Would just like to know how many breeders place their puppies on contracts? If so do you have an open door policy?

I have 2 seperate contracts. One for pet, the other for show.

What do you mean by open door policy?

If at anytime the dog is rehomed it comes back to you. I believe this to be one of the most important clauses in a contract. I love my dogs even when they go into their new pet home. I still worry about them and want to know they are always loved and given exceptional care for their lifetime. Even the so called show prospects I bought from ytca breeders I did not give them back, because I knew they would resell them into another breeding home. So I altered them and place them into pet homes, except for one who has to many health issues I kept her to make sure she gets the care she needs.

Absolutely, however, the clause reads that it does come back to me, however, I will assist in a rehome of my approval.

My Show Contract is a bit more complicated. I maintain approval of who the dogs are bred to and it is a 3 generation contract. In otherwords, any dog that is not kept by the owner will only be sold on pet only. The offsprings kept by the owner are also sold on pet only, and so on. Also, the dogs remain on co-ownership and can't be bred untl the dog obtains it's Championship.

I also have the $5,000 clause.

True, but a good breeder needs to make sure they cover everything possible even if they are placing with a friend! Just because someone shows a dog to their championship, does not make them reputable. We have court of laws for a reason and I am not afraid to use one to make sure my dog is protected.

Absolutely, that's why I only place pups in close proximity. Maintain constant communications. My contract states that I will groom and/or board said pups for no fee, for the rest of their lives.

You are right, a contract should be written with the dog's welfare at the forefront. Also, one should keep in mind that even though the dog may be of ones own breeding, there are lines to protect, the lines of those that came before us.

I understand why you started this thread. And what it boils down to, is ehtics, integrity.

But, keeping in mind the person owned said dog, breeds horses and views animals as livestock. Thinking that it's a dog or a horse. Sad but that's the way they think. The Yorkie world is a bit more stringent than that. Especially in the reputable world. The person that purchased the dog for someone else and then passed it to someone else....well none of them feel that they've obtained the dog via the back door. Something that is frowned upon.

It means that I can come over and walk right in anytime I am in the are!

I have wonderful lines in my dogs, but with that being said I did not run into any health problems until I bought in the wonderful akc champion sired dogs. I would love to go back to the old lines I started with. If I would ever decide to bring another yorkie into my home I would look at the dog first and the pedigree second. People and breeders should realize a champion pedigreed dog means nothing if the lines are junk.

My dogs welfare will always come first! Friends will always come second!

Are these contracts legally binding, like in that episode of Judge Joe Brown in that other thread?

In addition there are some that think that if they buy a Champion that it'll produce Champions. That doesn't happen unless one knows how to breed a dog (genetics, the fundementals of dog breeding). And then sometimes putting the right two dogs doesn't produce what you'd hoped. Not every dog should be bred. However, I have seen the offspring of the dog in question and correctly bred he's produced beautiful Champions.

Mine was drawn up by a lawyer. Hopefully I'll never have to test it. However, any contract can be broken, it's only as good as the two people signing it.
