I 've always had a signed contract, being either seller or buyer.
However, I always hold on to the deposit from buyer until the puppy is picked up. I don't let my babies go to their new homes until they are at least 12 weeks or older.IMO a contract protects all parties. I've even had buyers make payments so they could get the baby that was right for them. I have contract for that as well.

personally, i wouldn't pay a deposit without some sort of contract.
i'm not completely without understanding for the breeder, but if the seller changes his/her mind at the last minute, i may get my deposit back, but i've just lost other opportunities to purchase other puppies from other breeders while i was being stringed along.

i think that many would....but we always hear about how buyers "changed thier mind" and yet they don't get slammed for that. so that is why i feel to each is own. and we all have a right to change our minds. this isn't just a one sided thing it goes both ways, breeders get dissapointed when a buyer changes their minds and then asks for thier deposit back, and buyers get dissapointed when breeders change their minds anad return the deposit..things happen.

I'm glad you brought this up. I had someone waiting for a puppy from this Dreamy litter. We've been talking for sometime, she said she wanted a puppy from me..not sure of the sex though..male or female. So she's been on my wait list. I emailed her that right now only the male is available. I need a female and have decided to see how she turns out. I haven't heard from her yet. I wonder if she is mad at me. But then, why should she be. She didn't even verbally commit to to puppy, let alone what sex she wanted.

Please cross fingers she understands.

I can understand my view as well as hers..so I'm on the fence..

I as a buyer would be so crushed if I had put a deposit on a pup and the buyer change their mind. I guess if there was a health reason that is one thing. But to wait for a pup and find out you can't have it. I think that is mean. IMHO you should decided before you advertise pups if you are keeping any of them, and then take deposits on those that are left.

With No Contract,
The dog belongs to the breeders until the pup changes hands.

I know..but then you have some that just react the opposite... She hasn't even seen the pictures since they were days old...

I agreed. But on the other side, say the buyer changes her/his mind then the seller has to start all over to find the right home for the pup.

I've always taken deposits. No deposit contract, just a contract when the pup is picked up. Alot of the time I have taken a deposit for either a male or a female; not a specific pup. Heck yeah it's my right to send back a deposit and keep any puppy that I have bred. But I have never done this nor have I ever had to consider it thus far. Now unless they are older pups and a specific pup has been chosen and agreed upon by me and the buyer, in that case I would never say "i've changed my mind". If I have a certain litter that I may have an interest in keeping a puppy for myself, I will let my clients know this upfront and inform them that I have the first pick of this paticular litter. If there is more than one of the sexes they are wanting in the said litter, I'll take the deposit once they understand and have agreed to choose after I do. If I have no desire to keep a puppy from the beginning, I'll let them know and it's a first come, first pick and so on. I've never had any promlems with deposits. I run a very smooth show and I'm honest with my clients from the beginning.

I too always take deposits and consider it a contract between myself and the buyer. I do not take a deposit until the puppies are born and at least 2 weeks old to be sure they will be healthy, Then I start down my waiting list and one at a time I contact potential prescreened buyers. As they respond and designiate what exactly they want , I request a nonrefundable deposit.

I would think it would be a breach of that agreement to later change my mind and not sell the designiated puppy. After all if the buyer changes their mind they have lost one half the purchase price in the deposit. If I refuse to sell , I lose nothing. That doesn't seem ethical to me. This is just my opinion and the upfront honest way I want to be treated and I treat others the same.

I agree with Jess...she shouldn't be mad at you BECAUSE she did not specify what she wanted...sex wise.

I hope that you hear back from her but if not, I'm sure that you'll find him the perfect home.

But, you're right...some people take it to extremes and talk bad about the breeder when in fact, they should not.

Lol...I will gladly take a deposit anyday. That way, when it comes time for them to go, I say to myself, "well, they already have deposits on them, I have to give them up" rather than "well, nobody wants them, I'll just keep them all."
