A necropsy needs to be done. |
I have to share this. So when I got my Bailey there was nothing signed or anything. So, today I get a "PUPPY AGREEMENT" in my mailbox signed only by the greeder (not me of course because I have never laid eyes on it) stating how coccidian isn't covered, an autopsy must be done, a replacement could be offered and NO vet bills are covered. It was salt in the wound. Anyone who reads this is smart enough to realize it was created, written, and printed only for me. It was full of misspelled words, bad grammer, and it is written in anger. I , of course, have not signed it and I feel it will only strengthen my case in the end. Any opinions??? This was no health agreement only something fabricated to cover herself. |
Saying this gently...but the case of a puppy's death...it is routine for a breeder to require a necropsy. The SC puppy lemon law requires it also. |
I'm not so sure it counts if it is received as a requirement three days AFTER the death of the dog. |
What a mess. In reply to a question you asked about letting the breeder know you are taking her to small claims the answer in Ca is yes. You must inform her of your intent before filling papers. When you get your papers for filing all the necessary steps will be outlined for you. Good luck. I hope hope nail her. |
So sorry to hear about Bailey. You did everything you could. I'm glad you are going to take this breeder (and I use the term breeder loosley) to court. Also smear her name all over facebook and anyplace else you can think of. I shudder to think of all of the other puppies in the litter. She should be burned at the stake because she is a witch. I hope someone can put her out of business because God knows who she is selling these sick puppies to. |

If I were you I would also copy the information on YT from reputable breeders that say 8 weeks old is too young for a yorkie puppy to leave their mother. Arm yourself with as much evidence as you possible can. I really hope this person has to pay the maximum possible. Maybe you'll get a judge who is a yorkie lover :):):) Feel free to share her name on here, also. Does she have a website? |
Thanks so much for the well wishes guys. I am afraid at this point to put her name on here. I can however say that she lives in Gaffney, SC and sells and breeds yorkies, morkies, and poms from what I saw. I wish I knew someone who could tell me if this was worth persuing. If you look throught the posts, the views vary and I cant dump more money into this unless it will be a positive result. :confused: |

That's such a heartbreaking story. I can't imagine how devastated I would be if my pup had to go through that. I know it probably doesn't lessen the pain you're going through much, but you gave your boy the best fighting chance he could have gotten. I hope you can find a little bit of peace here on yorkietalk, sruss; this place was a lifesaver for me when I buried my girl in May. |

Keep the envelope you received the "health agreement" in. It will show you received t after the death of Bailey (postmark date). She doesn't have a signed copy from you therefore it won't stand up in court. The registration papers from CKC, ACA or APRI are a fluke. Anyone can register anything (literally a coffee table) with those bogus registries. Go AKC or Canadian Kennel Club. Sue. Sue her for all vet bills, pain and suffering and the cost of getting a new puppy. And plaster her bad name every where you can with your story. |

Thanks guys. I will sum it up with this. My son simply wanted a puppy, not all of this. Lord knows its not fair. I could sue her for a million dollars and accomplish nothing but dragging this out for my son. He is all that counts. Unless you have sat and watched your puppy scream in pain then you have no clue. He just wanted a puppy. I may have been ignorant of the law but Im not a puppy "buyer" per say. I saw him , thought he was cute, and he had papers and shots and such. My son loved him. Its easy to say to know both sides of the law, but the average person does not know or have a clue. Who would think they needed to know when getting a puppy? Time is creeping and he is healing. We are going to go have a puppy checked tomorrow for him to see if he will be a fit for him. I truly and gratefully appreciate all of your wishes, prayers, and hopes for us. Some say I have no case, others say I do. Please understand that I cant afford to go to court if I cant win, even if to prove a point. All I can do is pray about it, hand it over the Lord, and pray for the lady who did this. Its not always meant for us to understand and vengeance isn't always going to help. If my son wasn't involved, it would be different. If the Lord sees fit for this pup to bless our home, then it will happen. If not, then my job is done . No amount of money will help anymore, honestly, its not worth it. I cant pay to get my Bailey back or those memories out of my mind. Of course it was my first instinct to get revenge, but my heart has softened and I have peace about it. It brings tears to write this, I miss my sweet boy.Thanks again. |
