Has anybody been through this? My dad recently bought a new car from a small dealership and now he's finding out that the guy who owned the dealership committed a bunch of fraud and has declared bankruptcy. The car that my dad bought has a lein on it (money still owing on the car) and the dealership's credit company wants to repossess the car :( It's completely unfair, as my dad paid for this car and now it must be taken away for no fault of my dad's. I was just wondering if anybody here has been through a problem like this and has any advice or thoughts? Anything would be helpful, thanks in advance! |
CholeandJ just had a thread about this recently. Unfortunately it doesn't look too promising on getting any money back. |

We have sent in a claim but have no idea if we will see any money. Be sure to report it to the DMV and they can also tell you how to the the information on the dealer's bond. |
Oh my goodness, I had no idea this happened to you, too! I'm going to go read your thread. There is a compensation fund that we can file for, but the maximum payout is only $15000 and my dad paid almost twice that for the car. Another problem is, he paid most of it by certified check but paid the rest in cash, so there's no paper trail for the cash, and so he can't prove the actual price that he paid for it :( Can I PM you to talk more about this? He surely received a printout from the company with the price he paid for the truck? They usually print out a long yellow piece of paper with everything on it. |
Well, on the sale agreement/bill of sale, the guy only put down the amount that my dad paid by certified check...he didn't include the amount that was paid in cash. When I went with my dad to pick up the car, I kind of had a bad feeling about the place. I told my dad that I had a shady vibe about the place, but he had aready put a few thousand dollars deposit on it and just figured it was ok, since it was a legit dealership and not a curbsider or anything like that. I should've gone with my gut feeling and convince my dad to not get the car :( Quote:

My dad has done dealings like that before and has never gotten screwed over by it. We just didn't think that a legit dealership was capable of a scam like this. Hindsight, there were many red flags and we are now aware of that. No need to point it out and make me feel worse about it. Quote:

My dad doesn't want to shell out money for an attorney either, especially since it's not a very hopeful case. We went to file a police report, but the Constable said it wasn't neccessary, because a bunch of other people had aready filed police reports on the guy. Apparently this jerk ripped off atleast 12 other people :eek: He's currently on house arrest until his trial, but that doesn't help us keep the car or get our money back :( Quote:

Oh, I forgot to tell you that the lien on the car is around $22000...and we are NOT paying that much to keep it. |

This must be a new way for scammers to make money:( I'm so sorry for both of you going through this, it's just horrible and unfair:cry: In the future, there must be some way of checking for liens:confused: Does CarFax do that? Gosh, the world is SO full of shifty people. |
My husband got the carfax report on his truck after this all came about. The lien on the truck was not recorded on carfax until the day my husband went into dmv to try and register it.:confused: wierd!:mad: |
The Ford dealership in a town near here did that on a big scale. They were not paying off lein's on cars that were traded in, they were not forwarding $$ for extended warranties that were purchased by car buyers & they were not paying their floorplan for cars that had been purchased and were gone from the lot. Ford came in after sever complaints and closed them down and called in the state for a complete audit. The case is still pending and I don't know what happened to those who traded vehicles and they were not paid off like they should have been. It hurt alot of people as this practice was supported through the entire office not by just one person. |
Thank you so much for your sympathy. In the future, we will know for sure to be more cautious and check the lien information. We just didn't think to do all of that since it was a legit dealership. Had he have been buying from a private seller, he would have checked into everything more carefully. We know better for next time, but it still sucks because we're out a great deal of money :( Quote:

I wonder how you go about checking liens? Do you go to DMV, or the courthouse, or what:confused: This could easily happen to ANYONE! Like Yorkiemom55 posted, there was a dealership in our town, about 15 years ago, that was doing all that shifty stuff. It just sucks that we feel so safe going to what we think is a legit dealer, and end up getting burned. I guess there will always be those that find a way around the laws so they can rip off others:( |
