divorce laws in florida does anyone really know about them.. my brother just got served with divorce papers , he knew he was getting them, but he is all upset because in the papers it states the witch wants everything. he as 2 children 1 girl 17 and a boy 12..anyway he is just un controlable right now. the paper states she wants him to pay for her lawyers, alimony, maintenance, mortgage, kids insurance etc,, mind you she works in the court system.. he is afraid he wont have any money to live.. i just want to beat the crap outta her.. he is coming to ny tonight, this was already planned and she planned to serve him today.. thank god he can be with his family this week.. please i need some answers before i leave today so i can tell him |
I've never been through a divorce so I don't know this for sure but isn't it typical to ask for everything and then the lawyers negotiate and things end up being divided up in court? :confused: Hopefully being with family will help him through this...we'll be sending good thoughts your way. |
I cant be of any help but I just want to say I am so sorry and I hope he finds a good lawyer and thing work out for him. |

It's typical to ask for the world to start out with so you have room to negotiate. Depending on your brother's circumstances, financial and all of that will factor in. He may not have the means to pay her mortgage and all of that. I don't know their situation of finances at all, but I would definitely suggest strongly that he find an attorney. After which he'll state his ability to pay or not pay. It now becomes a matter of he said she said unless they can come to an agreement, which would be the most cost effective. Best of luck to him. |
Don't know about Fl, but I think most papers start out like that. Sounds like there will be alot of fighting for rights between the lawyers. Unfortunately, it usually takes a slightly crooked, or extremely powerful attny to win. Good luck to your brother in his hunt for the right representation. Just make sure whoever it is, that they know exactly what they are doing (yes, this is coming from experience - the losing end). I hope it works out for him. If she has the right attny, and he doesn't, he could still end up paying for things he can't. I ended up paying for my husband's support and alimony(we live in a non-alimony state) and we weren't even married because he was misrepresented. So, PLEASE, make sure he finds the right person. |
thank you my friends. i just feel so bad for my brother.. he is 51 and lost. he crys i cry. he calls my mom she crys she calls me i cry.. how can i just sit there and hear a grown man cry.. i feel sick... i want to be there for him.. his friends tell him that hes gonna lose everything.. i say impossible. ive been there..she can ask for anything she wants he just has to counter sue the witch... what makes her right, cause shes a woman... shes the one who went for this divorce.. shes the no good one.. he s the one who pays every single bill in that house.. and then some... shes the one who racked up a 25.000 credit card bill twice and my brother had to pay for it.. there is so much more to it and i just want solid answers to give him.. |
First of all, he needs to come up there, be with his family, and try to relax and enjoy the visit. When he returns to Florida, he needs to find an attorney, one who specializes in divorces AND that maybe comes recommended. Not sure of the laws in Florida (is it a community property state or not?) but there are laws in place in each state that sets a pre-determined amount for child support (which is subject to change based on the income). As for alimony, there again, there should be a set scale used to determine percentage awarded (if any!). I would not like to think that Florida, or any state for that matter, would award so much money that it makes the individual unable to survive!!! It should be set up to where he WILL have money to live on himself. Oh, and he also needs to make sure HIS papers state that he is no longer responsible for any of her debts. That way, if she racks up more credit card debt, he's not held liable for the payments. I know he's upset right now, as you all are, but hang in there Gina! Be there for your brother, just as you have been. He will be okay - I can't help but think otherwise! Will have you all in my thoughts and prayers:) Suzi |

he already has a lawyer and will see him aug 30 when he gets back. my mom flew down there a few months ago when the s**t hit the fan. she wanted to make sure he was ok.. i think he was suicidal ,he was.. my poor brother lost so much weight, down to 130 lbs believe that.. my dad saw him and just cried... he is a loner type of guy,, just into fixing he house and doing stuff manually, and of course his motorcycle... doesnt ask for much. dont drink, do drugs anything like that, but she sure does. we all seem to think she went the other way, shes been hanging around her girlfriend for a long long long time now... sleeps there, and the children know this... i dont really care if anyone sees the either cause i hate the bitch. i want to let it known. |
Make sure he has the best family/divorce lawyer around!!! Friend just went through a divorce this summer. Her husband filed. She got EVERYTHING...because she had the darn best lawyer in town. |
I don't have any advice, but wanted to wish you and your brother the best. I can't stand it when women or men have a decent, hardworking, loyal spouse and then they sh*t all over them. It upsets me to no end. Please give your brother a big hug from me!!! |
