What Can I do?
 

I have a question. I had a terrible experience with a lady in Oklahoma whom I purchased a female from in August. I still have yet to receive her AKC papers that I was promised I would get the following week. I contacted AKC about a month or two after the transaction and after several months of their research this lady would not respond to their calls and emails and they told me "because you do not have an official bill of sale there is nothing we can do." However, I DO have a wire transfer receipt, emails where she gave me her bank account numbers and referenced that she had received the money and shipped, etc. AND paypal receipts for the deposit and some extra money on shipping that she decided I needed to pay the day of her ship or else she wouldn't do it. :rolleyes: So I still don't understand why her emails and those receipts aren't enough to prove it. To me if they have tried to contact her with no response that would be an AKC red flag and they should be inspecting her or something of the sort. I have read some awful things about her since then. I did not breed the female, her quality was terrible and much different than what this lady described and also her picture was of a different dog. I was told she was 7 lbs and she was 12. I will not be breeding her. HOWEVER, this is not right. I paid a HUGE amount of money for this girl as AKC registered, and have yet to receive her papers. I have emailed and attempted to call the breeder, no response and I doubt I'll get one. If I do I bet it will be ugly. I asked that if she is not gonig to send the AKC papers, I need a partial refund for buying an unregistered dog...but of course no response so far. Since AKC can't help me, what can I do? I will take whatever steps needed to get what I paid for, or at least try to.

I made a huge mistake, so word to the wise, when buying a dog online, be very VERY careful...:rolleyes::mad::thumbdown

I think for the money you paid, maybe the cost of a trip to her home (un announced) is in order

Lorane Matlock is her name...I know, big mistake...I wasn't aware of all the issues with her until AFTER I had made the transaction. :mad: And I paid $1200 including shipping for a 12 lb unregistered female...

And I HOPE that she IS going out of business, I have seen that statement on her ads before...but I highly doubt it....

What about small claims court?

If you paid with a credit card. I would file a complaint with them ans ask for your money back. The registration is part of the sale.

On their website AKC expicitly states they will not get involved with non-receipt of papers.

Probably your only resort is small claims court. Once she was served with papers and ordered to court in another state....I'm pretty certain she'd contact you.

If you paid for her by paypal, You could file a complaint! I would look into that route!

It's too late for that. You only have 45 days from the date of transaction to file a compliant with paypal.

Nicki I am so sorry. This is why I don't like AKC, they screwed around with me once a long time ago, so, now I don't even register with them anymore. Of course, I know you breed, so you really got taken. Wish there was some way I could help you.

I just looked at Lorane Matlock's website. I am always leery of people who have to "advertise" that they are religious. Actions always speak louder than words, and in her case, her non-action speaks volumes!

PayPal will work with you to get some of your money back if you paid through them. They aren't the fastest, but if you keep pushing them you will be compensated.

I think your best bet is small claims court also, and report her to BB, and again to AKC in writing with copies of all your paperwork. At least if you are not compensated for not having the AKC papers you have put the word out against this woman in different ways to hopefully not let it happen to someone else. Nikki, I'm sorry you have had this experience. I have two puppies from Lorene. (Unrelated and bought at different times). It was a couple years ago, and we did not have any problems. The dogs were just as described and the papers came right away.

However, I do know that she suffers from fibromyalgia (I think that is correct), and in recent years she had a lot of trouble keeping up with her dogs. I think she has been down-sizing as a result.

I like Lorene and she was very helpful to me. I have a beautiful little girl out of one of her puppies. So, I'm sorry that you are having so much trouble. It may be that she is tending to her health instead of business right now. I hope it can all be straightened out.

I know I am so stupid about this kind of thing, so I apologize, but I've never been in a situation like this. If I took her to small claims court would I need to have a lawyer? How would I go about this process? I'm sorry for being so ignorant. I realize I screwed up by not having a very specific contract with her in the beginning, but I do have all the emails that we sent to each other in a file, and I have her stating several times that she will send the papers, etc. I also have the bank statements where I paid her. I have the paypal receipt for the deposit and the extra cost on shipping as well.

Like someone else said, I know I may not be able to remedy this for MYSELF at this point, but at least maybe I can keep someone else from ending up in the same situation. She did tell me about her health, but I was promised these papers with the purchase of the dog and didn't get them, and now it's been way too long with no response. I feel that I am definitely being ignored and cheated, and I don't think that's something that should be let go unresolved.

Hey Katelin, how are all your babies doing? It sounds like you got lucky dealing with her. She was always very NICE to me when I spoke with her, but now she is ignoring me, and I know she's there because she continues to update her puppyfind ads. She has also been very dishonest with me. I don't know if this is something has developed recently or if you were just one of the lucky ones. I just feel that this was unfair to me...:( I'm glad you got your baby and everything went well! :)

I have no advice as far as how to get your money or her papers, but my goodness, there are more red flags here than I've maybe ever seen before!

Where is that? I don't remember seeing anything about teacup. When I got the girl she had maybe 4 puppies and 8 adults for sale and said she was going out of business. :rolleyes: I know it was stupid, probably the most stupid mistake I ever made.

I just checked her site and didn't see anything about teacups, etc.. I bought my little Nemo from her a couple of years ago and he was exactly as advertised and I got the papers from her within a week. Sorry this is happening to you but maybe she is having health problems, as posted earlier. That being said, there's really no excuse for her mis-representing a dog to you. From what you've posted, it seems odd that AKC wouldn't be more helpful to you. When I bought Nemo, I copied and saved the web page before she updated it so I had further proof of how he was advertised, just in case. Best of luck to you in resolving this. I know nothing will change one thing about the dog you purchased, but maybe a little persistence will at least get you the papers and a partial refund. I do know that she charges more for full registration so at least she should take that off since you are unable to breed her.

You don't need a lawyer for small claims, in fact, I don't think you are supposed to have one for it. All of your receipts and any emails from her should be enough. Small claims isn't like a murder trial, so you don't need dna proof that she screwed you over.
I don't understand the concern over AKC papers if you aren't breeding. Honestly I would be more upset that you didn't get the dog you were shown and told you were going to get. What would you need papers for at this point? If it's just the principal of it all, I would still go on it being a different dog, since that to me seems to be the most deceiving part of the purchase. If it were the right dog, and you were breeding, I would be concerned over registration papers.

I would get your lawyer to draw up a letter just enough to scare her. If she doesn't budge then I would continue with small claims court.
