| Always. But NYC law and federal law each offer certain protections of their own. Like NYC has leash laws. Federal law allows service dogs to be unleashed on voice or signal command. If I get challenged by city, Federal superceeds.

| For starters, if the rental unit is a pet friendly complex, then typically their would be a dog or cat deposit, which would cover damages. However, if their is a no pet policy, and a disabled person has a service dog, they are going to need to request accomadations be made for the animal , so the tenant can enjoy her apartment just like any other person. Legally I know in California, leasing agents or managers are not allowed to charge a 'pet deposit" on a service dog, because they are not considered "pets" However, it the service dog does cause damage to the home the tenet will be held liable. Lets say it is a puppy in training, and the puppy chews up a wall or corner of a door, the tenant is responsible, or the dog pees everywhere, tenant is responsible. Plus, if the service dog is a barker, and is found to be a nuciance, the management can give a notice to the tenet, to try to fix the problem, and if not still resolved the service dog may have to vacate the premisis. Those are legit and legal reasons for denying a service dog, plus if the apartment needed to change the structure of the building and cannot make accomadations due to that reason, legally they can say no.

| Often when I have to stay in a hotel that is not dog friendly with my service dog I am asked to sign a damage contract - they cannot charge a pet fee for a service dog, but if the dog creates damage the handler is responsible for that. My dog went to one of those "bijillion" dollar service dog training centers for about a year and is them re-created every 3 years. That, however, is not required by ADA and those training. Enters will give you a certificate of training. Omelet ion, but it is not required. Any agency, store, or facility can "eject" a misbehaving dog - makes sense -- then why can't they eject the kid that screams there way through their whole shopping event ![]() There are many suttle thing that a formally trained service dog will have, but certainly they are not always totally necessary -- example at training programs they teach the handler and the dog behaviors to keep them from getting poisoned- that is something that might be hard to show Target (which I have demonstrated to the store manager at one point). But then I know people with drivers licenses who shouldn't have them
