| More puppymill info I just found this as well. This is more propaganda that millers toss around. They are opposing the California legislation because: The Issue. California Assembly Bill 1122 would make it illegal for a person to transfer, as a commercial transaction, a live animal in certain public places. The bill also provides a range of penalties for violators. The rationale for this bill revolves around increased reports of people selling dogs, birds and other pets in unregulated public venues. The Impact. Under this legislation it is unlawful for any person to willfully sell, trade, barter, display, or offer for sale, trade, or barter, or give away as part of a commercial transaction a live animal at any of the following: on any street; highway; public right-of-way; commercial parking lot; swap meet; flea market; parking lot sale; carnival; boardwalk; or any outdoor special sale. First time offenders of these provisions will be guilty of an infraction punishable by up to a $250 fine. A person found in violation for the first time and, by that violation, either causes or permits any animal to suffer or be injured, or causes or permits any animal to be placed in a situation in which its life or health may be endangered will be guilty of a misdemeanor. Second time or subsequent offenders will also be guilty of a misdemeanor. Anyone guilty of a misdemeanor violation will face a fine of up to $1,000 per violation, and a court may access the severity of the violation in setting the fine. These restrictions do not apply to the following: An event held primarily for the auction or sale of agricultural livestock; A tax-exempt nonprofit organization founded for the prevention of cruelty to animals; or A public animal control department. March 4, 2009 (CA SB 1122) 2 Recommended Action. Similar legislation has been already introduced in Tennessee and we expect to see it pop up in other legislatures across the country. Assembly Bill 1122 has yet to be assigned to a committee.
