I don't know the laws in your state. Now that you have paperwork to prove it's not a purebred, you need to negotiate a refund to keep the dog. If you happen to have a friend or family member who is a lawyer, sometimes a friendly letter or email with their letterhead might do the trick. The key here is to get some or all of your money and keep the dog. Sorry to see you go through this, but I wish you lots of luck and hope things turn out in your favor. |
what an adorable little dog!!!!!!!! seems very playful :) anyways i feel like your puppy is a mix. but then again i'm no expert. but from the pictures, she looks mixed |
Edit: I just read rest of it! ugggh! it really upsets me when people try to decieve an innocent person! i don't know what you can do because im not very familiar with law but i think you should post about the breeder anywhere possible!!! what she did was wrong! as for suggestion i'd msg people who live in your area and get an idea where they got their dogs from. also, attending dog shows and speaking to the yorkie showers about it. im sorry you went through this. |

2. I actually thought your pup looked very Yorkie/Jack Russel to me but I'm no expert. 3. Glad you did a DNA test and I'm also in CA...research the lemon law and also civil code violations regarding terms of sales-try the you were sold something other than what you were promised...unfortunately the judges in civil court here usually make you return your pup in order to justify the court's resolution and determination of fraud. 4.Also know that CKC registration (unless it being Canadian Kennel Club which is also silly to get in the US) if often a sign of "issues" AKC registration of a pup is also not without fault but the only registration of a pup you should be concerned with in American. 5. FYI California Health & Safety Code sections 122125-122220- try calling an attorney to give our a free consult if you are willing to take it so far... |
Does your city have a legal aid society? They are lawyers that will do you a service for a minimal fee. I got mad reading this thread. The nerve of some people!!! She tricked you and knew it, wow!! I would check into the legal aid and see what they can offer. I am so sorry this happened to you. |
Yes, it's sick how blatantly she lied to me. I am going to take her to small claims court. The advisor I spoke to told me to find out how much the dog is worth, like get an estimated value for her so I can sue the breeder for the difference. Does anyone know how I can find out how much she is worth? Thanks! |

I know this happened to one of my grooming clients years ago...but she paid the price of a purebred Yorkie at that time and got back $600. |
I am not sure where you would get an appraisal. I think shelters are a good place to start, perhaps a show judge or reputable breeder? Mixes are much cheaper than purebreds generally. In addition, your baby isn't a particularly popular mix or "designer dog" type, so I imagine there is no argument she is worth more to the market either. I would say your estimate is going to be well under $400, but that is just my opinion. My girl is a Morkie and I didn't pay much for her at all and no where NEAR purebred yorkie price, and she's considered a "designer dog." (God I hate that term, but I will apply it here to make a point). I would expect shelter price would be a fair estimate. Make sure you ask the shelters to appraise her EXCLUDING the vet care they give them, this would lower the price and rightly so because it sounds like YOU gave all the medical care. Also, please get reimbursed for any medical expenses that you should not have incurred as well. I am sorry this happened to you! Remember to argue for the difference because they might make you return the pup for a full refund. Also note: I would not recommend involving the legal system right off the bat. If you can get them to settle out of court, you may be able to get FULLY reimbursed (most people don't like legal ramifications waived in their face and may do anything to get rid of the problem). I would try bargaining outside of court first and then taking it to the courts if they don't comply. One caution about this method though!!!! Make SURE you know what kind of window you have to file a complaint, if you wait to long you may not have a case, so please ask a lawyer what your window would be. I hope this helps some. Your baby is absolutely adorable though and I'm so glad she brings such joy to your life!!!! That is what really matters in the end. |
Four hundred dollars is a drop in the bucket and Ive seen many mixes go for that price. Your going to pay alot more than that for a yorkie from a reputable breeder. I would keep the dog and accept it as a lesson learned. |
For what it's worth I think you should give yourself some time. See how Nibbler turns out. Believe me I KNOW how hard it is to get a standard Yorkie, especially where I live, but the extra time will give you an opportunity to enjoy her "puppyhood" and also to save some cash. She looks as sweet as pie! I checked out your album and love her! Keep being a proud Mamma! Good luck with all the legal stuff keep us posted |

Do NOT use an estimate from a pound, humane society or any other animal sheltering organization as purebreds are in those places at significantly reduced prices and this can go negatively for you. Especially in CA "designer dogs" are of astronomical and unbelievable retail prices...so go to 3 pure bred Yorkie breeders ***(hint hint contact YTCA breeders and tell them your story I'm sure they would have an interest in helping you considering the circumstances)*** and get estimates (written to submit to the judge complete with the value acessors 's contact information) from them as they are experts and they will give you a value based on what your pup is and this looks better as you were told you were getting a Yorkie and didn't so you are going with the experts in the feild you were already involved in (Yorkie breeders). Unfortunately petfinder won't do much, but hopefully people will read your review there. Follow through with the CKC and also obtain copies of her AKC report history-it will really help you to show that to the judge also...it shows a history of fraud from this person. |
I've had a lot of yorkies in my life and I'd say this is NOT a purebred yorkie I did try to think of what it could be mixed with due to that red coloring in its fur. at this age a yorkie is starting to break into adult hair colors and I remember my binky starting at around this age Her head she looked like an old lady getting gray hairs then it got pretty white the same with her back the silver started mixing in with the black. cute little dog though very adorable |

You did not purchase a "designer breed" you purchased a mixed breed as the breed mix is not of a popular hypoallergenic "designer" dog standard. |
In process of buying a puppy from this breeder!!! I am in the process of buying a female puppy from the same breeder that you guys are mentioning and i don't know what to do?? Reading what i have read I am gettingvery nervous anad upset. I went to this lady's house all the way in sun valley, ca and she showed me the puppy along with papers claiming that it would be a purebreed but after reading this i dont know what to think...I have only seen the way they look at 5 weeks and they looked fine so i put down a deposit of 100 dollars. I havent really heard from her much, and when i texted her that i wanted a picture of the puppy now at 7 weeks she said that they moved too much and had problems taking pictures so she sent nothing. Do you guys have any advice...should i go along getting the puppy in march basically waiting it out and seeing what the puppy looks like or should i tell her that from what i have read that i dont want a puppy from her and how do i go about getting my deposit back when she made me sign this paper saying that i coulnt get my deposit back unless the puppy died under her care?? please any advice would be much appreciated, thanks. |
