I think your best bet is small claims court also, and report her to BB, and again to AKC in writing with copies of all your paperwork. At least if you are not compensated for not having the AKC papers you have put the word out against this woman in different ways to hopefully not let it happen to someone else. Nikki, I'm sorry you have had this experience. I have two puppies from Lorene. (Unrelated and bought at different times). It was a couple years ago, and we did not have any problems. The dogs were just as described and the papers came right away. However, I do know that she suffers from fibromyalgia (I think that is correct), and in recent years she had a lot of trouble keeping up with her dogs. I think she has been down-sizing as a result. I like Lorene and she was very helpful to me. I have a beautiful little girl out of one of her puppies. So, I'm sorry that you are having so much trouble. It may be that she is tending to her health instead of business right now. I hope it can all be straightened out. |
Hi everyone, thanks for the suggestions and PMs, it's all really helpful information. I think it's too late for paypal but I will try emailing them. I doubt it though. I know I am so stupid about this kind of thing, so I apologize, but I've never been in a situation like this. If I took her to small claims court would I need to have a lawyer? How would I go about this process? I'm sorry for being so ignorant. I realize I screwed up by not having a very specific contract with her in the beginning, but I do have all the emails that we sent to each other in a file, and I have her stating several times that she will send the papers, etc. I also have the bank statements where I paid her. I have the paypal receipt for the deposit and the extra cost on shipping as well. Like someone else said, I know I may not be able to remedy this for MYSELF at this point, but at least maybe I can keep someone else from ending up in the same situation. She did tell me about her health, but I was promised these papers with the purchase of the dog and didn't get them, and now it's been way too long with no response. I feel that I am definitely being ignored and cheated, and I don't think that's something that should be let go unresolved. |

I have no advice as far as how to get your money or her papers, but my goodness, there are more red flags here than I've maybe ever seen before! The headline of her website is "yorkie puppies for sale, tinys, teacup, akc yorkie breeder" :thumbdown:eek::thumbdown |

Sorry this is happening to you but maybe she is having health problems, as posted earlier. That being said, there's really no excuse for her mis-representing a dog to you. From what you've posted, it seems odd that AKC wouldn't be more helpful to you. When I bought Nemo, I copied and saved the web page before she updated it so I had further proof of how he was advertised, just in case. Best of luck to you in resolving this. I know nothing will change one thing about the dog you purchased, but maybe a little persistence will at least get you the papers and a partial refund. I do know that she charges more for full registration so at least she should take that off since you are unable to breed her. |
You don't need a lawyer for small claims, in fact, I don't think you are supposed to have one for it. All of your receipts and any emails from her should be enough. Small claims isn't like a murder trial, so you don't need dna proof that she screwed you over. I don't understand the concern over AKC papers if you aren't breeding. Honestly I would be more upset that you didn't get the dog you were shown and told you were going to get. What would you need papers for at this point? If it's just the principal of it all, I would still go on it being a different dog, since that to me seems to be the most deceiving part of the purchase. If it were the right dog, and you were breeding, I would be concerned over registration papers. |

I would get your lawyer to draw up a letter just enough to scare her. If she doesn't budge then I would continue with small claims court. |
