Gardenyorkies: as I stated in an earlier post, I have found that breeders get offended when I have offered to write the contract, and say they have their own with their own conditions -- I've only had 1 breeder so far that has allowed me to change some of the terms of their agreement. Anyways when exactly was I suppose to walk away? --when they phoned me after 3 days of waiting ( I had no other stud and hoped for the best), after the 4th day when their dog didn't ejaculate into my dog (they insisted they could do AI the next day on Wedn. and again on Friday so I gave it another chance -- hoping my dog when be in standing heat several more days). AI worked on Wedn., but she was definitely out of heat on Friday -- they still wanted to breed her, but that's when I said no - she's done, it's too late, you weren't there when I really needed you like you promised, now lets look at what happened here and what is a fair price... I guess I expected the answers I got on this thread b/c they would be answered by breeders. When I surveyed a table of teachers today at lunchtime and told them the story, all of them agreed that the breeder should not be given the full amount b/c he was not available the first few critical days like he said he would be, but should be paid the full amount if my female gets pregnant. One teacher stated I think paying 1/2 ($250) would be fair and then the balance if your dog gets pregnant, another teacher agreed ... I think I feel comfortable enough with these women's opinions who I know are bright, caring, responsible people ... but thanks anyways everyone for some interesting discussions. |

Well I know breeders in my area ask for pick of the litter or the amount of one pup. they do pay half up front but if their stud does not get the female pregnant they get that money back, and some will wait and see before getting their money. But all breeders are different and have their own way of doing it. a contract is always best. and always make sure the stud has been tested for STD and have had all the normal test ran on their dog before breeding it with your female, if they havent I wouldnt use them. |
I asked a teacher about this b/c I am a teacher and happen to work with a group of wonderful level-head teachers -- so it was a good unbiased audience to survey. If I ask an audience of breeders they be biased and most will probably side with the breeder rather than also looking at the viewpoint of the customer. |
I am also surprised that the owner of the stud didnt give you a written stud contract to sign. That being said, one breeding constitutes a breeding. Therefore, the complete stud fee should be due at the time of breeding. It is not the fault of the stud owner that your bitch came into standing heat during a holiday. Stud owners may have had plans too.They do have a life outside of breeding dogs. I do agree that they should have made it clear that an AI would probably have to be done. I would probably not have used that stud if that information was made available to me. I also would have , well in advance, looked at many studs before choosing just one, for the exact reasons that you have run into(non availability, breeding another bitch at the same time, etc) Also, it is not the stud dog owners fault that you had to drive over a gravel road and it broke your windshield. It was you that wanted the stud service. |
But, since it is a verbal agreement and both parties agree on the 250 down, 250 at whelping then I dont see any problem with your arrangements. |
