I have read all the threads. I feel bad for all involved. Mostly, I feel bad for Max. I truly think the two parties need to handle this privately at this point. Perhaps a mediator could become involved so that neither has any more hurt caused. |
I agree with you, but for mediation you need open minds on both sides. Hope it can happen soon as this is all very distressing for all. One good thing is that Max is being taken care of very well. |
[QUOTE=Yorkieville200;4349851]Gemy, I sent you Maxwell's Sire & Dam information in a private message this morning, but I will post it here as well. Sire:PELLERD-ORE TOP GUN TR66899601 (2-09) BL & TN NONE (HUN) AKC DNA #V484482 Dam:POTRAITS TREASURE O PELLERDORE TR60763901 (8-09) BL & GLD Search Results from eye registry CERF Registry/Breeder Options Lookup No records found for current search criteria. I searched under the registration numbers on both dogs. |
Gemy What does this mean for Max and Sheila, is Cerf registration essential for an AKC pup/breeder. I am asking as I am totally ignorant of breeder rules and how they affect the validity of a contract. Please do not take my question in any other way. Thank you for doing this search by the way. |
[QUOTE=Dixies Mom;4349937]As a retired law enforcement officer, proof is a big key. Also, as a human being who also lives everyday with a life threatening diseased, the truth is the most important. You are asking for an absolute resolution on your terms without providing any proof to the breeder. Mrs. Marksbury has agreed to honor her contract. I believe that the owner should be getting that paperwork out shortly. It is reasonable for a breeder to request the results of tests that have shown a problem or problem(s) going on. A second opinion for sure can be sought at the breeders expense, she can pick a board certified opthamologist within a reasonable travel distance to the purchaser. Should the purchasers vet health records and the current opthamologists consult report not be enough to satisfy the breeder. As a breeder who would never knowingly breed a dog with a genetic condition I would gladly pay for that consult, especially seeing as I have done no CERF's according to the CERF registry on either one of the breeding pair. If this dry eye is autosomal recessive that means both these dogs carry the gene! And that by God I would want to know for sure that this puppy has this condition. If it is autosomal dominant, and some diseases can be, without full penetration throughout the litter, then at least one of the littermates from either sire or dam would have expressed this condition. This is a life long condition, and maybe surgery (which will be expensive) just might correct it, but if not you are talking about drops for the lifetime of the dog. |

:thumbup: Hopefully, if nothing else, this thread will lead to open dialogue between the two. I hope that one of them comes back to this thread to publicly share the outcome and what is happening with Maxwell!! I would think it would be good for the breeder if they worked things out and Sheila was all of the sudden singing praises. |

Hey Gemy.... Does this mean that the breeder did NO genetic testing on these dogs...or is this just referring to the eyes only?? |

This will not affect as far as I am aware the "validity of the contract", but MORE to code of ethic violations at the club level. I may need to amend my Health Concerns for Yorkies to include this condition; right now I am not sure if I have dry eye on the list, I do know I have cataracts on the list. But as I have written over and over again here and other places, part of the research on the breeder is to go to these health registries and see what health tests have been done, before even thinking about purchasing a puppy!!!!!!!!!!! |

Don't even bother going to CHIC as she couldn't have one as there are no CERF's on file. |
I will not ask Judy to come back to this forum, why would I? As far as the papers, I ask Judy why on earth she would release registration papers with out proof of spay or neuter. She told me the story. Read the definition of defamation... How do you know what is fact? The word of another? I do not know this OP, but, I see who she is in her posts. She needs to return the pup for a full refund as offered by the breeder who I might add is yet to see a vet report. |
Gemy Thank you for the info. It does appear that the breeder is not of the high standard we would hope for and expect. |

Another question(sorry, it's confusing)....Since she doesn't have a CICH #, does that mean she hasn't done genetic testing on any of her dogs, or just this breeding pair?? This seems like a great way to screen breeders. Wish it were more widely known among owners. I never would have known had it not been for Yorkie Talk. |
