I understand that all breeders do have their own procedures and it was just a question because so many here over the years I have been here have told us they would not use a breeding pair they knew had thrown hereditary defects again. Also many here on this thread have said that they would do certain things to help the situation going on. I just wanted to know what your stand with your breeding program would be is all. I really meant nothing else and I do understand if you do not want to answer. If you read the posts I have not said one bad thing about you defending your friend. I just do not understand her position but I don't expect you to be able to make me understand it either. Thanks.

Does the YTCA every mediate things?? If the two parties don't communicate, nothing is going to be resolved.

I wish the breeder would have taken the puppy back when the husband ask for his refund and was willing to give the puppy back~this would have saved all parties involved from a bunch of heartache.


BTW...I think the breeder did offer her a pup from a different litter on here. She may have not did it in her email, but I am fairly certain she said it on here....but she did not offer to refund her money.

EDIT TO ADD: Looking back...yes she did say a pup from any litter and she offered to have it vet checked and certified.

I can't seem to find where she did. But her contract does say serious or fatal illness and if surgery is required this would be a serious illness. Oh wait went back and read she has a second post and yes she did say that.

This is Rich, Sheila's husband. I have just put Sheila to bed. I want to thank the people that have stood up for Sheila. It has meant a lot to her. For those of you that have criticized her, put yourself in her place, and think about how you would feel.

I'd also like to address a few things that have been stated. It's been stated that Sheila has had Max since September and the breeder is just now being told about Max's health issues.

Sheila e-mailed Judy the same day that Max saw our Vet the first time, and told her about Max's diagnosis of yeast infections in both ears, and the bacterial infection in his left eye. And told her that our Vet had done the Schirmer tear test. That was October 1st. (We brought Max home in the late evening, on September 26th.) I took a stool sample in the next morning, and when we got the results that Max had Giardia, Sheila e-mailed Judy right away, and Judy said she would notify the other puppy owners.

Our Vet consulted with an Ophthalmologist at Purdue Veterinary Hospital in West LaFayette, IN. I took Max back to the Vet on October 8th, and Sheila e-mailed Judy right away and told her that Max had been diagnosed with Congenital Lacrimal Gland Aplasia. The Ophthalmologist stated that Yorkies are the poster child for this condition, but she had never seen it in such a young puppy, Judy offered to take Max back and give us the tiny female in the litter. But Sheila wanted to wait until Max had his 3rd Schirmer tear test, which is scheduled for tomorrow. She was hoping against hope that the Tacrolimus drops would stimulate tear production.


As for parentage: We believed when we went to see the puppies the 1st and 2nd time, that gustos mom was the mother to the puppies.

We both wanted a puppy from this particular female, because she looked exactly like our Sydney, who died 2 years before Kia.

I sat with Sheila, as she talked with Judy and Sheila told her that gustos mom looked exactly like her Sydney, and I know that many of you were there for Sheila when she lost Sydney. Sheila and Sydney had an incredible bond, and it just about destroyed her when Sydney died. But she still had our tiny little Kia from Susan Harasim, and Kia was grieving, too.

We didn't find out until October 20th, that gustos mom is not Max's Mom. I had e-mailed Judy, and asked her if gustos name was Treasure, and she responded, "No, it is Treasure".

It's been stated that we saw both parents when we were at Judy's. Yes, we two dogs them in Judy's arms as she stood behind the counter in the office of her boarding kennel. Both dogs were shaved down, and if you have ever had a Yorkie in full coat, and then shaved them down, you know they look very different.

Sheila kept our girls in full Show coat their entire lives. And when she could no longer sit to do it, I kept them in full coat.

With each of our Yorkies, they have come from Show breeders, and we were always given their registration papers on the same day we took our puppy home.

I did e-mail Judy in regards to Max's papers, and asked her to send them, explaining that we needed to see our attorney, to draft Sheila's Living Trust and DNR, and Sheila wanted to name her best friend as Max's new Mom, in the event that anything happened to both of us. There was no intent on Sheila's part to guilt Judy into giving us Max's papers. We never even knew Judy didn't give registration papers right away.

Judy replied that she hadn't registered the litter yet, but would do it and send us the papers.

Another thing I would like set straight is it has been stated that Judy didn't tell us that she imported Treasure. Yes, she did tell us that she imported Treasure, and when I questioned her about it, she e-mailed me and told me she was disappointed that I would doubt her, and said, "All my dogs are imported".

One last thing I would like to address is that Judy's friend has stated that Judy told her that she offered to give us our money back. No, Judy never offered to give us a refund.

As I watched my wife getting sicker, I did ask Judy if she would give us a refund, rather than a replacement puppy. That's when things turned nasty.

Sheila copied and pasted the e-mail that Judy sent to me. And her friend didn't believe Judy sent it, because of the punctuation.

Well, I have that e-mail, and that's how it was sent to me. We have every e-mail that we exchanged with Judy.

So go ahead and continue to criticize Sheila, but remember, "What goes around, comes around

I'm sorry this has been such a nightmare, Rich. Hoping against hope that Max's visit to the vet goes well tomorrow. Please give Sheila a hug from me in the morning. :)

I don't think the questions would be that hard to answer. "If the pup was your pup and it was bought from you, how would you handle it and/or what would your contract say for you to do?"

A lot of people have chimed in on how they would have handed it...breeders and non-breeders alike.

It may be difficult for someone to answer at this point when they don't have all of the date, facts or medical records and results in front of them though. But if, it turns out that the pup is indeed sick and was sick when it was initially sold to Sheila, and there are facts that back that up...then IMO, it's a pretty straightforward question.

Since you aren't the breeder though...it's not going to make much of a difference in how or if you answer it, so please don't think I am in way asking or trying to pressure you into answering...

I think a lot of people believe what Sheila is saying, simply because they have no reason to doubt her. I am not sure what motives she would have to come on here and lie and cause herself a bunch of stress over a puppy. However, I do understand, since she has the puppy and is the only one who can take it to the vet, burden of proof is on her...and luckily, she's said she will provide proof.

If Sheila is just this bad person...who is lying and is out to defame Judy, why on earth would Judy want to do a replacement and give her another puppy to care for?? If she was that bad, it seems like Judy would just want to give her the money back, get her puppy back and cut tie

I started to think about what others would say if one of the well known and well liked breeders was going through this, instead of Judy...and I am sure there would be lots of people defending them. On the other hand, I'd like to believe that most wouldn't have let it escalate to the point that it has gotten in this case.

Rich, tell Sheila I am praying for good news for Max tomorrow. I have had emails and phone conversations with Sheila in the past as her precious Kia and my Pixie, Roxie and Dixie were all from Susan of Stardust Yorkies. She emailed me shortly after getting Max and finding out his health problems. I feel so bad for Sheila, as I know getting another yorkie wasn't something she went into without a lot of thought. As I have mentioned in the past, I had no contracts with any of the 3 dogs I got from Susan. When Dixie had to be put to sleep due to a congenital kidney failure, she replaced Dixie and paid for vet bills without me having to say a thing. Also, with all 3, when I picked them up I was given their AKC papers. So Sheila asking for papers would have been normal based on her past experiences.
I just pray that Max's eye condition can be corrected and Judy and Sheila can settle this to Sheila's satisfaction.

Amazingly sickening thread, all the way around and back again. I have seen many scenarios here on YT. If Sheila was here saying she had a sick pup and wanted to hand him back to the breeder and the breeder wouldn't take him back we would be all over the breeder for that too and in almost unanimous support...ya know? I have seen posts both ways on this but never this complex, confusing or without any proof.

I'm a Lynzycomelately and all I will say is that I still see only one side to this story and no proof of anything other than the word of OP...I do not think the breeder should insert any information at this point giving that her breeding program/show program's reputation etc are on the line. I too believe any lawyer would advise her to NOT comment on a highly public forum. OP, if your trying for any legal recourse you may have already lost your case as you have publicly admitted you have "broken" the contract.....

I am hard pressed to trash this breeder because the breeder did (from what I've read) try to honor the contract that was signed in full agreement by OP. The OP opted (out of love that I understand) to renig on the terms of the contract. There is not a living being that can be guaranteed to be healthy human or pup, we all know this and regardless of how healthy genetics have proven to be there can always be exceptions. This is a perfect example of the exception.

My only hope is that Max is taken care of and I'm glad OP has decided to do the very best for him. Good Luck and prayers to all in this most unfortunate and sad situation.

Lynzy, I have been following this thread since the beginning, especially because it has to do with breeders in Kentucky, etc. Admin can probably explain this better, but I think what happened in the beginning of this thread is the breeder posted, but not all the post came through, probably because she was new at posting. However, I think Ann or Admin later put the whole post up and that is why in the beginning it sounds confusing.

My thoughts are with little Max and hope his is going to be okay.

WOW!! I have been keeping up on this thread and I find it interesting how things are progressing. I have no experience in breeding or contracts, so I have no basis for any opinion. I sure hope that a reasonable conclusion can me made... soon! A main reason why I am posting is, I would like to say that Rich, Sheila's hubby, deserves a gold medal for all that he is doing and done!!!!!!!! I can't imagine being in his shoes, and trying to keep all the lose ends from unraveling!! Kudos to you, Rich!:angel::angel::clapsmile:clapsmile:woof::woof : Lastly, I sure wish that Sheila is able to return to some sense of normalcy real soon!! Sending positive thoughts all 'round.:aimeeyork

I think also we were reading this and the other thread to and only responding here (some of us) and it probably added to the confusion.

Hi, Chris.

Thank you. Sheila went with me to Max's Vet visit this morning, but she is back in bed now. It's hard for her to move very much.

Max now has it in his right eye.

I gave Sheila a big hug for you, and she asked me to give you a big hug for her.

Hi, Patti.

I told Sheila that you are praying for good news for Max. She said to thank you for always being such a great friend. She went with me to his Vet appointment this morning. But she is back in bed now. Moving makes the nerve pain, bad for her.

He has it in his right eye now.

The Vet explained to Sheila, why she did the first Schirmer tear test. She said Maxwell's left eye was so dry. So then she consulted the Ophthalmologist at Purdue, and she said she had never seen Lacrimal Gland Aplasia in such a young puppy.

I feel pretty bad. The day after Sheila e-mailed the breeder, she changed her mind and e-mailed her and said she wasn't ready.

I told her to look at the picture of gustos mom again, and she looked so much like our Sydney, that I convinced her to call the breeder.

You went through the grief with her when she lost Sydney, and again, when she lost Kia. I know that losing Kia just about killed her.

Susan really was a wonderful breeder. She always called Sheila, every time Sheila sent her a picture of Kia. I wish she hadn't retired.

Sydney was out of Susan's blood-lines on her Sire's side.

Both our girls were so beautiful and so healthy.

Julianna,

You are far too kind. If you ever met Sheila, you would meet a beautiful lady, in every sense of the word. She's beautiful inside and out.

She never complains about her pain.

I know God blessed me, the day He put her in my life.

She's a Eucharistic Minister-not active right now. But she is the only Minister in our Diocese that the Bishop gave a dispensation to hold Communion Services.

She's in pain today, after going to the Vet appt.

But I will tell her that you said you pray her life returns to some sense of normalcy soon.
