I am so very sorry for your loss of your wee boy. Fitness of registered companion dog or cat for sale; definitions; certifications; remedies. It would seem that there maybe some financial remedy for you under the pet lemon laws for your state. I do urge you to investigate this with your vet. In fact your vet should in my opinion have already gently counselled you about this. |

So very sorry to hear your little Bailey didn't make it. Poor baby :( If I were you I would take that breeder to small claims court and sue her for the cost of your pup and the vet bills. She should be held responsible for selling you a sick puppy and for selling that puppy at 9 weeks old. Did you have a necropsy done to rule out or confirm any genetic issues? |
I just want to say for all purchasers, that you never leave the breeders home without signed paperwork. At the minimum a contract of sale. Which by the way you should have already printed out the pet lemon laws in your state, and then you can insure said contract falls in line with those laws. Better still the contract should have already been sent ahead to you, for your perusal and examination by your lawyer. If the dog is registered that means the parents are, and you should demand at the minimum copies of the registration paperwork, if the breeder is with-holding paperwork of registration until you submit proof of spay/neuter. Once again I am deeply sorry for your loss. |

Can anyone counsel me on how to hold this breeder responsible. Here is what I can share. *Pup was listed on the Greenville Kijiji pet section website *Pup was listed as 8 weeks..registered..and guaranteed health *pup was listed at $350 and she said she would take $200 *I visited her home where I purchased Bailey and was told he was the last of the litter and had been held back due to ringworm treatment *I contacted her the next day to inquire as to why I received no paperwork. Keep in mind I had my kids with me and was a little overwhelmed and excited. *She said the registration papers but had to resubmit them and she would mail them to me when they came in and I could pay to register them online *I never got anything written about the health guarantee-I am a first time breeder buyer and didn't realize this was a "written" thing. *I have yet to receive anything from her *I have all of our corrospondance since it was instant messages through facebook *She admitted that her dogs tested positive for coccidia four days after I got bailey-her dogs had diarrhea *She said she wouldn't help with the vet bills because I used albon instead of marquis as she requested ...my vets use albon *She has offered to replace Bailey but my vet advised against it because her kennel has coccidia in the environment *My puppy was bought on Wednesday July 4 and went into the vet for coccidia on the next Wednesday and was on IV from Thurs. to today when he passed *She will no longer respond to my requests that she assist in vet bills after admitting that her dogs tested positive as well. **Any help is appreciated guys!! I have dipped into our house down payment money to cover vet bills and I am no more able to cover these bills than she is!!** |
also...should I contact her before filing in small claims against her to give her the opportunity to do the right thing or just do it? I have to put a stop to her selling coccidia ridden pups!! She only had two dogs tested and she said only one tested positive. However, my vet says they will all eventually get infected. |

Sorry to hear about this! I have never heard of coccidia being that severe! Did they test him for other stuff too? I would wash everything you had him on and your clothes in bleach just in case before getting another dog. Read some of the stickies on YT about buying a yorkie and what to look out for- that breeder had a lot of red flags- here's a good one: http://www.yorkietalk.com/forums/fea...ead-first.html for future reference a healthy purebred yorkie will probably cost you at least $800, I would be very skeptical of anything listed for less because a true breeder spends much more money on the health of her puppies, parent dogs, testing, and health they don't list them for this much to make money, they are simply recouping costs of care usually |
I purchased Winnie for $350 but she is not a purebreed she is a yorkie/russel mix. To me even that was a bit cheap. I am not a lawyer so I dont want to speak out of turn but if I were you I would mention that I was contacting an attorney and plan to take legal action against her. Remind her that you have all of the emails in regards to your pup. Is the health guarantee mentioned in any of those emails? If so I would highlight and forward that to her. I would also get signed paperwork from your vet stating that if one pup was infected all pups would be so accepting another puppy as compensation would not be adiquet bring that to court with you because this will be her only leg to stand on. Also speak with your vet about this. Make sure they know that you are attempting to gain monetary compensation from the breeder for the vet bills and see if they will work with you on putting off some of the payments until after the court case |
I am very sorry for your loss. I agree with the others, you should contact your breeder (and I use that term loosely) and tell her you are aware of the puppy lemon laws in your state. Even if you do not have a contract, can you at least print out the ad. Take her to small claims court, or Judge Judy! |

Did you do a necropsy? The comment about Bailey's liver may be the problem. I would ask my vet if there is a possibility that Bailey had other health issues. This information will only help when dealing with the breeder. You and your vet did everything you could. Something else was preventing Bailey from fighting off the Coccidia. I hope the breeder corrects this situation. I know there is no way to replace all that you have gone through and the expense. |
