| [News] Judge: Man Doesn’t Have Dangerous Dog An owner whose dog accompanied a pit bull on a fatal attack against a Yorkshire terrier in Hazleton was found innocent of harboring a dangerous dog. John Leshko of 456 E. Cranberry Ave., however, must pay a fine and costs of $159 for failing to license his dog, District Judge Joseph Zola of Hazleton ruled Thursday. Leshko testified his dog, Bailey, a mix of breeds including pit bull, didn’t participate in the attack that led to the death of the Yorkshire terrier. His son’s pit bull, Cocoa, charged the Yorkshire terrier, and Bailey entered the yard at 450 E. Cranberry Ave. after the attack occurred there on Jan. 5, Leshko testified. Cocoa attacked swiftly after getting loose from Leshko. “I tried to stop it. I wasn’t fast enough,” Leshko testified. Mary Ann Winters, who owned the Yorkshire terrier, testified that she saw Leshko retrieving two pit bulls from her yard after the attack. “He said they did it,” Winters said, stressing the plural pronoun when asked to give her testimony by state Dog Warden James Spencer, who filed the charges against Leshko. Winters didn’t think one dog could do so much damage in such a short time, she testified. Her Yorkshire was gashed from shoulder to shoulder, had a bulging eye, and puncture wounds down its back. It looked like dogs played tug of war with her Yorkshire, Winters testified. A veterinarian decided the terrier had to be euthanized due to its injuries. When Zola asked if Winters ever filed a complaint against Bailey before Jan. 5, she testified that Bailey did come after another dog. That led to an altercation between her and Leshko, but she didn’t file a police report. Leshko said that incident occurred four years ago when Bailey was a puppy. When ruling, Zola issued a warning to Leshko. “As far as we know, you were the only witness. If you believe that was a dangerous dog, to prevent any future action, take the necessary action,” Zola said. Leshko said he would have acted if he thought Bailey was dangerous. He had Cocoa euthanized after his son, William Brennan, pleaded guilty to harboring a dangerous dog Feb. 21. http://www.standardspeaker.com/index...=1288&Itemid=2 |
