Too late now for the OP, but here in New jersey you can be awarded treble (triple) damages if fraud is involved. We had a situation with a carpet store that was taking deposits when they knew they were going to be filing bankruptcy. The judge told us that if we won we could get triple. They were bankrupt, so of course we got nothing but a worthless judgement.
Point is, if it was this case, in NJ you would have been entitled to 3x what you lost (or in this case-paid) which should have enabled you to easily keep the dog AND get extra $. Something for others to consider in the future, even if only to use as a bargaining chip for a full or partial refund.
There was someone besides OP who did a DNA test (joanna??) What did those results say? I'd like to see pictures of NIbbles now. |
