I totally agree with this...What is this world coming to? I pray that you get your puppy back because if this woman is really just interested in the money then she probably shouldn't have this innocent creature in her posession. If the puppy is not a possibility then you should at least get your money back, you didn't have the pup very long, and why would you just GIVE her the doggie back? Good luck, and everyone here has given good advice.

You have gotten good advice. Just wanted to share my thoughts too! Definitely make a list of all of these, so you can get all of your paperwork in order before your court date. (Any paperwork from the breeder, phone records, emails, payment information, police information, any contact prior to the purchase with this breeder, vet information, pictures you might have, etc.). The breeders sister could be brought into it as well, since you contacted her.

Did you get any paperwork when you took the puppy back? Anything about an agreement on what will happen or what the breeder and you will receive out of the return? I know that you (we all) don't think about stuff like this at the time because we are just thinking about the well being of the puppy....so don't stress if you do not have all the paperwork. It is sad that in this day and age, you have to treat the purchase of a puppy like a business deal (which it is since normally there needs to be a contract and with a large amount of money being spent), but it is cases like this why that paperwork comes in handy. And, I for one, I the person who does keep records on everything and when I bought my Yorkie, I made sure I had copies of everything....I even have printed out copies of emails to and from the breeder before I even purchased my little guy...that was almost three years ago!! I think you did a good thing too about going back to the breeder....thinking that she would be the one person who understands the breed and knows who to find it a good home (the judge should see it that way too)....who would have known that the breeder would then turn around and do this? People are crazy!

The bad thing about waiting a month for the court date is the fact she can sell or get rid of your puppy before she gets the notice (or says it was before she gets the notice). I am not sure how it works, but it would be nice if there were a way that she could not sell any puppies (any of them, not just yours) until this is settled....that way, she can't get rid of yours, or lie that she sold another puppy not yours. I think if I were buying a puppy from a person and had to wait, I would understand or what to know the circumstances and then I might not buy from them.

I wonder if they will bring up the fact that you purchased a dog without knowing if it was allowed in the apartment....do you think there would be any down fall from that? I am just trying to think of all the possiblilities here and not saying anything bad on your part. It might be a good idea to get a copy of your apartment pet policy and your boyfriends apartment pet policy too....take that with you to court....that way, the judge knows the puppy would be allowed in the other apartment.

The best you & your boyfriend can do is to be honest and have all your paperwork (and anything else you may think will help). Sometimes, you can even do some research on the judge....some are well known animal lovers, etc. And it isn't that you are doing anything sneaky or wrong, because there is a lot of information availbable to the public and sometimes that can be a blessing.

The one thing you can do that makes it easier to get her arrested is get a warrant for her for Theft by Deception....That is a felony and by it being that the police have to issue a warrant , Contact the state police not the county . The state police will issue the warrant then she will have to go before the grand jury. The grand jury can indict her .
I know this works better than any other way because i had to do this over a horse.

Definitely keep us posted. i can imagine the agony and heartache you must be going through. I also think you should try to find the vet that has been treating the pup and maybe that will tell you if she still has it. GOOD LUCK

That is terrible!!! I don't remember what station he's on ..But Brad Edwards does "in your corner" and his whole segment deals with sitituations like this!!! I wanna say he's on Channel 4...well 3 now..but i'd check into it!

I hope by now you've found a reporter interested in your story. I'm a reporter and this would definitely be something I would want to cover if it happened here. I can't believe this breeder. I used to breed Bichons. One time I had a retired gal buy one of my males, then about 2 weeks later called and said she had been asked by a friend to go on a 6 mth journey (or something) in a motor home. She wanted to know if I would take him back under similar arrangements to what you made. I took that puppy back (I think I had sold the rest of the litter, or had one left at the time) I tried every which way to sell the little cutie and could not get him sold - I spent more money placing ads in the paper - he became best friends with his dad - he was having a great time at my house - but I didn't need him coming of age to chase his own mum. Well, I kept trying to sell that pup and the lady who had bought him refused to believe I couldn't get him sold. She filed a complaint against me with the attorney general and then filed a suit. I told her all I had done and provided documentation of the ads. Thank God, when the pup was almost 7 mths old I got him sold. It was right before she would have taken me to court, but unlike your breeder I knew I was in the right. But the buyer was so nasty through it all - of course I had to deduct the cost of additional advertising for the pup and shots I paid for and should have taken off the cost of his food, but I didn't. She got most of her money back, but I grew so attached to that pup, so I had that additional heartbreak

Taking a dog back for a breeder can be risky, but this women is unethical. I agree contact the state police and perhaps animal control. Someone should be able to verify that she still even has the dog! Also, report her to the attorney general's office. I hope you received positive feedback from AKC.

AKC told us that there was nothing that they could do, it is outside their jurisdiction. *shrug* That's a damn shame, AKC.

As for the news, we have not heard back from them, so today we are going to start contacting individual reporters...

Keep on trying, and DON'T give up! Hey, maybe you can get some Yorkie Talkers in your area to go with you to her house and "talk" with her. If I lived in your state I would be the first on the list.

I dont have any words for this all i can say is, DONT let her get away with it!! If she has sold your puppy, she needs to be honset with you and tell you so she can contact another breeder and take you there so you can get another puppy on her expence! Its obvious that she thinks she's dealing with a "minor" is it possible to take your parents or inlaws to this woman? I wish i could help you!

You and your boyfriend must have a lot of self control. Personally when she first opened the door for you I would have walked in and taken my dog. If she threatened to call the police I would have asked her to please do. Someone said it earlier, she stole you puppy. The laws read differently in every state but it basically is theft by deception as stated earlier. The police officer that you spoke with was totally wrong it is not a civil matter it is a criminal matter. Go back to the police and ask to speak with someone in authority, a Supervisor or Detective. If you stll get no satisfaction go the the District Attorny's Office or City Prosecutor depending on what you have. As far as the AKC, they absolutely can get involved by not allowing her to register anymore litters unti this matter is resolved. Don't be frustrated, you've dealt with lazy people that don't want to do their job. As to speak with a Supervisor at the AKC too.. Good Luck
