Www.tinydarlings.com PLEASE FORWARD THIS TO EVERYONE YOU KNOW! DO NOT PURCHASE ANY PUPPIES FROM WWW.TINYDARLINGS.COM. PLEASE SPREAD THE WORD!! I ordered 3 puppies from this site. Payment was made in full (to waive the shipping cost of 200/dog). The three puppies were to arrive on 11/11/04 but only one came. The seller stated that 2 of the 3 were sick and recommended that I wait until they got better. 7 weeks later, they didn't so she said she would get me the same breed from a different litter and that they would be ready mid-end of January. My last contact with the seller was on 12/30/04 confirming that the new puppies were fine and everything was set for the end of January. Ever since that day, I have sent her numerous emails and tried to contact her via telephone and she has NOT responded AT ALL. If there was a problem, she could at least have the decency contact me to advise me of it. I even created a "fake" email to send to the seller and she responded immediately (thinking that I was someone else) and telling me that she had more puppies to sell. I am extremely upset. Not only am out out a lot of money but the stress of trying to figure out what's wrong is worst! Now my neices NEVER got the puppies I ordered for them! |
im so sorry about this.. thats real BS to me.... there has got to be somthing that you can do about it.... did yo happen to save any of the emails that were sent to you by that breeder, emails that might state everything the breeder said to you. maybe about your purchase and other things...if so and you dont hear from her very soon about your dogs and if shes not answering you, i would find a way to get your money back or make sure you get the dog... there is always court..... good luck with your money or dogs |
contact the "better buissness bureau"........ If her buissness is "legal" (as in she is paying income taxes on teh puppies she sells) then they should help straitin it out....... and if it is not legal (as in not paying taxes and recieving all this money and not having a buissness license) then she wil be in BIG trouble, not only with paying you back ..... but also with the government (IRS, Buissness bureau, ect...)........ i would try this rout if she doesnt answere your e-mails........ you could even e-mail her one more time to let her know you are going to cantact the bureau about her buissness practices (or lack of) and she will probably be REALLY accomodating to you just because she doesnt want to be reported........ oh, and one more thing..... i would be careful about posting her name and or actual buissness name online because she might be able to use that as slander... (there is a lawyer on this site rite????..... i know there is a reason you shouldnt call them by name, i think it is slander...... ) anyways....... this is my advise..... I hope everything works out |
It's defamation of character, but if the woman really did these things, then it's not defamation of character b/c the information relayed is true. AKA, slander: the spoken defamation and libel, the written defamation of an individual is illegal, if the information relayed in untrue. I am not an attorney, this is practically word for word from the book, but I am a journalism major -- we cover the same stuff there as far as written and broadcast goes for media law. You should contact the BBB and the local authorities in her area. If you can find a shelter in her area, you may contact them as well, just in case they can step in if there is an investigation and remove the animals if needed, if charges are pressed, if miss tinydarlings has done something that warrants the action. And, if you find yourself having to press any charges, you may also contact the media in her area, as they would love to cover a story of this nature. |
I was a journalism major too, but now I'm graduating law school in a few months. I AM NOT giving you legal advice, but here's my take on it: It's not defamation of character, slander or libel...that's only if she said or wrote something bad about you. For that, you need proof that the bad thing she said about you was not true. There's also a contract on the website that expressly states that if you pay in full, she will not refund your money, but will give you a puppy when one becomes available. It also says that she can stop the sale at any time. Unfortunately, that's the contract she got from you. BUT...all is not hopeless. I would suggest contacting a local attorney who is familiar with sales transactions and/or animal law. Attorneys might be expensive...it might be more to get one than the amount you'd make back, so your best bet is to contact your local legislature, ie: congressman, to find out what steps can be taken. You'd be surprised at how helpful your legislature can be in these circumstances. You might also want to take a stab at contacting the ASPCA or animal control if you suspect this woman is abusing the animals by overbreeding. It all depends on what state you live in (and this woman is in), but it's definitely worth an investigation. Good luck and let us know what happens!! |
I think we're looking at it from different views lickthestar -- orinsky warned BBtrinna not to make slanderous/libelous posts. I was indicating that if what BBtrinna writes about this tinydarlings woman is true, then BBtrinna could not be prosecuted for slander, libel, or defamation of character. |
Thank you Thank you everyone for your feedback. I will definitely do all of the above. Just to let you all know, I have ALL email records of my conversations with her. I even have records of the "fake" emails that I sent to her with her response of having more puppies to sell. I am not trying to slander anyone. I just wanted to bring it out so this doesn't happen to anyone. I don't think (and please let me know if I'm wrong) that what I wrote was bad, it was the honest truth. I am just very frustrated. My friend sent her an email a few days ago (just to see if he would get a response) and GUESS WHAT? She did respond to him (within a few hours). I'll try to remove her name from my original posting. I would hate it if something like this would happen to someone else. Thanks again and take care. |
you did the right thing, and we are happy to be warned about breeders with "shady" practices....... i more or less said that for your protection because nowadays people will sue for anything and i would hate to see you penalized when this lady is the one doing wrong ..... not you........ if she would try and rip you off, then she would probably be one of those people to sue for just mentioning her name......... I am glad you have all teh e-mails, and teh "fake" ones...... i still stand by my opinion of reporting her to the BBB, even if she does give you your puppies (and can i say what a NICE aunt you are for buying puppies for your neices,,,,,, you know i could always use another aunt!!! :p ).... i took a look at hte contract as well, and so far as i see she has covered all her bases pretty well, the only loophole i could see her using is the fact that she says she will replace and give you a new puppy WHEN SHE HAS PUPPIES AVAILABLE...... this seems to be the key sentence, because she can always claim that she doesnt have any for you (BUT ......... GOOD FOR YOU!!!....... YOU PROVED THAT SHE DOES HAVE PUPPIES AVAILABLE!!!!!!!!... and as an added plus those e-mails you have probably have dates on it.... so there is NO WAY she could weasel out of it!!! :D ) I'll be rootin for ya, i hate these "shady breeders" we hear about them ALL THE TIME here...... GO GET HER (and you had better get her good so she wont do it to someone else ;) ) |
Orinskye said it all .. amen! Lickthestar is correct to -- legistlature members always want to be voted back in and will serve the public better than any other public officials. The BBB can act sort of as an abritrator if there is a breech of contract, and obviously she can't take your money without providing the service she advertises. Best Wishes, and we are all rooting for you! I am so thankful I insisted on going to pick up my pup before I handed over the lump sum we paid. There was no way I was going home without taking Luca Dean after I saw he was outside, being fed well, but not good food, in dire need of grooming, etc. He was what the vet considered healthy condition, but by no means pampered -- which every yorkie deserves a chance at. You are doing your part if you go after her to reduce the number of yorkies that don't get the full 4-6 hours of attention they need each day!!! |
Update Hi everyone. Here is the latest update. I sent an email to the guy that does her website and found out it was her brother! I basically told him the same story as what I posted and told him that I was going to take legal action against her. He said he would forward it to her and make sure that she gets it. GUESS WHAT? I finally received an email from her but she said that she has been busy and that she was indecisive on what to do with my situation....I know that it's a bunch of BS. I responded that I didn't want to play games and that she has 2 options... either send the puppies or refund me the money. I will keep you posted. The reason why I purchased three was because I was getting one for my daughter and I only have 2 other nieces whom I adore and they have been wanting one for a long time. They're doing excellent in school and have shown that they are both responsible enough to take care of a puppy. Also, their parents were quite happy that they didn't have to pay for it! :) You also have to remember that if you buy one niece a puppy, you'll have to buy the other one too.. it's only fair. They've been waiting since November. They call me almost everyday to see when the puppies are coming. I haven't told them the truth. The puppy we did received... we love our little guy. We named him Peanut. He's quite a character. Thank you for all your support. I will definitely keep you posted. |
good that it all worked out, but i would still consider contacting the BBB regardless of what she said (after you get the pups of course) ......... lol...... on a lighter note..... WHAT ABOUT ME??? havent you heard that i am youre long lost neice???? Good luck, im keeping my fingers crossed for ya....... |
Welcome Peanut and BBtrinna and congrats on your progress thus far! |
Just to let you know, I have heard stories about her and her website and her taking money from people and not delivering on the puppies and making excuses. I think if you go to the website www.yorkiepup.com you can see numerous emails from other people that have dealt with her and many of them have contacted the detective in her area and also have filed complaints with the better business bureau about her. She has a lawyer herself (or so she claims to these people), but there is a case against her I believe. You can go to that site I posted above and read the emails from other people that have been unfortunate enough to deal with her. I really hope you do get those puppies for your nieces sake and I am glad to hear that your baby is doing great! Good luck to you!!! |
Oh just scroll all the way down the page as soon as you get into the site....it says BUYER BEWARE... |
Just went to that web-site and it is amazing that woman is still in business. All should contact the lawyer and hopefully run her out of business. |
lucynfred--I apologize! I misread. Yes, this is an awful thing...just a few things that tipped me off about this woman from her website was the agregious contract that she gets from people, and the fact that she asked for a cashier's check or money order to be mailed to a PO Box. Few people who had a good "product" would request that, plus, it's a way for her to hide her money from the IRS. It's as good as cash. Also, there are other people who have websites dedicated to how awful this woman is (www.yorkiepup.com). She even goes on to talk about what to do if your "teeny tiny darling" acts drunk!! Argh! I'm so angry at her!! If she's got so many customers, how is she able to fill her orders so quickly unless she's overbreeding?!! Those poor little yorkies she's selling...I hope that this woman is put in jail because she's really sick. Please buy your yorkie from a reputable breeder, or adopt one from a shelter. I wouldn't buy from yorkiepup.com, either, only because any reputable, honest breeder would never sell "teacup" yorkies. Consider checking the AKC website on how to get in contact with reputable breeders in your location. I'll be honest, I got Archie from a pet place in NY, but I found out that they got him from Lake Country Pets. I wasn't sure what Lake Country Pets was, but I now know it's a broker. So I called and found info about the breeder, and that the breeder only breeds yorkies, only a few at a time, etc. I'm not sure if Archie came from a puppy mill...I hope not, but I have him now, and he's healthy and happy and the best ever. Even to save yourself from the craziness of trying to track down where your puppy actually came from, like I did, it's best to go straight to a good breeder... |
I've only been around the yorkie internet world since a little bit before Christmas but had seen several warnings against this woman in other places. If she doesn't deliver, we is at least guilty of fraud and misrepresentation. Best of luck to you!! I'm glad I stayed clear of her during my search for my new family member. |
Her response to me today You would not believe it. After my email to her she now says (which is total BS...again) that she had not forgotten about me BUT the puppies from the new litter is now sick!!! What a bunch of crap! I finally told her that I didn't want to do any more business with her and that I wanted my money back. I told her I wanted a money order sent out first thing on Monday. Hopefully, I will get my money back. I will check that website and post something there too. |
Looking for new puppies now Hi everyone. Hopefully, when I do get my money back, I will be looking to purchase 2 more puppies. I have learned from this experience. If you have any recommendations on any specific breeder you know of, please let me know. Thank you!! |
yorkiepup.com I am so scared now! She had taken money from so many people!! I am so scared that I won't get mine! On the website, it has a detective's phone number and I will be calling him first thing Monday! Thank you soooo much everyone!! |
BB Trinna........ if you get your money back from this woman, i would suggest looking for breeders in your area..... where you could actually go and inspect the premesis and the puppies BEFORE you commit to buying them...... Keep us posted on what happens, like i said if you decide to buy puppies from a breeder in your area we can help you with the many questions you should ask to make sure it is a reputable one :p good luck |
Im sorry that happened. I wish you the best of luck, and I hope you take her down! ^-^ sorry, but anyone who would do that....in this kinda line, is terrible. |
Yes, best of luck to you BBTRINNA, I'd say call the local authorities (in HER city), and the credit card company if you paid via credit card, or call the post office if you paid via other methods, as that is MAIL FRAUD as well to accept money and not deliver services/goods. Also contact a lawyer if they don't follow through with what they say. But at least you did get your Peanut! :) |
the problem with tinydarlings is nothing new...people have been having problems with her for a very long time. There are some issues with yorkiepup as well. I just want to caution everyone when looking at a website that sell pups, you need to look for red flags. Both site are waving their red flags proudly. |
horrible I tooked at the website with the email complaints. This is horrible. How can this woman live with herself? Horrible, Horrible |
BBtrina what state are you located in? |
California. I put a posting on this site to see if anyone has 2 puppies to sell (I can probably send 500 for each) but that's it. I'm crpssing my fingers that I get something back from that horrible lady! Thank you everyone for your support!! |
Did you read this thread? http://yorkietalk.com/forums/showthread.php?t=1378 Your best bet is to just contact breeders in your area and ask them questions and find the best. When it comes to pets, even if you spend a little bit more, it's better to give healthy pets to others or else they might resent having to pay for vet costs (I read a Dear Abby about this a while ago, where someone gave a cat and the recipient later asked them to pay for the vet costs). If money is an issue, then adopting might be the way to go. Pets are living, breathing creatures who we are choosing to give a home, not only for our sake, but for theirs. |

look at his contract page at the bottom...he owns the name to all of those he has listed. Just really think about buying off the net. http://yorkiecontract.homestead.com/yorkiecontract.html |
