Puppy Deposits part 2 Here's another question for you guys. In leu of all of the deposit threads lately, as a breeder, let's say...I took a deposit from you for a pup. As the pup got older, I decided that I didn't want to sell it. If there is no contract signed, is it my right to send you back your deposit and tell you the deal is off? If a buyer can change their mind about buying the pup, shouldn't I have the right to change my mind about selling it? |
absolutley!as long as you return the deposit, i don't see anything wrong with it. it is your right just as you said, and it is our right as buyers to change our minds. ofcourse it hurts if the buyer is excited about getting a pup then they not get the baby. but that is the same for breeders when buyers change their mind. the breeder is excited that the pup is going to their family then the buyer changes their mind it is the same thing. WE ALL HAVE A RIGHT TO CHANGE OUR MINDS! :D |
Yes, it is still your dog unless you signed a contractIMHO. Does this mean you are keeping another one of your babies? |

I didn't read the last post, but I want to put in my 2 cents!!! I think if someone takes a deposit, then that is a unsigned contract between two parties!! I don't think the buyer or owner should be able to say, Oh, I'm sorry I have decided not to buy your pup or sorry I'm not selling him or her (I've changed my mind). We take deposits and place deposits so we know in time we will either have our puppy sold or will be getting our puppy after it is big enough!!! Kinda like a hand shake!! Oh and this is my opinion!! I don't want anyone shooting me over this discussion!! :fallen: |

I have only taken one deposit and I never cashed the check... Most people don't like to leave them, and I can understand that.. and then most people also want to go and buy a puppy not wait until the puppy is ready!! I don't know if the deposit thing actually works!! |

I have taken deposits from those that have not bought from me before and really really sound like they want a baby from me and only me. Before I even accept a deposit, I have numerous conversations on the phone and by email I also get the vet reference. Then and only then I will accept the deposit. I am pretty flexiable with my deposit. I ask for it and stated that it's non-refundable if you decided you just don't want my puppy. I know things can happen that are out of our control. I will give a refund minus the deposit within a reasonable timeframe a week or two. Oh and Karen..'Bang Bang'..lolololololol |
I 've always had a signed contract, being either seller or buyer. However, I always hold on to the deposit from buyer until the puppy is picked up. I don't let my babies go to their new homes until they are at least 12 weeks or older.IMO a contract protects all parties. I've even had buyers make payments so they could get the baby that was right for them. I have contract for that as well. |
personally, i wouldn't pay a deposit without some sort of contract. i'm not completely without understanding for the breeder, but if the seller changes his/her mind at the last minute, i may get my deposit back, but i've just lost other opportunities to purchase other puppies from other breeders while i was being stringed along. |

I as a buyer would be so crushed if I had put a deposit on a pup and the buyer change their mind. I guess if there was a health reason that is one thing. But to wait for a pup and find out you can't have it. I think that is mean. IMHO you should decided before you advertise pups if you are keeping any of them, and then take deposits on those that are left. |
With No Contract, The dog belongs to the breeders until the pup changes hands. |

I've always taken deposits. No deposit contract, just a contract when the pup is picked up. Alot of the time I have taken a deposit for either a male or a female; not a specific pup. Heck yeah it's my right to send back a deposit and keep any puppy that I have bred. But I have never done this nor have I ever had to consider it thus far. Now unless they are older pups and a specific pup has been chosen and agreed upon by me and the buyer, in that case I would never say "i've changed my mind". If I have a certain litter that I may have an interest in keeping a puppy for myself, I will let my clients know this upfront and inform them that I have the first pick of this paticular litter. If there is more than one of the sexes they are wanting in the said litter, I'll take the deposit once they understand and have agreed to choose after I do. If I have no desire to keep a puppy from the beginning, I'll let them know and it's a first come, first pick and so on. I've never had any promlems with deposits. I run a very smooth show and I'm honest with my clients from the beginning. |

I too always take deposits and consider it a contract between myself and the buyer. I do not take a deposit until the puppies are born and at least 2 weeks old to be sure they will be healthy, Then I start down my waiting list and one at a time I contact potential prescreened buyers. As they respond and designiate what exactly they want , I request a nonrefundable deposit. I would think it would be a breach of that agreement to later change my mind and not sell the designiated puppy. After all if the buyer changes their mind they have lost one half the purchase price in the deposit. If I refuse to sell , I lose nothing. That doesn't seem ethical to me. This is just my opinion and the upfront honest way I want to be treated and I treat others the same. |

Lol...I will gladly take a deposit anyday. That way, when it comes time for them to go, I say to myself, "well, they already have deposits on them, I have to give them up" rather than "well, nobody wants them, I'll just keep them all." :D |
