Easy solution to this entire situation. Judy refunds the cost you paid for the pup, the pup goes back to Judy. If documentation is provided the vet costs are reimbursed.

Not so easy……..only pup exchange not cash refund in contract, and Sheila is bonded to the pup and does not want to hand him back. Would you hand a pup back? Only vet refund offered for minor vet bill, not the big eye issue.

The big eye issue isn't covered as part of the warranty because its not life threatening. Legally, there doesn't seem to be much to stand on.

I agree, I was just responding the the OP's suggestion and what was possible to do via strict contract.

for all parties involved this would be the best option in my opinion. Yes I would give the pup back if it was exacerbating my illness. I have read the entire thread and as an outsider to the situation it is a he said she said argument. I think both parties involved need to communicate and do what is in the best interest of this pup. without all the name calling and illness issues of the persons not the pup involved. The main thing here is the pups well being. I do not believe this pup would suffer if he went back to the breeder. This is my opinion and I am not telling anyone what they should or shouldn't do. For some that have questioned the replacement pup in contracts, there is no set in stone clause that says that has to be done. It is put there as an option. In my opinion the biggest problem here is communication.

You are right. I apologize. My last post was not appropriate. There as something's I am very passionate about.

I have personally known this breeder for years. How do you know the OP? From YT? How can you be involved in ruining a good persons reputation when you don't know either side personally?

I am a breeder/owner-handler. None of my lines are related to the Yorkshire terriers involved.

I understand that you are a friend of this breeder and a fellow show breeder so maybe you wouldn't mind answering a question for me. If you had a pup you sold show up with this disease would you breed that same pair again? Also would you try and help the purchaser of one of those pups out by giving them a pup from a different litter if you were not willing to refund the purchase price or pay for the vet bills up to the price of the pup? It seems lots of very reputable breeders have those things in their contracts although yes I am aware that Judy does not. Just wanted to know your honest opinion on this seperate from this actual situation as a breeder yourself. Thanks.

Talk about loaded questions.

I have yet to see a breeder, show or not, who warrants against ANY defect. If you know of some, I think it would be awesome to post their names on YT so that potential buyers can know that they are only buying a 100% guaranteed perfect dog.

And since this particular condition can be easily diagnosed with a simple eye test, it would seem that providing a puppy from another litter "just in case" this proves to be genetic would only be necessary if the puppy was going to be used in a breeding program.

Excuse Me??? I was asking her an honest question. If you read this entire thread you will see several breeders who said they would step up and do the things I have mentioned. Is there a reason you seem to want me to argue with you? I don't understand why this seems to continually happen when we post on the same thread because I don't know you and have absolutely nothing against you. I do not understand why you would say this is a "loaded" question either.

It's a loaded question because you are attempting to put the poster in the position where her own answers may be used against her friend. Kind of low, IMO.

I am attempting no such thing. This will be my last response to you as you seem to take pleasure in twisting my words, and coming up with sinister reasons why I would ask a question so I will not hijack this thread by answering questions about my questions to another person here again. If you would like to discuss this through PM's I would be more than happy to. I am a very straightforward person and I do not need to attempt to do anything underhandedly. If I have a question I ask it outright just as I did with this breeder. I have no knowledge of either breeder and just like others here I state my opinion and ask questions. It is one way I was taught that you learn. Also dissenting opinions are fine but saying I was asking for that reason is accusation toward me.
