BAUCK: SENTENCING

Kathy Jo Bauck is a dog breeder and dealer, operating out of Otter Tail County, Minnesota.

Bauck's kennel name is Puppys on Wheels (formerly Pick Of The Litter); ownership of the facility has been transferred to her husband and daughter. As of this date, the kennel continues to operate. (Scroll down to bottom of this email to view some of the breeds produced.)

On Friday, May 1, 2009, the Court sentenced Kathy Jo Bauck on one of the original four counts: Count 5. (The four counts are listed below.) Bauck was sentenced to 90 days in jail for this count with 70 days stayed, and a credit for 5 days already served. This means Bauck will serve 15 days in custody. Also, Judge Senyk sentenced Bauck:


· to pay a $1,000 fine; however, $500 was stayed so total fine is $500
· to perform 80 hours of community work in her own community
· to be placed on supervised probation for one year, concurrent with her prior probation. (Concurrent means "at the same time." Bauck's prior probation was due to practicing veterinary medicine without a license and is unsupervised for two years, which will be up on May 19, 2010. Bauck's current supervised probation will be up on May 1, 2010 - ending before her earlier probation is completed.)
· as long as Bauck is working with animals, she is to allow the Minnesota Humane Society or other agency (as recommended by probation officer) to inspect the kennel without notice (as they determine necessary) and to allow inspection of the entire property.
· not to have same or similar violations for one year.


The first sentencing hearing was held on April 24, 2009. No sentence was given at that time. A second hearing was scheduled for and held on May 1, 2009.

Note: On March 24, 2009, a jury found Bauck guilty on four misdemeanors (three counts torture, one count animal cruelty). This included:

· Count 3 (torture) Minn Stat. 343.21 sub. 1
· Count 4 (animal cruelty) Minn. Stat. 343.21 sub. 7
· Count 5 (torture) Minn. Stat. 343.21 sub. 1
· Count 6 (torture) Minn. Stat. 343.21 sub. 1

Yes. Not good. We posted the sentencing on the Animal Folks website.

Basically, the Court sentenced Bauck to 15 days in jail, $500 fine, 80 hours community service and supervised probation for one year. The kennel still operates under the ownership of her husband and daughter.
No animals were seized.

We'll be sending out an email soon to everyone (Animal Folks database) with a few suggestions as to what steps can be taken.

This proves again why regulation of this industry is needed --- we have to get the regulatory bill passed.

This is absolutely ridiculous! 15 days??? That's it? Misdemeanors? THAT'S IT???? I am personally furious about her sentencing. You know what happened to me for selling fake purses? A FELONY, 30 days community service, 3 YEARS FORMAL PROBATION (you have to pay for probation in case anyone didn't know that), over $20,000 fines, and that was for me and my boyfriend. Oh and we had no priors at all. FOR FAKE PURSES! That was them being nice to us too, they wanted us to do 9 MONTHS! We lost our home, everything. We can't get a job now because of the felony. Why wasn't her husband and daughter prosecuted as well? The system is so corrupt. She should have gotten life for her behavior. Why is the kennel, oops I mean puppy mill, still in operation???

That is not going to stop her. I see that that pups have been sold to pet stores in Fresno, Uggg. My neck of the woods . SHe's done business all over the United States . AND has gotten off W/O anything . Which means their will continue to be more sufferinf of innocent animals. Shame on our justice system.

I am sick. I thought I had seen a lot from working with Dachshund rescue, but I guess not. The "breeders" around here (Pasco County, FL) live up in the woods North of me and the conditions are bad, but not THAT bad. All these sweet puppies want to do is to love us and be in a forever home. These people need to be in prison for life. I'll bet some of the puppies came to my area because it says they were sent to Orlando, FL. I will alert friends in that area.

I am not sure I guessed that since the charges were against her that selling the business to her hubby and daughter was a way to keep the business. It's still operating because no charges were filed against the new owners.

It doesn't seem fair that you were harming no living thing and got into more trouble than someone who was. Makes one shake their head in wonder.
