Should breeder be responsible for cryptorchid????? I really need help!!!!! I purchased a yorkie male from a breeder : I thought was a friend (Boy was I DUMB!). She knew I was looking for a tiny male and while we were talking she said she had a wonderful tiny guy. I was wanting him to use as a breeding male to my 2 females, and she knew this. At the time of purchase she gave me a copy of her stud contract to use when the male was used for stud. I ask her what would we do if something were to come up if he couldn't breed. She was smooth, she said we'll figure it out when the time comes. So she got my money. When I took him home he was crusty with flea crud, ear mites, worms of all kinds. The vet checked and treated him for all listed. I called to tell her about the puppy, and her answer was: It is dirt from where he was playing outside. She had to tell me that she is so good with he puppies her vet always recommends her to anyone looking for a Yorkie. Her vet told me this was untrue as they never recommended her. The story only gets worse. I contacted her to let her know that only one of the testicles was coming down, what could she do. She said give him time as yorkies are slow to develop. Well he has only one testicle. I've had him to 2 vets and they say its a defect that can be passed on. I have called her to request that she replace the dog or refund my money. After a year of hearing she doen't have any male puppies, she doesn't have any females bred(she has 9 females I know of and breeds every heat cycle), and she can't guarantee a male to have 2 testicles (She said B-lls). My proven female was in again and I had tried to breed him twice with the male (he was old enough to breed) at her request: that just because he had one testicle didn't mean he couldn't produce. Well he couldn't, and can't. So my final attempt was to contact her and ask if she had any puppies, NO. Well did she have anything I could use. Yes she had a male (she had bought him back for 1/2 of purchase price. He was 1 year old and 1/2 brother to the male I had. So I thought HUH! we'll she how far we can go with this. I ask what she wanted for the male and I just needed to come look to see if I liked him. After getting this answer again. I got my courage to ask what she could do about replacing my male with the male she was offering me forsale..... She told me that she couldn't do that the dog was promised to her son. She did offer me one stud service and she would take my male back. Big offer for me. I'm out the money and she wants more. I've since filed a lawsuit in smallclaims. So what I need from you all is answers. Shouldn't this breeder be responsible for this male????? Thanks to all who care to help. yorkEluv |
Unless it was stated in a contract that this puppy was purchased for breeding I think there is much to be done. Now if she is being smart and not will to exchange, I really don't know what to say cause this would make me mad. :thumbup: |

First, whether possible or not, don't ever try to breed a male with only one testicle! Two, you thought this woman was a friend?? And you bought a puppy from her that had fleas, worms, and ear mites?? I'm thinking that you really didn't know this woman that well. As far as filing a lawsuit, Do you have proof anywhere that you were planning on using this boy for breeding?? How about a health issue?? Do you have a contract of sale? Something saying the dog is healthy?? If you do, you might be able to win, because a dog with onnly one testicle should be fixed as it could develop cancer later on. I'm not picking on you and the Lord knows I have made many mistakes myself, but breeding Yorkshire Terriers, or any dog for that matter is not an easy task, we must first be fully knowledgable, know what we are looking to achieve, and then go after if, money not be a opinion~ When I lookied for my male it took me at least 8 months, if not longer to find him and then I had to travel to pick him up. ;) |
First let me state I'm very new at this and I know I have a lot to learn. The little male is well taken care of and all 4 of my yorkies live as family in our home. It sounds like I'm a whiner and maybe I am, but the situation never ends with this person. This "person" is also advertising her puppies using pictures of my dogs on a puppy website. When I called her on it and requested them removed. She promised to sell this male on the site for me. I know for a fact that if she were to get this male back he would be sold. There is nothing in her house that isn't breedable, or cranking out puppies. I would be more than happy to neuter and place this male in a loving home. BUT I think this "person" needs to be accountable for their actions. If she does this to her "Friends" what is she doing to others. Money or another dog is no longer the answer. If action isn't taken this will only continue. As we know hind site is 20/20. |
This might not be able to help your situtation but do you have Puppy Lemon Laws in your state? If you do, research it. And inform this "person" about it. |
Who is this "person" and what is the website, so we could all beware? |

When they have zero testicles, it's called cryptorchid. One testicle is Monorchid. I'm sorry to hear that you didn't have a contract. You're best bet is to have him neutered and either rehome him or keep his as a pet. Retained testicles become cancerous. It's a shame that you've had to deal with the likes of her. A dear breeder/friend of mine is dealing with this and it's the first time to ever happen to her and she's got 3 pups that are monorchid from the same stud. He's never produced pups like this but they all come from him. Anyway, you may just have to cut your losses on this little male and like I said, neuter him. Just because it is possible to produce pups with a monorchid doesn't mean that they should be bred. It's a hereditary defect and people will respond to you as you have this breeder. |
How old is this puppy because testicles can still come down as a puppy matures? It is not uncommon for the testicle to descend later. I think it is a little early to consider neutering especially if you are considering returning the dog. Good luck in reaching a resolution. |

I first need to say HE did not go back with the breeder. Nor was I planning to allow him to go. He is at this time being placed in a wonderful pet home approved by myself and a Veternarian. I did not charge for him. My concern was his care & happiness. He will be neutered and checked on to see everything is as it should be. He cannot be sold or placed into another household. If it is you don't know me. As for your comment about buying from a reputable show breeder. That I would of have plenty of recourse, and they only sell to those who want to learn acordingly. Cheap Shot!! As for recourse I think; maybe or maybe not. And for wanting to show and learn accordingly. Not everyone has the money to purchase a "very" expensive show/breeder yorkie, and have the money for campaigning this dog to a championship. It is more than costly and VERY POLITICAL. I have learned a lesson from this experience and the last thing I need. Is someone to judge me and rub my nose in it. I hope you will rethink being so judgemental. You did several good things here that should be lessons for all of us, including pursuing your victory in small Claims Court. I'm also glad you were able to find a forever home for this puppy. Pat yourself on the back you did a good job . |

One thing you should check for before purchasing a pup. Not getting on you, it is a learning lesson, unfortunately.) In young pups many breeders make sure they are descended. Once that canal is closed they do not descend and sometimes it is a difficult operation for the dog. Check to see if your state has a dog lemon law. If not I am afraid you may be out of luck. Make sure contract states you are purchasing for breeding. |

I just wanted to update all that was kind enough to help me with my ordeal. As you know My little guy was placed in a very wonderful home and is very loved. His new Mommy called to say he was going tomorrow 4/05 to be neutered. She said she thought maybe I would want to call the vet to check on him, too. It's such a happy time yet its sad. He is so beautiful, and we so wanted to use him as stud for our 3 girls. It didn't happen so I can only assume it wasn't to be. I have been looking at other male yorkies. My husband says; I can't keep judging everything I see by the little male we place. Maybe someday there will be another small Babydoll faced little guy come into our lives. I'm new here and still have a lot to learn about Yorkies and breeding and all that fun stuff, but one thing I have picked up along the way is that if cost is a big concern for you, you may want to re-think breeding dogs, especially Yorkies. Buying the dams and stub are only the beginning, they should see a vet for at least two sets of shots and worming and check-ups...not to mention tail docking, dew claw removal and, I haven't looked into it too much - breeding is low on my list of priorities right now, but isn't there an ear trimming proceedure in there somewhere as well? None of which I would attempt at home. It can add up quicker than a lot of people realize when they're blinded by the sale price that some of the dogs are fetching. I'm certain that nobody has ever set out to become the sort of breeder that you had to deal with with your little boy. But costs and lack of time can quickly make you into one if you're not careful. I'm also certain that no one here is trying to be mean or political, we just have the best interest of this beautiful breed at heart. Good luck with your new little boy! :) |

I am wondering how long you need to wait to know if a male is able to breed I heard there usually down by 2 months. |
I respect your integrity.... I have read this entire thread and I must admit, it has been an ordeal for you. I really do respect your integrity as a buyer with this little male. Your determination and strength thru out this issue is commendable. I went thru something similar over 20 years ago....lady sold me two puppies open papers, only to find a big defect with one of the puppies. In her pitch about the puppies, was that I could breed them, they were both females. (I never did or ever wanted to breed) Anyway, I called her with the info and she said...."I do not give refunds, you bought the puppy". Well, needless to say, after our phone conversation, she was willing to take the puppy back and I stopped payment on the ck." If she would have been upfront with the defect, I may have handled the purchase differently. Lesson learned on my end, and I will never buy or recommend her as a seller, but she still does very well with her breeding program.....I just dont understand it. :confused: As far as your breeder with this little male, the issue is as much that she is a friend, and with friends we tend to expect them to treat us with the utmost care....I tend to put my friends on a pedestal. Sorry that you had to deal with all of this in the first place. |
