with the breeder (Vicki and Betty Anne) he whole time and have been trying to return her. And again to be clear: Roxy is not in any danger, she is safe and not playing with our GSD. We are returning her to the breeder who has finally agreed to refund the amount. |
